By this application, applicant seeks permission to convert an
existing barn containing a preexisting one-family apartment into
two one-family apartments on the second floor. Also existing on
the premises are several accessory buildings. The entire premises
in question contains approximately 45.3 acres.
The Board finds that the use will not prevent the orderly and
reasonable use of adjacent properties or of properties in adjacent
use district~; that he use will not prevent the orderly and
reasonable use of permitted or legally established uses in the
district wherein the proposed use is to be located, or of permitted
or legally established uses in adjacent use districts; that the
safety, health, welfare, comfort, convenience and order of the town~-
will not be adversely affected by the proposed use and its location;
and that the use will be in harmony with and promote the genera~
purposes and intent of the zoning ordinance.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was
RESOLVED, that Peconic Corporation, by Abigail A. Wickham, Esq.
as attorney, be granted a Special Exception to the Zoning Ordinance,
Article III, Section 100-30 Permitting the conversion of existing
barn with preexisting one-family use to a two-family use, SUBJECT
TO THE FOLLOWING CONDITIONS:
(1) That a minimum of 80,000 square feet of land area be
applied to this building/use as shown on the plot plan submitted
to this Board June 10, 1981;
(2) That pursuant to Article III, Section 100-30B(1) of the
Southold Town Code, applicant must obtain Southold Town Planning
Board site plan approval;
(3) That pursuant to the rules and regulations of the Suffolk
County Charter, this matter be referred to the Suffolk County
Planning Commission.

Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed herein is
hereby classified as a Type II Action not having a significant
adverse effect upon the environment for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as
planned.
The project in question is not located within 300 feet
of tidal wetlands.
This declaration should not be considered a determination
made for any other department or agency which may also be involved,
nor for any other project not covered by the subject appeal appli-
cation.

As you are aware, Peconic Corporation is contemplating the conversion
of an existing barn with an existing one-family use to a two-family
dwelling use at premises located at the south side of New Suffolk
Avenue, Mattituck, and located in the A-Residential/Agricultural
District. Article III, Section 100-30B(1) of the Code permits the
conversion of existing buildings to two-family dwellings by Special
Exception and subject to Site Plan Approval of the Planning Board
in accordance with Article XIII, and Bulk Schedule.
It is our understanding that you have reviewed this matter and
we request that you provide us with your determination prior to
the date of public hearing, to wit, Thursday, June 11, 1981 in
order to expedite processing hereof.
