Please be advised that you are in violation of your Wetland Permit No. 385
which states "A foot path is to be used and most of the access is to be from the
right of way so that the high marsh on the property can reestablish itself."
You are to discontinue any further mowing of the vegetation on the property.
If you do not adhere to the provisions of your permit, it will be revoked, and
your structure will have to be removed.
Should you have any questions, regarding this matter, please do not

The applicant does by the acceotance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and properW resulting from such ooerations. By such acceotance, the applicant also agrees to indemni-
fi/ and save harmless the Town, and its officers, agents and employees from an',, and ali claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occu pants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town. and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con°
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of an,/channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr. Just:
The following action was taken by the Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above matter.
WHEREAS, The Land' Use Company on behalf of Nunzio & Stephanie Reale applied
to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 12, 1986, and amended February 26, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that the LAND USE COMPANY ON BEHALF OF NUNZIO & STEPHANIE REALE BE AND
HEREBY IS GRANTED PERMISSION UNDER THE

x 32' fixed dock leadin8 to ~ 3' x 10' ramp leading to a 6' x 20' float to be attached

This permit is issued with the provision that most of the access is to be from the
R.O.W. so that the high marsh on the property can reestablish itself.

This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustess, which said policies shall
name Ithe To,mi as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any o!ther department or agency which may also have an application
pending for ~he same or similar proj.ect.
THE FOLLOWING FEES ARE NOW DUE AND PAYABLE. UPON REMITTANCE YOUR

Attachment: Section of Zoning Code regarding boats
No. 476 - Paul Ferdenzi - Recommend disapproval. Dredging
wilt destroy the shellfish producing bed and do irreversible
damage to the bottom. As an alternative measure
the CAC suggests applicant either apply for a mooring
elsewhere in the creek or seek docking at Boatman's
Harbor.

Use haybales to avoid runoff; put in more plantings
