No. 5182 — R.W. REINIGER Property Location: 3500 Lighthouse Road, Southold 1000-50-2-1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the east side of Lighthouse Road (at the north end or dead end), in Southold. The lot consists of 18,908 sq. ft. in area, and is improved with (variable one and two story) frame single- family dwelling as shown on the survey prepared by John C. Ehlers, L.S. dated February 18, 2000, amended April 3, 2000. BASIS OF APPLICATION: Building Department's April 22, 2002 Notice of Disapproval denying a permit to construct addition(s to the existing dwelling for the reason that the additions will not meet the minimum 35 ft. rear and minimum 35 ft. front yard setbacks required under Sections 100-242A and 100-244 of the zoning code. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 17, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: Relief considered in this application is for a 3' by 8' 4" one-story shed/addition at the southeast corner of the dwelling, leaving a setback of 6.5+- ft. from the closest property line and 12+- ft. from the southerly property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. This lot consists of almost 19,000 sq. ft., most of which is located below the Coastal Erosion Hazard boundary line. The lot has a small building envelope which is improved with a modest contemporary style with nonconforming setbacks from all property lines. Reiniger f 4�Q 1000-50-2-1 at Southold hearing, no opposition was offered (from contiguous or adjacent property owners or others in the community) regarding this request. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. The setbacks of the house are significantly nonconforming on all sides. No other step is available except to apply for area variance relief. 3. The requested area variance is not substantial based on the size of the shed and based on the limited building area and bluff-related restrictions of the lot. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The shed is landward of the house and Coastal Zone Management boundary. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member Orlando, and duly carried to: GRANT the variance for a shed as applied for and shown on the sketched copy of the Ehlers' survey, with notations by Mark Schwartz, Architect for the applicant. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Reiniger, located at 3500 Lighthouse Road in Southold as you have requested. The bluff face is very heavily vegetated overall. At the toe of the bluff there are many glacial erratics, especially towards the East Side of the lot. There are freshwater seeps in spots around the bluff, however the only one that appears to be causing an erosion problem is located next to the public stairwell off of the Subject Parcel to the west. The topography of the Bluff Face is not as it appears on the Property Survey. There is a channel leading up the bluff face about middle of the lot, which appears to reach one third to half way up the slope. This would appear to have been caused by one of the freshwater seeps. It is very heavily vegetated also at this time. It does not appear that high tide can reach the toe of the bluff. Storm tides may reach it and there is no toe stabilization present hear or to either side of the lot. At this time the Bluff appears to be in relatively stabile condition. The house has only one downspout that was observed. This one led back away from the bluff face and under the deck. The rest of the roof exits onto the ground surface. The lot appears to be sloping away from the bluff and is covered in dense vegetation. There is a retaining wall near the top of the slope that is in relatively good repair. From above the bluff face you can see a path or flat area running along the entire width of the lot. The owner tells me this is a deer path, which appears to be a reasonable explanation. The addition of house structure along the south side of the house will not add any surface water runoff to the site since it will be located beneath the existing overhang. ARCURI: No. THE CHAIRMAN: We are concerned with people backing out into the road. (Mr. Arcuri showed sketch indicating how he could park and drive out again) . THE CHAIRMAN: Can you back up on your own property? MR. ARCURI : Yes. THE CHAIRMAN: It would appear that you are locating the house as well as you can. You really can't put it back any more than 15 feet toward the bluff. MR. ARCURI: I would like to stay as far from the bluff as I possibly can. THE CHAIRMAN: This is a triangular shaped house to conform to the lot. You are only leaving 5 feet on the east. MR. ARCURI : Anderson's lot has 100 feet on Sound View Avenue, and they also have a depth of 200 feet. THE CHAIRMAN: I don't think the Board would attempt to change the way you have located the house. One of the purposes of the Board is to assist a person with topographic hardships. How far does this drop down? MR. ARCURI : The elevation is about 60 feet to the top of the bluff. You can't walk down it. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that applicant requests permission to construct dwelling with insufficient setback and rear yard on the south side of Lighthouse Road, Southold. The findings of the Board are that applicant has a hardship because of the topography of the land. The Board agrees with the reasoning of the applicant.
