Herreros 3000 Delmar Drive Laurel, NY 11948 [Appellant(s)] At a Meeting of the Zoning Board of Appeals held on November 5, 1981, the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section IX] Request for Variance to the Zoning Ordinance Article III , Section 100-31 [ ] Request for 7:30 p.m. Application of Robert A. and Bettyann Herreros, 3000 Delmar Drive, Laurel, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct addition to dwelling with an insufficient frontyard setback. Location of Property: 3000 Delmar Drive, Laurel, NY; Laurel Country Estates Map No. 5486, Lot 37; County Tax Map Parcel Item No. 1000-125-4-13. By this appeal, applicants seek permission to construct a 10' by 27'3" addition at the northwest side of existing dwelling with a frontyard setback off Gina Street at its nearest point of approximately 30 feet. Gina Street is a dead-end street, and the dwelling is setback off Delmar Drive at its nearest point approximately 40 feet. The premises is a corner lot as defined by Section 100-13. The Board agrees that this location for the addition is the most practical, and the design of the dwelling lends itself to the practical difficulties in these circumstances. In considering this appeal, the board determines that the variance request is not substantial in relation to the code requirements; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appel- lants, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance. On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that the application of Robert A. and Bettyann Herreros, Appeal No. 2909, be GRANTED A~ APPLIED FOR. Location of Property: 3000 Parcel No. 1000-125-4-13. Vot_e~ of the Board: Ayes: ~ Delmar Drive, Laurel, NY; Cotmty Tax Map ssrs. ~n was Doyen, Douglass, Goehringer, Sawicki unanimously adopted.
