TASKER, being duly sworn deposes and says that he resides at 202 Sixth Street, Greenport, New York. That your deponent is an attorney admitted to practice as such in the State of New York, and is the attorney for Orient Community Activities, Inc. and as such, is familiar with all matters concerning the affairs of the Orient Community Activities, Inc. as well as the real property owned by said corporation. That by deed dated January 2, 1929, and recorded in the Suffolk County Clerk's Office on January 7, 1929 in Liber 1403 at page 61, D. Milton Rackett and Maria W. Rackett, his wife, conveyed a parcel of land located on the west side of Village Lane at Orient, Town of Southold, Suffolk County, New York to Lucius H. Hallock and others, as directors of the Ruth E. King Memorial Association. That, thereafter, by a Certificate of Merger dated May 2, 1983, and filed in the Secretary of States Office on July 29, 1983, the Ruth E. King Memorial Association, Inc. was merged with the Orient Community Activities, Inc., and pursuant to law, the Orient Community Activities, Inc. is now the owner of the premises formally owned by the Ruth E. King Memorial Association, Inc. That the premises which is the subject of this affidavit is designated on the Suffolk County Tax Map as District 1000, Section 25, Block 1, Lot 25, and is more fully described in the aforementioned deed to the Ruth E. King Memorial Association, Inc. That said premises are located in the B-1 Business Zone pursuant to the provisions of the Southold Town Zoning Code and Zoning Map. That by reason of the foregoing, said premises, since January 2, 1929, have been held in single and separate ownership to the present date. That during all of said time, the owner of said premises was never the owner of any other land abutting said premises. That said premises have been in single and separate ownership prior to the enactment of the Southold Town Zoning Code in 1957, and the same constitutes a pre-existing, non-conforming premises. Accordingly, deponent respectfully requests that the Building Inspector issue a Certificate of Occupancy for said premises authorizing said premises for all uses permitted in the B-1 Business Zone under the Southold Town Zoning Code. That annexed hereto is a copy of the aforementioned deed dated January 2, 1929. That to the knowledge, information and belief of your deponent, a survey of said premises has never been made and deponent respectfully requests that since a survey is not required for a determination that said premises are a pre-existing, non-conforming premises, deponent respectfully requests that this requirement be waived. Said premises are under contract of sale to Robert John Black and Leslie E. Black and upon information and belief, a survey of said premises is being prepared for Mr. & Mrs. Black.
