Dear Mr. Rosenberg:
Prior to our last meeting held on January 5, 1976, your attorney,
.Mr. StanLey Corwin advised us that you had decided to withdraw
your amended application and stated that as-much as the matter
was not on,the agenda, he would not stay to attend the meeting.
Your matter was de£initely on the agenda. The agenda was published
in the December 31, 1975 edition o£ the Su££olk Times.
It was a disappointment to have this matter concluded in such a
marmer. Under the circumstances we must conclude that you are no
longer interested in our 150 £t. agreement and we will await
development of other information and proceedings.
Your attorney also advised us that a law suit might be plarmed.
Under the circumstances, we are tabling the matter matil we hear
from you.

Dear Sir:
The Board of Southold Town Trustees hereby objects to the issuance
of permit for A.B. Rosenberg, 250 Great Mill L~ae, Great Neck, N.Y.
10023 for dredging at Sterling Creek, Greenport, N.Y. in view of
the fact that it appears to be in violation of our Ordinanee.
Application was made to the Board of Southold Town Trustees on
J~y 17, 1975. There is a discrepancy in the number of yards
to be excavated in the application made to your agency and the
application made to our Board.
The Board of Southo!d Town Trustees hereby objects to the issuance
of this permit o~til such time as ~u exact determination can be
made in regard to the above.

We ~re returning, herewith, yoo~ application to the Board
of Southold Town Trustees for dredging at Stirl~ng Basin,
GreenpoD2, N.Y.
We suggest that you revise your application in conformity
with the statements made by your attorney, Stanley Co~ain,
at our meeting held on October 6, 1975. M~. Corwin stated
that there will be no enlargement of your private marina
and that this is maintenance dredging only for the boats
presem_tly moored there. Therefore, we feel that the amoo_nt
of dredging shotuld be reduced drastically.

Please be advised that the following resolution was passed
by the Board o£ Southo_d Tow~ ~r~stees at their reguZLar meeting
held on March 8, 1976:
"IT WAS RESOLVED that the Board of Southold ~ow< T~stees
no acvion on the application o£ A.B. Rosenberg'for proposed
maintenance dredging at Sterling Creek, Greenport Luatil such
time as the SouWnold Tow~ Bos_~d of Appeals determines exactly
what legal rights he has -o<der the operation o£ this non-
conforming marina.
We would strongly suggest that this matter be t~ke~ up with
the Board of A ppeats so that Mr. Rosenberg's legal rights
c~n be cleared.
