In considering this application, the Board finds an determines: (a) the relief requested is not within the character of the immediate area and will be a substantial change, creating other precedents to follow; (b) the practical difficulties claimed are not sufficient to warrant the granting of the relief requested; (c) the circumstances of the property are not unique; (d) that in carefully considering the record and all the above factors, the interest of justice will be served by denying the relief granted, and granting alternative relief, as further noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to DENY the Variance with ALTERNATIVE RELIEF in the matter of the application of EVA HALL~under Appeal No. 3914, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the house not be any closer than ten feet from the southern property line (toward Glen Court). 2. That the house not be any closer than 65 ft. to the top of the bank. Variance to the Zoning Ordinance, Article: III-A, Section 100-30 A.2 to construct a retail/office complex. Proposed construction is not permitted in this R-40 Zone District. WHEREAS, public hearings were held in the'Matter of the AppliCation of NICHOLAS ALIANO under Appeal No. 3907; and WHEREAS, theBoard has carefully consideredall testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the sUrrounding areas.; and WHEREAS theBoard made the following findings of fact: is an appeal of the January 5, 1990 Notice of Disapproval inwhich an application dated January 4, 1990 was considered by the Building Inspector to construct a retail office complex and which was disapproved on the following grounds: -- ,..;Under Article III A (R-40 District), 100-30A.2, proposed construction is not a pezmitted use in this district. The premises in question consists of .860 acres, or 37,46~ sq. ft. in area with 200 ft. frontage along the west side of Pequash Avenue and 207.62 feet along the south side of State Route 25 (Main Road) in the Hamlet of Cutchogue, Town of Southold. The subject premises as of January 9, i989 has been situated in the R-40 Residential Zone District and is improved with an existing one-storyframe building having a total floor area, inclusive of attached garage, of 1408+- sq. ft. 4. By this application, the appellant requests a Variance for permission to construct new 1426 sq. ft. (One-story) masonry .~building to be occupied by retail stores and commercial office E-uses, uses which are not permitted in this R-40 Zone District. 5. Certificates of Occupancy have been furnished for the record indicating that on January 14, 1988 renovations were made to an existing real estate office in an existing building (C.O. ~Z~16582) and that on'August 2, 1973, Certificate of Occupancy No. Z5343 was issued for a business building with apartment- (public garage). 6. Although the present use of the site has been nonconforming in this R-40 Zone District since the January 9, 1989 Master Plan Zoning Revisions, the relief requested in this application is not under the nonconfoaming sections of the code and was applied for a variance under the "permitted use" section of this R-40 Zone District. 7. For the record, it is noted that expansions, enlargements, alterations or reconstruction of nonconforming buildings and/or nonconforming uses are not permitted without variances from the Board of Appeals (Section 100-243 of the Zoning Code). 8. It is~the position of the Board Members that the grant of the subject variance under the present terminology and definitions of the current zoning code is not appropriate. 9. In considering this application, the Boardalso finds and dete~ines: (a) sufficient proof has.not beendemonstrated as required by the statutes to show that: (1) the property cannot yield alreasonable return with underlying facts lie dollars and cents proof; (2) the burden of proof of unnecessaryhardship or that literal~application of the zoning ordinance would resultin unnecessary hardship has not been sufficiently met (Otto v. Accordingly, on motion by Mr. Dinizio, seconded by Mr.. Grigonis, it was RESOLVED, that the relief requested under Appl. No. 3907 in the Matter of NICHOLAS ALIANO be and hereby is DENIED for the reasons noted above. Vote of the BOard: Ayes: Doyen, Sawicki, and Dinizio. Accordingly, on motion by Mr. Goehringer, seconded by Mr.Dinizio, it was RESOLVED, to GRANT a Variance in the matter of the application of MATTHEW KAR as applied under Appeal No. 3946, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the 16' X 37' addition be located as indicated in on the survey submitted. 2. That the proposed addition not extend any closer than eleven (11+-) ft.. to the rear property line and fifteen (15+-) ft. to closest side yard on north side of property.
