Tl~e validity of this permit is or may be subiect to the approval of other governmental or municipa
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In th~
even [ that SUCh approval is necessary, the holder of this permit shall not commence operations here
uno ~r until such approval has been obtained in writing. The failure to obtain such other approval whet
reou~red shall subject this permit to immediate revocation by the Trustees upon receipt by th~
Trustees, of written notice from such other governmental or mumcipal autt~orities of its refusal o
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and sh all take all precautions for the prevention of injuries to persons
and properw resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harm] ess the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this per mit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premtses where such operations are being conducted to-
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit,
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town,

Dear Mr. Just:
The following action was taken by the. Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above matter.
WHEREAS, The Land' Use Company on behalf of Nunzio & Stephanie Reale applied
to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 12, 1986, and amended February 26, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was hsld by the Town Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the ~own,
NOW, THEREFORE, BE IT
RESOLVED that the LAND USE COMPANY ON BEHALF OF NUNZIO & STEPHANIE REALE BE AND
~ERE~Y IS GRANTED PERMISSION-UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: To construct a 4'
x 32'i fixed dock leading to a 3' x i0' ramp leading to a 6' x 20' float to be attached
to (21) 6' x 20' floats. Properny is located on Fleetwood Road, Cutchogue.
This permit is issued With the provision that most of the access is to be from the
R.O.W. so that the high marsh on the property can reestablish itself.

This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amoun~ as shall be fixed by the Trustees, which said policies shall
name the Towm as a name insured.~ Please take further notice that
this declaration should not be consiHered a determination made for
any o~her department or agency which may also have an application
pending for the same or similar project.
THE FOLLOWING FEES ARE NOW DUE AND PAYABLE. UPON REFfiTTANCE YOUR

Records of this Department indicate that you are in violation of the Environmental
Conservation Law (ECL):
Article 15, Protection of Waters, Section 15-0501.1,
Article 25, Tidal Wetlands, Section 25-0401.1
in that you caused, or per~itted to be ca.used: Clearing, grading and dumping
of debris in a~dadjacent to a regulated .tidal .wetla. nd without permit to
do so.
A violation of this/these Articles of the ECL is a misdemeanor and is punishable
by a fine of not more than $3,000 and/or $8,000.
-Yo~ are hereby advised to cease your operation at the referenced location immediately.
Please contact this office at once so that we may attempt to resolve this matter.
A failure to contact'this office within 30 days will result in this matter being
