The hardship created is UNIQUE and is not shared by all properties alike in the immediate ~icinity of this property and in this use district because Appli,?ant only ,wants to square off the size of his house and add a 10 foot deck, leaving a rear yard Of appr°Xi~na~ely-29 feet. 3. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because Applicant would be unable to construct addition to dwelling. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because Applicant only wants to square % off the size of his house and add a 10 foot deck, leaving a rear yard of approximately 29 feet. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the majority of the properties in the immediate vicinity of this property are of non-conforming size.
