Box 1179 New York 11971 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD January 9, 1996 Land Use 2576 Sound Avenue Baiting Hollow, NY' 11933 RE: Judith Schmid SCTM %t000-70-4-12 Dear Ms. Lachenmeyer: The following action was taken by the Southotd Town Board of Trustees on ~anuary 3, 1996; RESOLVED that the Southold Town Board of Trustees grants a waiver to construct additions to existing dwelling with the conditions that drywells ,are to be placed to retain roof runoff, the pipe leading to the bulkhead is removed, and the. disturbed buffer along the bulkhead is planted with a non-turf, non-fertilized buffer as agreed. This approval does not constitute app~ovat from any other agencies. If you have any questions, please do. not hesitate to contact this office. New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL At the meeting of the Southold Town Conservation Advisory Council held Thursday. November 28. 1995, the following action was taken: WR-32 Moved by Bruce Loucka, seconded by Scott Hilary. it was RESOLVED to recommend to the Southold ToWn Board of Trustees DISAPPROVAL of the Waiver Request of JUDITlt SCHMID 70'q-12 to construct an addition to a single family dwelling. The Council feels this project requires a full application. The project could have a potential negative effect being so clo{e to the water. The Council would possibly approve a Wetland Application if appropriate erosion and sediment controls are addressed. A second concern of the CAC deals with the current status of the property. It appears fill has been placed above the bulkhead and is allowing lawn runoff into the creek. Applicant must be required to remove the fill and establish a 10' non-turf buffer to meet current code. Zagata Ms. Judith Schmid 5 Ironwood Road Morristown, NJ 07960 Schmid Property Wells Avenue, Southold SCTNI #1000-704-I2 Dear Ms. Schmid: Based on the information you have submitted, the New York State Department of Environmental Conservation has determined that: the property landward of the functional bulkhead greater than 100' in length and constructed prior to August 20, 1977 as shown on Tidal Wetlands Map #716-548 is beyond the jurisdiction of Article 25. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the. tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result 'from your project. Such precautions may include maintaining an adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier, or hay bale berm. Please be further advised that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from other agencies.
