By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties (SEE REVERSE SIDE) (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immedlate vicinity of this property and in the same use district because (SEE REVERSE SIDE) (c) The variance (does) (does not) observe the spiri~ of the Ordinance and (would) change the character of the district because (would not) (SEE REVERSE SIDE) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector (:) be confirmed ( ) be reversed. CG: lk ~ ZONING BOARD OF APPEA/~ FORM ZB4 After investigation and personal inspection, the Board fin~s~ as follows: By this appeal, appellants seek permission to convert a nonconforming preexisting one-family dwelling in a B-1 Zone into a two-family dwelling. The premises consists of a parcel of land. having 12,930 square feet in area, with 95.32' road frontage and ~ depth of approximately 132' The premises are improved with a 2½-story framed house, the rear of which is 1½-story, and privat~ garage in the rearyard area. The premises has been prior to zoning occupied for one-family use and accordingly has a nonconforming use status. The Board also finds that the properties located in the S immediate vicinity are of a character similar to the instant parcel and accordingly the appellants' circumstances are similar to the circumstances existing generally in the neighborhood. Appellants have not.shown, whether or not they can obtain a fair return of the investment into this B-1 property. The Board finds that the relief requested is substantial in relation to the'Code requirements; that the relief requested is not unique; the spirit of the zoning ordinance would not be observed if this variance were granted; no substantial hardship has been shown; and the interests of justice would best be served by denying the variance requested herein. On motion by Mr. Grigonis, seconded by Mr. Douglass, it was RESOLVED, that Alfred T. and Audrey M. Young, by Rudolph H. Bruer, Esq. as attorney, be denied a variance to the zoning ordi- nance, Art. VII, Sec. 100-70A, B, without prejudice, in Appeal No. 2820.
