The Board made the following findings and determination:
By this appeal, applicant seeks permission to construct a
30' by 29' addition to the existing one-story concrete-block
building with an insufficient setback from the westerly property
line of five feet. The property in question is zoned B-1 General
Business and is a corner lot as defined by Section 100-13 of the
zoning code. The parcel in question contains an area of approxi-
mately 17,649 square feet. After investigation the Board finds
that a parcel adjoining this lot on the west was granted a
variance to construct a business building with a setback from
the same side line approximately three feet. It is the feeling
of this board that the location proposed by applicant is the
most feasible especially due to the fact that the premises is
a corner lot and situated at a very busy intersection in the
village of Mattituck. The Board agrees with the reasoning of
applicant.
In considering this appeal, the Board determines that the
variance request is not substantial; that the circumstances here-
in are unique; that by allowing the variance no substanial detri-
ment to adjoining properties would be created; that the difficulty
cannot be obviated by a method, feasible to appellant, other than
a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general
purposes of zoning; and that the interests of justice will be
served by allowing the variance.
On motion by Mr. Grigonis, seconded by Mr. Sawicki, it was
RESOLVED, that the relief requested in Appeal No. 2906,
application of Allan C. Dickerson be granted, SUBJECT TO THE FOL-
LOWING CONDITIONS:
(1) County Planning referral pursuant to Sections 1323, et
seq. of the Suffolk County Charter;
(2) Planning Board approval.
Location of Property: Northwest Corner of Main Road and
Wickham Avenue, Mattituck, NY; County Tax Map Parcel 1000-140-3-34.
Vote of the Board: Ayes: Messrs. Doyen, Douglass, Sawicki
and Grigonis. Mr. Goehringer abstained.

Gentlemen:
Concerning the matter of Mr. Alan A. Cardinale for the Mattituck
Shopping Center, it is our understanding the their request for
a reduction in the parking is scheduled for your November 9, 1981
agenda. Please be advised that the Board of Appeals has
allowed a variance to construct a drive-in roof addition with
an insufficient frontyard setback as shown on the attached and
subject to your Board's approval.
Concerning th~°matter of Mr. Allan C. Dickerson, premises located
at the northwest corner of Wickham Avenue and Main Road, Matti-
tuck, the Board of Appeals recently granted a variance to the
zoning ordinance for the construction of an addition at the west
side of the subject building with a sideyard setback from the
westerly property line of not less than five feet, subject to
the approval of your Board inasmuch as this property is in a
B-1 Zone.

After investigation and inspection the Board finds that Mike
Winiarz, a/c Stanley Winiarz request permission to build a business
builOing on a lot where ther~ is an existing residence. After the
construction of the new business building, there will be insufficient
front yard for the residence. However, to move the existing residenc
would incur a great expense. The Board finds that the proposed bus-
iness building is to be 40~ x 40~. This is in a "B~ Business Distric
and will conform with the development of the area.
The Board finds that strict application of the Ordinance will
produce practical difficulties orunnecessaryhardshi~ the hardship
created is unique and wou~d no~ be shared by all properties alike
in the immediate vicinity of this property and in the same use
district~ and the variance does observe the spirit of the Ordinance
a~d will not change the character of the district.
Therefore, it was RESOLVED that Mike Winiarz, Mattituck, New
York, a/c Stanley Winiarz, Mattituck, New York,, be granted permission
to erect a business building on property.where there is an existing
residence, on property located north side Main ~oad, Mattituck, New
York, in accordance with the following suggestions of the Boards
1. The building shall be located 25 feet from the Main Road.
2. The building shall be erected parallel to the Main ~oad.
3. The building shall be erected 3 feet from the Eseo .property
on the east.
