No. 5189 -SHIRLY KRAM AND THE KRAM FAMILY TRUST STREET&LOCALITY: 100 West Lane, Southold DATE OF PUBLIC HEARING: October 17, 2002 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the west end of a private road which extends off of Little Peconic Bay Road near Angel Shores Development in Southold The property consists of approximately 15,783 sq. ft. of land area, having 100 ft. along Peconic Bay and lot depth of 161.75 feet. The property is improved with an one-story, single- family dwelling with deck, all as shown on the survey prepared by John C. Ehlers (last dated 12-12-01). BASIS OF APPLICATION: Building Department's May 6, 2002 Notice of Disapproval denying a permit to construct: (a) an addition to the existing dwelling, and (b) an accessory garage in a front yard area. The building permit application was disapproved for the reason that the new construction did not meet the setback or yard locations required under Section 100-244B, 35 feet each at the front and rear yards. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 17, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant AREA VARIANCE RELIEF REQUESTED: The applicant proposes (a) an addition to the existing dwelling with a setback of , and (b) an accessory garage in a front yard area. The building permit application was disapproved for the reason that the new construction will not meet the setback or yard locations required under Section 100-244B, with a minimum 35 feet each the front and rear yards. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection,the Board makes the following findings: =1ik✓-✓ • Page 2—October 29,2002 Appl No 5189—Shirley Kram,Kram Family Trust 1000-88-6-12 at Southold 1. Grant of the area variance will not produce an undesirable change in character of the neighborhood or a detriment to nearby properties. In the case of waterfront houses, accessory structures are encouraged landward of the house, which area is typically identified as a front yard 2 The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. Due to the location of the existing waterfront house and wetlands in the southerly yard, the suggested location of 8 feet off the northerly property line and 5 feet off the westerly (side yard) property line is more feasible than any other location on this lot for an accessory garage. 3. The requested area variance is substantial, since it is a reduction of more than 25% in the front yard setback 4. The difficulty was self-created when the applicant built the existing house close to the water edge. 5. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. This is typical for waterfront communities, with accessory structures in the front yard or landward side of the house. RESOLUTION/ACTION: On motion by Member Orlando, seconded by Member Tortora, it was RESOLVED, TO GRANT the application as applied for SUBJECT TO THE FOLLOWING CONDITIONS: 1. The setbacks of the proposed one-story garage shall not be less than 8 ft. from the northerly property line and not less than 5 ft from the westerly property line, at its closest points 2. A continuous row of shrubs shall be planted and maintained at approximately seven feet from the west side property line, along the west side of the garage, and maintained at all times The length distance for the shrubs shall be at least 20 feet. 3. The new addition(s) at the easterly portions of the dwelling shall be as shown on the plans dated 9-24-02 prepared by Mark K. Schwartz, A.I.A., and shown on the sketch diagram prepared by Proper-T Permit Services dated 6-19-02. The placement of the garage in the front yard of this waterfront location also is not unusual and is provided for in the zoning regulations. 2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue, other than an area variance BECAUSE: The location of the property on the shoreline brings into play certain regulatory limitations which would not apply in other cases and the desire of the owner to arrange structures on the site is the most logical and efficient way requires that the area variance be sought. 3. Location of Property: 100 West Lane,Southold; Parcel 88-6-12. JIM FITZGERALD: We need the garage. The alternative of course is not to put it in the front yard,but to put it in the rear yard. I think with regard to the garage,you ought to consider the fact that the right of way under the Angel Shores subdivision is a common area and there's no development. In addition the area surrounding where the garage is proposed is a conservation easement extending at least a 100'from the property line,any development,clearing what have you in that area. Any construction that would take place on the privately owned properties immediately adjacent to the Smith property would be more than 100'away, and it would be shielded from the garage by the existing trees in the right of way which can't be cleared. MEMBER TORTORA: Where is that conservation easement? MR.FITZGERALD: I have a copy of the portion of the subdivision map and a portion of the C&R's which shows the location of the easement and the common properties which are treated in the C&R's. The green represents the area in which development is not permitted,and the blue in the middle of all that is the Kram property. CHAIRMAN: This is the nature of a minor subdivision? MR.FITZGERALD: What? CHAIRMAN: This entire C&R issue regarding these 4 lots. MR.FITZGERALD: Those lots are part of Angel Shores. No. 5189; Shirley Kram and The Kram Family Trust Members of the Board: The findings of the Board in this matter refer specifically to a"proposed one-story garage" and the Building Department has stated that the plans which we have submitted do not meet this description. They say that the plan, a copy of which is attached, is for a two-story structure, basing that determination on the Code definition of"story". We ask that the Board revise Condition 1. of its resolution approving our application for the setback variance in such a way that the garage shown in the attached plan would be acceptable. During the public hearing when the Chairman asked me,"The garage will be how many stories?", I casually answered, "One", because the plans did not exist and the question had not come up in my conversations with my clients. That answer became the specification in Condition 1. Since the construction details of the garage were not part of the Building Department disapproval, nor were the construction details part of the application for a variance, I would hope that the change could be made by action of the Board without the need for re-opening the public hearing. Mr. Kram is anxious to begin construction of the garage at the earliest possible date so that it can be used to store household goods during the renovation and expansion of the house. According to the Code definition of"story, half', the space above the first-floor ceiling joists is at most a half-story, but the words used to describe the structure matter only in so far as they are necessary to convey the Board's desires to the Building Department. The garage we propose in the attached plans is acceptable as an accessory structure and it is much more attractive and esthetically pleasing to both the owners and to passers-by than other structures with modified, but still acceptable, roof plans would be. For instance, in the attached annotated sketch of a cross section of the proposed garage,two alternate roof plans are shown. Both alternates would satisfy the Building Department's in-house standard for a one-story structure: the roof rafters rest upon the top plate of the first floor wall. a subsidiary of THE PECONIC EASTERN CORPORATION Southold Town Board of Appeals -2- February 14, 2003 Plan B, in red, shows a roof with the same overall height as the proposed garage but without the knee walls. Plan C, in blue, shows a roof of the maximum height which does not exceed the limitations imposed on an accessory structure. There can be no doubt that the proposed roof plan is by far the most desirable from every standpoint. Interestingly, the definition of a half-story is such that in the garage as proposed, the space above the first floor ceiling joists is not even a half-story since the side walls are at 4'- 6"less than the "minimum clear height of five (5)feet" specified in the definition. And if that space is not a half- story, it is surely not a full story.
