ZONING BOARD OF APPEALS
~ After investigatio, n and persona.1 inspection, the Board finds
and determines as follows:
By this appeal, appellant seek approval of insufficient area
of Shorecrest Subdivision Lots No. 10, 11, 12, 13, and 14 and
insufficient road frontage of Subdivision Lots No. 13, 12, and 10.
Shorecrest Subdivision is not one of the "excepted subdivisions"
in Article I, Section 100-12 of the zoning code but has been an
approved and filed subdivision as of April 6, 1971 pursuant to
the records of the Southold Town Planning Board, Suffolk County
Clerk and information received from the Suffolk County Health
Department. Each of the lots proposed contain an area of approxi-
mately 30,000 square feet, which is similar to those within the
neighborhood as to size and 6haracter, The Board agrees with
applicant's reasoning.
The Board finds that the relief requested is not substantial
in relation to the Code requirements; that the relief would not
change the character of the neighborhood; that no adverse effect
will be produced on available governmental facilities of any in-
creased population; that the hardship or practical difficulty is
unique and not self-imposed; and that the interests of justice
will be served by granting the relief as ~equested.
On motion by Mr. Goehringer, seconded by Mr. Doyen, it was
RESOLVED, that the relief requested in the application of
Frank A. Battel in Appeal No. 2837 be granted as applied for and
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That this matter be referred to the Suffolk County Planning
Commission pursuant to the rules and regulations of the Suffolk
County Charter;
Board.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would ProdUce practical difficulties or unneces-
sary'HARDSHIP becaUse all other lots in this subdivision have now been
conveyed to other parties, All of these lots a=e of the same dimen-
sions as lots in this subject application and were h~retofore granted
similar variances under APPeal Nos. 2675 and 26~76. If the applicant
were required to merge any of these lots in Order to meet current
.artec.requirements., ~it Would result in unattractive lots with road
frontages in each instance in excess of 300 feet and, in addition,
would cause serious economic hardship and practical difficulties to
the apPlicant.~ ' This is a most attractive subdivision and for the
reasons~st~d wit.h!respect to Appeal Nos. 2675 ,and 2676, it~would
serve the interest of justice to grant a further variance as requested
wi~hrespect to these remaining lots.
2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate
vicinity of this property and in this use district because the conditions affecting the
filed 'sub~division lands are peculiar to it 'and do not have applica-
bility to other land 'in the vicinity.
3. The Variance would observe the,spirit of the Ordinance and W. OULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the area would remain strictly residen-
tial in use and contain land parcels substantially in accord with
those set forth on the filed subdivision map. That this sUbdivision
is in fact a valid subdivision to which the owner thereof made sub-
s tantia! improvements to meet those specifications of the Town of
Southold.

isrequested forthe reason thot the filed map of Shorecrest at Arshamomoque
is not an accepted map under the Zoning Ordinance of the Town of
Southold and, in the light thereof, the aforementioned lots do not
currently meet the area and width requirements imposed by said
Ordinance.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because all other lots in .this subdivision have now been
conveyed to other .partieS. All of these lots aye of the same dimen-
sions as lots in this subject application and were heretofore granted
similar variances under Appeal Nos.: 2675 and 2676. If the applicant
were required to merge any of these lots in order to meet current
ar.ea requirements., it would result in unattractive lots with road
frontages in each instance in exces~ of 300 feet and, in addition,
would cause serious economic hardship and practical difficulties to
the applicant; This is a most attractive subdivision and for the
reaSons~St~d with'respect to Appeal Nos. 2675 and 2676, it.would
serve the interest of justice to grant a further variance as requested
wi~hrespect to these remaining lots.
2. The.hardshipcreatedis UNIQUE and isnotshared by all properties alike in the immediate
vicinity ofthis property and in this use district because the conditions affecting the
filed subdivision lands are peculiar to it and do not have applica-
bility to other land in the vicinity.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the area would remain strictly residen-
tial in use and contain land parcels substantially in accord with
those set forth on the filed subdivision map. That this subdivision
is in fact a valid subdivision to which the owner thereof made sub-
s tantial improv_ements to meet those specifications of the Town of
Southold.
