Trustees at the Special meeting on Thursday, September 26, 1991:
RESOLVED that the Southold Town Board of Trustees amend permit
number 3931 to allow clearing to take place ten feet (10') from
line of deck.

TERMS and CONDITIONS
The Permit~e Leonard Rosen
residing at 3145 Main Bavview Road. Southold N.Y., as
part of the consideration for the issuance of the permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees Town of Southold are released any and

all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this Perant, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Sou-thold
2. That this Permlr is valid for a period of 24 mos. which is coosidered to be the
estimated time required m complete the work involved, but should circumstances warrant, request
for an exmnsion may be made to the Board at a later date.
3. That this Pem~it should be retained indeflnltel¥, or as long as the said Permittee
to maintain the structure or proiect involved, to provide evidence to anyone concerned that anth-
otization was originally obtained.
4. That the work involved will be subject to the inspecrlon and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Pemfit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a re,dr of the work
herein authorized.
6. That there shall he no interference with the right of the public to pass and repa~ along
the beach between high and low water marks.
7. That if furore operations of the Town of Southold require the removal and/or alteration~
in the location of the wock herein attthor.~.ed, or if, in the opinlon of the Board of Tre,~% t.~
work shall cause unreasonable obstruct, on to free navigation, the said Permittea will be requl~ed~
upon due notice, to remove or alter this work or project herein stated without expenses to the Tom
of $outhold.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on July 11,1991 regarding the above matter:
WHEREAS, EN-CONSULTANTS IN BEHALF OF LEONARD ROSEN applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of $outhold, application dated April
26, 1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on July 11, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT EN-CONSULTANTS ON BEHALF OF LEONARD ROSE~ BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct a timber dock consisting of 4' X 24' fixed elevated (4'
above grade of marsh) walk (including inclined landward section); 4'
X 14' hinged ramp; 6' X 20' float secured by 2 pilings. Structure is
to be at least 5' from property line. Applicant is to have a 50'
buffer area. Located at 3145 Main Bayview Road, Southold.
This permit will expire two years from the date it is signed. Fees
must be pai~, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please 'return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:
Ramp 4' X 14' = 56 sq ft X 2 = 240.00
Float 6' X 20' = 120 sq ft X 2 = 112.00
Catwalk 5'X4" = 20 sq ft X 2 = 40.00

1. Is the applicant aware of the low life span of docks on
open bays.
2. Concern that proiect does not block public access of beach.
3. Is the area a tern ne~ting area?
The CAC cannot make-a recommendation of the application and suggests the
Trustees withhold approval until these concerns are addressed satisfactorily.

On a motion by Stephen Angell, seconded by Cynthia $turner, it was
R~E$OVLED 'to recommend to the Southold Town Trustees disapproval of
Wetland Application No.~04-7-7 of Paolo Lavagetto to construct a timber
cock consisting of a 4' x 130' fixed elevated (max, 3.5' above grade)
walk with ramped up landward end; 4' x 14' hinged ramp; two 6' x 20'
f~oats secured by three pilings. The CAC recommends disapproval
because the prolect is oversized for the location. The CAC suggests the
applicant g~t accurate soundings. The Council believes that the soundings
would show that if applicant moved the catwalk as far to. the west as
possible the applicant would reach a deeper area faster. The CAC
s~ggests l~he applicant shorten the catwalk so it does not extend
f~rt~er out than the neighboring docks. Also the walk should be
e!evated at least 4~ above grade.

RESOVLED to recommend to the Southold Town Trustees approval of
Wetland Application No. 78-2-12 of Leonard Rosen to construct a t!mber dock
consisting of a 4' x 24' fixed elevated (4' above grade} walk; 4' x 14' hinged
ramp; and 6' x 20'float secured by two pilings

On a motion by John Holzapfel, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 122-3~27 and 28 to combine two
pre-existin9, single and separate building plots in order to expand
existing dwellin9. Expansion to include 30' x 40' living area and 10' x
60' deck. A 110' timber retaining wall and 20' retaining wall to be back
filled with 500 c.y. clean materail to match existing grade at road and on
east property line. Deck/dwellin9 will be located 50' landward of TWL line.
Applicant also proposes to install a vegetative buffer of native upland
shrubs between the TWL line and timber retaining wall. Shrubs the
applicant proposes t~ plant on 6' centers include: Bayberry, Beach Plum
and Rugosa Rose. The CAC stipulates approval provided the applicant
move the cesspool away from the creek and not plant Rugosa Rose.
