ZONING BOARD OF APPEALS
The Board made the following findings and determination:
Appellants by this appeal seek a variance to permit the
use of the subject premises for industrial purposes, to wit,
manufacturing of small mechanical parts principally in the
large concrete-block "showroom" building. Also existing on
the premises are a two-story frame building and steel storage
building. The premises in question contains an area of
approximately 3~,700 square feet and is a corner lot with
approximately 244.85 feet along County Road 48 and 132.93
feet along Railroad Avenue (Youngs Avenue). The premises
is in a B-1 General Business District.
In considering this appeal, the Board determines that
the variance if allowed will not produce adverse effects on
available governmental facilities of any increased population;
that the circumstances herein are unique and that an economic
hardship has been shown; that the variance request is not
substantial in relation to the code requirements for uses
within this business zone; that the relief requested will be
in harmony with and promote the general purposes ~nd intent
of the zoning code; that the use will not prevent the orderly
and reasonable use of adjacent properties or of properties in
adjacent use districts; that the use will not prevent the
orderly and reasonable use of permitted or legally established
uses in the district wherein the proposed use is to be located,
or of permitted or legally established uses in adjacent use
districts; that the safety, health, welfare, comfort, conven-
ience and order of the town will not be advsersely affected by
the proposed use and its location; and that the interests of
justice will be served by allowing the variance.
On motion by Mr. Douglass, seconded by Mr. Grigonis, it
was
RESOLVED, that a variance to the zoning ordinance as
applied for in Appeal No. 2890, application of WARREN E.
HUFE, JR. and ELLEN HUFE, be granted,. SUBJECT TO THE FOLLOW-
ING CONDITIONS:
(1) That no work be done or materials displayed or stored
outside of the building[s], and
(2) That this matter be referred to the Suffolk County
Planning Commission pursuant to Sections 1323, et seq. of the
Suffolk County Charter.

for'the Purpose of manufacturing surgical, computer and aircraft hard-
ware; and that the prope~ty'i~ question, operating under a General
Business Use, has not been able to realize a reasonable return.
2. The hardshipcreatedis UNIQUEandisnotshored by all prope~ies ~ike in the'immediate
vicini~ ofthispropedy and in ~is use district because the mgjor structure on the
premises is existing and is not suited for t~e operation of general
business activity. The building in question is~'sUitable for manu-
facturing purposes, ~s desired by applicant; and, because it is not
suited for general business use it will not yield an adequate return.
3. The Variance would obsewe the mirit of the O~inance and WOU~D NgT g~H~GE THE
CHARACTER OF THE DISTRICT becau~ the existing structures p~esgnt~y exist
and)the'~se' Contemplated is not obnoxious; and because applicant
already operates a manufacturing plant in the use district and, in
effect, will just be moving from one place in the district to another
and not adding any additional industrial use. Applicant's ownership

due to the substantial exterior and interior repairs applicant will be
making to the premises.

Dear Mr. Bruer:
You have asked my opinion about the desirability of the
operation of a repair shop at the northeast corner of Route
and Youngs Avenue in Southold.
As you may know, our Company operated from this location
from 1965 through 1978. In my opinion, based on present economic
conditions, this location would not be considered as a good place
to operate a repair shop. One of the more important reasons is
the rapid escalation of operating costs and the difficulty in
proper utilization of the available space. The number and location
of the access doors and the narrowness of the building makes it
difficult to properly utilize this space.

o£ Southold.

signed neighbors of the property under consider-
ation are aware of the requests and urge the board
to grant the changes applied for.
We are certain that there will be many improve-
ments made which will be beneficial to the neigh-

Dear Sirs:
On Thursday at the hearing on the above matter, the
proof to be offered for the hardship will be as follows:
The present owners, Cliff Tyler and Elizabeth G. Tyler,
were not able to make a go of the premises using the existing
buildings for a garage, repairs and retail sales, a per-
mitted business use. The proof to be submitted is the
fact that the premises are being foreclosed by the present
mortgagee and are not in use.
We will attempt to have something from TRYAC stating that
it was unprofitable to operate said premises as a general
business use.
The hardship of applicant will be that if he bought the
premises he could not use it for manufacturing purposes and
that his present quarters are too small and he needs addi-
tional room.
I am attempting to find out what Mr. Tyler paid for
the premises. Its present value if it can be used for
manufacturing purposes is $90,000, as per contract of sale.
Since Mr. Tyler has not been able to operate the premises
there are no current maintenance figures available. The
land tax will be supplied at the hearing. The current
mortgage is $56,000 +/-, which the mortgagee claims is in
default. Due to the failure of Mr. Tyler's business,
the premises, as far as I know, are not producing any income.

The change in use will not alter the essential character
of the locality in that the present structure will be used.
The applicant has in the past, and can be expected in the
future, to maintain his premises in a professional way. The
use of the premises for manufacturing surgical, computer and
aircraft hardware will not alter the neighborhood.
