Tile SOUT~:CLD TOV/I.~ CLERK ) be denied and By this appeal~ applicants seek variances to the zoning ordinance: (1) for approval of insufficient area of two parcels to be re-separated~ approximately 25~000 square feet each, and insufficient width along Wavecrest Lane, approximately 100 feet each; and (2) for permission to construct new dwelling with an insufficient frontyard setback of 35 feet off Saltaire Way [Subdivision Lot 18 of Saltaire Estates]. Applicants propose a 5©~ frontyard setback off Wavecrest Lane. The parcel in question for the new dwelling is a corner lot as defined by Section 100-13 of the zoning code~ which lends itself to the practical difficulties produced, as well as the narrowness of ~he lot. When personally inspecting the area, the Board found most of the homes to be set back off Salta±re Way approximately 35 feet~ and the character of the neighborhood is lots of the same and similar size and shape as the parcels proposed by this variance° The Board does agree with the reasoning of applicants. In considering this appeal, the Board determines that the variance request is not substantial; that the circumstances here- in are unique; that by allowing the variance no substanial detri- ment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests~f justice will be served by allowing the variance. By denying the variance the property will be substantially larger than those generally in the neighborhood° On motion by Mr. Grigonis, seconded by Mr. Sawicki~ it was RESOLVED~ that William and Helen Robison be granted a variance to the zoning ordinance as applied for in Appeal No. 2918. The Planning Board has approved these premises being separated into two parcels as shown on the subdivision map of Saltaire Estate and as applied for in correspondence to this Board dated October 20, 1981. STRICT APPLICATION OF THE ORDINANCE would produce practical difflcuities or unneces- saw HARDSHIP because the property was acquired as two separate parcels in 1969 and separately mortgaged. Ail of the parcels in Saltaire Estates are approximate- ly t_he same size~ and these two parcels are slightly larger than the surrounding parcels. Applicant has a purchaser .for ~oth lots, but the sale ~,ill not go through if the lots cannot be divided. Lot ~18 on the filed map is'a corner lot with approximately 100 feet on Wavecrest Lane, ~nd 227 feet on Saltaire Way, with a 50 foot setback algng Saltaire Way. .Locating a reasonable sized house woutd be~ difficult. The house would face Wavecrest Lane with adequate set~ack making Saltaire Way the side yard. 2. The hardship created is UNIQUE and is not shared by ail properties alike in Che immedlate ~,icinity of this property and in this use district because these ~re two of the few remaining lots in Saltaire Estates which .are double lot~ due to merger. in ~ddi~io~,' because this is a corner lot with narrow width, it requires a full front yard setback along what would actually -be the side yard.- .- ..... - 3.
