CG: lk ZONING BOARD OF APPEALS
FORM ZB4
After investigation and personal inspection, the Board finds
and determines as follows:
By this appeal, appellant seeks permission to construct a new
dwelling at the southerly end of Ole Jule Lane, Mattituck, with a
rearyard setback of not less than 15 feet, established frontyard
setback of approximately 40 feet, and sideyard setback of approxi-
mately 50 feet. The premises in question contains an area of
16,120 square feet and has been in single and separate ownership
since 1964 according to information supplied from the Assessors
of the Town of Southold. The Board agrees with the reasoning of
appellant.
The Board finds that the relief requested is not substantial
in relation to the Code requirements; that the relief would not
change the character of the neighborhood; that no adverse effect
will be produced on available governmental facilities of any
increased population; that the practical difficulties are unique;
and that the interests of justice will be served by granting the
relief as requested.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was
RESOLVED, that Richard Posselt be granted a variance to the
zoning ordinance, Article III, Section 100-31 as applied for in
Appeal No. 2855, provided that the setback from the easterly
property line (currently abutting Battersby) be not less than
15 feet.
Location of Property: 3145 Ole Jule Lane, Mattituck, NY;
County Tax Map Parcel Item No. 1000-122-5-18.
Vote of the Board: Ayes: Messrs. Doyen, Douglass, Goehe'
ringer, Sawicki and Grigonis.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
Property was bought and paid for F~ee and clear with the
verbal understanding (from a local Rea~) 2hat the progerty
w~s read~.ly bui!d~b]e without the need of a variance.
The money invested re~:resents a substantial amount of
life savinq's.
2. The hardship created is UNIQUE and is not shared by ail properties alike in the immediate
vicinity of this property and in this use district because
~ shape of the property does not let it be defined as
a corner lot; therefore, I do not have the required minimum
re~.r yard.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
We co~zld reposition the dwelling ~nd it would conform
to the rest of the ~eighborhood.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would pr~uce procticaldifficultiesorunneces-
so~ HARDSHIP becau~
Property was'bou&ht and paid for ~ee and clear with the
verbal understanding (from a local Reat~'~-~) that~'-~'~ property
was readily but~.]able without the need of a variance.
The money invested represents a substantial amount of
life savings.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
The shape of the property does not let it be defined as
a corner lot! therefore, I do not have the required minimum
rear yard.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
We could reposltion the dwellir~ and it would conform
to the rest of the ~ighborhood.
