CG :lk FORM ZB4 ZONING BOARD OF APPEALS After investigation and personal inspection, the Board finds and determines as follows: By this appeal, appellants seek permission to construct an 18' by 32' addition to existing dwelling with a minimum sideyard setback from the northerly property line of eight feet. Existing on the subject premises is a 1½-story frame house. The Board agrees with applicants' reasoning. The Board finds that the relief requested is not substantial in relation to the Code requirements; that the relief would not change the character of the neighborhood; that no adverse effect will be produced on available governmental facilities of any in- creased-population; the circumstances are unique; and that the interests of justice will be served by granting the relief as requested and restricted as below-noted. On motion by Mr. Goehringer, seconded by Mr. Douglass, it was RESOLVED, that the relief requested in Appeal No. 2841, by application of Mr. and Mrs. Thomas Crowley be granted, SUBJECT TO THE FOLLOWING CONDITIONS: 1. There shall be no living quarters in the garage addition; 2. The garage addition shall have a maintained frontYard set~- back as exists for the main dwelling. [The addition shall not protrude ahead of the front of the house.] Location of Property: 745 Cedar Drive, East Marion, NY; County Tax Map Parcel Item No. 1000-22-2-42. NEW YORK 11939- PHONE 477-2465 July 8, 1981 Southold Town Board of Appeals Southold Town Hall Main Road Southold ~ew York 11971 Dear Mro Chairman and Members of the Board: I am writing this letter in regard to the hearing on Thursday July 9, 1981 at 7:25 P.M., Mr. Thomas Crowley and wife. I live on Cedar Drive and would like to go on record as being against the issuance of this variance. I do not believe that not issuing this variance would create a hardship, as the applicant does not now use the proposed garage area for vehicle parking. The total yard area is minimal, and taking away yard for a garage is not keeping wit]~in the character of the neighborhood, as all of the other houses in the area have fairly large yards including garages. I realize that Mr. Crowley is adjoining and not included in the Aquaview Park development, however granting an easement of the minimum side yard requirement is not fair to me or my neighbors as all of the dwellings in the neighborhood that were built'at the same time or after Mr. Crowley's meet the zoning regulations. I trust that you will consider these factors in determining the issuance of this permit. I would prefer to speak in person on this matter~ but due to personal matters I am unable to attend this hearing. I hope you will consider this letter as you would my appearance. Thankyou.
