CG:lk FORM ZB4 ZONING BOARD OF APPEALS By this appeal, appellant seeks a variance for approval of access, New York Town Law, Section 280-A to premises located on a private road, "Clay Point Road," at Fishers Island, NY. The right-of-way in question is 40 feet wide. It is the feeling of the Board that the road is adequate for egress and ingress. The Board finds that the relief requested is not substantial; that the relief requested is within the spirit of the law; that the variance if granted will not change the character of the neighborhood; that no adverse effects will be produced on avail- able governmental facilities of any increased population; that the practical difficulties are unique; and that the interests of justice will be served by granting the variance as requested in Appeal No. 2881. On motion by Mr. Doyen, seconded by Mr. Grigonis, it was RESOLVED, that Jeremiah Bogert, by James V. Righter Architects, be granted a variance to New York Town Law, Section 280-A, for approval of access as applied for and SUBJECT TO THE FOLLOWING CONDITION: That the access road(s) be maintained passable at all times for emergency vehicles.
