A Variance to Section 280A Subsection 3
X) A Variance to the Zoning Ordinance is requested for reason that applicant wishes to
divide Lots 3 and 4 on Map of Pequash Acres, as shown on the filed Ma~,~Bc~py of
which is attached hereto, resulting in one lot with insufficient fro~age and width.

REASON FOR APPEAL Continu~
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the lot ±s long and n~row and although it eontains over
The property was subdivided in 1972 at a time when the frontage was sufficient.
However, when.thefrontage requirement was increased in 1973, thisfiled map was
not ~xcepted ~ in Sec. 100 - 12 of zoning ordinance. Additional frontage could
be obtained by annexing a piece of Lot No. 3 but this would unduly diminish the
size of Lot No. 3 and also require an additional variance and Planning Board Ap-
proval.
The lots in this subdivisio~ including the lots in question, are substan-
tially larger than the surrounding lots~many of which have only 100 feet frontage
and also have insufficient area. The lots immediately to the south contain only
75 feet frontage - others in the neighborhood are even narrower.
2. The hardship created is UNIQUE and is not shared by afl properties alike in the immediate
vicinity of this property and in this use district because the oonf±gurat±on of the lot is
long and narrow whereas the other lots in the subdivision are more evenly pro-
portioned.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the two lots will both contain more than
40,000 square feet and will still be considerably larger than most lots in the
neighborhood.
