By this appeal, appellant seeks a variance for approval of
access, New York Town Law, Section 280-A to premises located on
a private road at the East End of Fishers Island, New York.
The access road in question is approximately 40 feet wide. It
is the feeling of the Board that the road is adequate for egress
and ingress.
The Board finds that the relief requested is not substantial;
that the relief requested is within the spirit of the ordinance;
that the variance if granted will not change the character of the
neighborhood; that no adverse effects will be produced on avail-
able governmental facilities of any increased population; that
the hardship is unique; and that the interests of justice wil~
be served by granting the variance as requested with the following
below-specified condition.
On motion by Mr. Doyen, seconded by Mr. GrigoRis, it was
RESOLVED, that Karl E. Fransson, 11 Dodge Drive, West Hart-
ford, CT 06107 be granted a variance for approval of access,
SUBJECT TO THE FOLLOWING CONDITION:
That the access roads be maintained passable at all times
for emergency vehicles.

Vote of the Board: Ayes: Doyen, Sawicki and Grigonis.
Nayes: Messrs. Goehringer and Douglass. (Messrs. Goehringer
and Douglass felt that the access road should be improved to
a width of 15 feet and maintained improved to insure easy
accessibility and safety.)

Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed herein is
hereby classified as a Type II Action not having a significant
adverse effect upon the environment for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as
planned.
The property in question appears to be located within 300
feet of tidal wetlands but the wetland area is separated by a road
or similar type of barrier.
This declaration should not be considered a determination
made for any other department or agency which may also be involved,
nor for any other project not covered by the subject appeal appli-
cation.

by certified mail. (F.I.D.C.O. is not considered an adjoining
property owner~ to whom you have given notice. )
Attached herewith are copies of the current tax map showing
the names and addresses of the adjoining property owners on
January 1, 1981. It is suggested that you confirm these names and
addresses with the Assessors Office at (516) 765-193Z Also
enclosed is a photocopy of the Notice you filed with your application
for your reference.
If you can provide us' with the additional certified mail receipts
