ZONING BOARD OFAPPEALS
After investigation and personal inspection, the Board finds as
follows:
By this appeal, appellant seeks permission to construct an
addition~ approximately 20' by 20' at the southerly corner of the
existing i½-story frame dwelling with attached garage. The setback
requested off Beachwood~L~ne is 40' and the setback from the rear
property line approximately 30'. The project proposed is consistent
with the average setbacks mn the neighborhood.
After investiqatmon and personal inspection, the Board finds as
follows:
By this appeal~ appellants seek permission to construct a 20 by
12-foot deck to the backyard leaving a setback of approximately 21
feet from the rear property line. The property in question as
shown on plan revised 6/5/80 by Shepard B. Palmer, P.E. is 163
feet along Greenwood Road, and an average depth of 93 feet. The
premises is improved with a preexisting dwelling.
The Board finds that the relief requested is not substantial
in relation to the Code requirements; that the relief requested is
within the spirit of the zoning ordinance; that the variance if
granted will not change the character of the neighborhood; that
no adverse effect will be produced on available governmental facil-
ities of any increased population; that the hardship or practical
difficulty is unique~ and that the interests of justice will be
served by granting the requested relief.
On motion by Fir. Goehringer, seconded by Mr. Sawicki, it was
RESOLVED~ that Donald Scott be granted a variance to the
zoning ordinance, Art. III, Sec. 100-31 to construct addition
to dwellfng with insufficient front an~ rear yard setbacks as
applied for in Appeal No. 2819.

1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficu~Hesor unneces-
sary HARDSHIP because the Owner has an expanding family which requires
more living space. Expansion in the two front yards (corner lot)
is restricted by zoning setbacks while the side and rear yards are
occupied by an existing swimming pool and garage/driveway. The
Owner is requesting a reduction in one front ~ard (Beachwood Lane)
from 50' to 40' to allow for a proposed addition. This reduction
is consistent with existing setbacks in the surrounding neighbor-
hood.
2 The hardshipcreated is UNIQUE and isnotshared by all properties alike in the immediate
vicinity of this property and in this use district because the property being a corner
lot has two required front yards restricting expansion in those
directions, In the side and rear yards there is an existing
swimming pool and a driveway/garage respectfully. Re'cause of this
configuration of the site, house and accessory construction, a
variance is sought.

Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed herein is
hereby classified as a Type II Action not having a significant
adverse effect upon the environment for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as
planned.
The property in question appears to be located within 300

I STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the Owner has an expanding family which requires
more living space. Expansion in the two front yards (corner lot)
is restricted by zoning setbacks while the side and rear yards are
occupied by an existing swimming pool and garage/driveway. The
Owner is requesting a reduction in one front yard (Beachwood Lane)
from 50' to 40' to allow for a proposed addition. This reduction
is consistent with existing setbacks in the surrounding neighbor-
hood.
2 The ¼ardship created is UNIQUE and isnotshared by all properties alike in the immediate
vicinily of this property and in this use district because the property being a corner
lot has two required front yards restricting expansion in those
directions. In the side and rear yards there is an existing
swimming pool and a driveway/garage respectfully. Because of this
configuration of the site, house and accessory construction, a
variance is sought.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because existing setbacks in the neightborhood
are often less than the 40'-0" setback requested for the addition.
