Pursuant to your request, I reviewed this file. It
appears that'the :~threec:.tots were reduced to a two lot subdivision
when presented to the Planning Board due to a denial by the
Suffolk~County Health-Department for thr~e lots. The Planning
Board'approved~two~lots~subject to ZBA approval. You have
advised that the application for ZBA approval was withdrawn by
the applicant in 1983~
Also noted in file is a permit Zrom the DEC for
construction of three single family dwellings, dated 2/29/88.
Did the applicant Submit the original three lots to DEC? Has the
Suffolk County Health Department changed their position?
In'any event,-.vacant lot C.O.'s-should no{ have been
issued for either the-two lot subdivision,.since that has not
been completed, nor for the three original lots.
