TERMS and CONDITIONS The Permittee Kenneth Rock residing at lg00 Broadwaters . Cutcho~ue N.Y., as part of the consideration for the issuance of the Permit does understaml and proscribe to the fol- lowing: 1. The Southold Town Trustee Permit must be prominently displayed on prmises effected during period of work. 1. That the said Board of Trustees and the Town of Southold axe rdessed from any and all damages, or elalmg for damages, of suits arising directly or indirectly as a result of any ation performed pursuant to this l~mig and the said Permittee will, ~t his or her own expeme, defend any and ali such suits initiated by third parties, and the said Permittee ~nmes fell l;~hilit~ with respect thereto, m the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of 24 mo~ which is consldeted to be the estimated time reclaired to complete the work involved, but should citcnmsrances warrant, request for an extension may be made to the Board at a later date. 5. That this Permlr should be retained indefinitely, or as long as the said Permittee wisbe~ to maintain the structure or project involved, to provide evidence to anyone concerned that anth- orization was originally obtained. 4. That /he work involved will be subject ro the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, ma}, be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the fight of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the locatmn of the work bere~ authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstmcrton to free navigation, the said Petmlttee will be requltec~ upon due notice, ro remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee or the completion of the work auth- orb. ed. 9. Dear Mr. Haje: The folloWing action was taken by the Board of Town Trustees during their regular meeting held on June 22, 1989 regarding the above matter: WHEREAS, En Consultants on behalf of Kenneth Rock applied to the Southold Town Trustees for a permzt under the provisions of the Wetland Ordinance of the Town of Southold, application dated August 10, 1988 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on June 22, 1989 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that En Consultants ON BEHALF OF Kenneth Rock BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Replace 193 lin. ft. timber bulkhead within 18", replace 37 lin. ft. bulkhead landward of existing bulkhead, dredge 26' x 30' boat slip to 4' below MLW. All work to be done in accordance with the following conditions, and in accordance with NYSDEC approved plans: 37' foot section on west side to be replaced landward of existing bulkhead with no removal of existing bulkhead, backfill to be limited to area between west section and boat slip, 7' section on east side should not be replaced, 52' section replaced within 18" but no backfill can be used behind old bulkhead at deadmeno Remaining section to be replaced within 18". No machinery to operate on landward side due to the vegetation. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project° Permit will be issued upon palrment of the following fees for work to be done below Mean High Water Mark: $300.00 approx. 50 cu. yds. dredging/backfill Very truly yours, Frank A. Box 1179 TELEPHONE Southold, New York 11971 (516) 765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL September 26,: 1988 The following recommendations were made by the Southold Town Con- servation Advisory Council at its regular meeting on Tuesday, September 20, 1988. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No, 641 of Laughing Waters Property Owners Association to reconstruct in kind/in place approximately 227r of deteriorated timber bulkhead. An area 3' seaward of said structure shall be dredge to a depth of 3' at MLW. The resultant spoil, approximately 50 c.y. of sand shall be utilized as backfill for the new bulkhead. RESOLVED to recommend to the Southold Town Trustees approval with stipulation of Wetland Application No. 642 of Paul Ferdenzi to construct a walkway 20' x4~r hinged ramp 12' x 4' and folating dock 16' x 6'; install two 8" piles to secure floating dock. Approval is with the stipulation that ~t_he grass betweer! the.lawn and water be disturbed as little as possible. Tabled Wetland Application No. 643 of Nicholas Theoharides. The CAC wishes to await the answers to questions posed by the NYS Departmenl of State. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application bio. 644 of Thomas E. Boyle to repair existing concrete wall by reinforcing with rip-rap in fornt of and behind existing wall in an attempt to prevent collapse. Truck in fill from an upland source to place behind existing wall. Leeton Drive, Southold. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 645 of Thomas E. Boyle to construct a rock bulkhead, approximately 90'. Leeton Drive, Southold. RESOLVED to recommend to the $outhold Town Trustees approval with stioulation of Wetland Application No. 646 of Robert E. Mitchell to construct a walkway 72' x 4'; and floating dock 16' x 6~; install two 2-pile dolphins to secure floating dock. CAC approvals with the stipulation that the walkway be elevated 4' above grade of marsh. Oakwood Drive, Southold. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 648 of Harold Knight to constaruct a 16' angled bulkhead return on north side of porperty and backfill with 7_+ c.y. of clean loam to be trucked in from an upland source. Return is needed to prevent further Joss of backfill from existing damaged bulkhead. Calves Neck Road, Southold. RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 649 of Alfred Nadel to approve completed project. Construct 127_+ I.f. of timber bulkhead above mean high water to connect to existing adjacent bulkheads 11' from corner of westerly, 6~ from corner of easterly and backfill with 50 c.y. of clean upland fill. Construct timber pier, 4' x 18' catwalk, minimum of 3' above grade, 4' x 12' hinged ramp, 6' x 16' float anchored by two piles. Approval is with the stipulation that catwalk be elevated the standard 4' above grade of marsh and that runoff from roof and lawn be contained on property (suggest use of dry wells, etc.) Robinson Road, Southold. RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 658 of Port of Egypt Enterprises, Inc. to erect a 25,440 square foot boat storage I~uilding. The stipulations would be: 1. Use a pervious driveway surface. 2. Suitable dry wel system for roof runoff. 3. Add pumpout station. Route 25, Southold.
