The Board of Trustees is of the opinion that you will obtain all required consents from the property owners to eliminate the right of way in exchange of a quit claim of all or a portion of the bed of Gull Pond Inlet. In view of the foregoing, the Trustees are agreeable to eliminate the right of -way across the Town Beach in exchange for quitclaiming the bed or a portion of the bed at Gull Pond Inlet, as per advise of Town Attorney Robert W. The land_ is_=on_the-_=e_astern_border of my propert_y_ facing_ the_ be_ach._.- Between the beach and--my-property there is in sequence a dune, then a creek and wetlands, then my propertlr. The ex- tent of the creek and wetlands is about 30 yeards. This creeld is fed from Gull Pond through a pipe extending under Manhanset Avenue. ftter and debris floods through the pipe at high tide and the water recedes at low tide leaving the debris at the edges of the wetlands. Over time, this becomes quite a mess. . However this garbage heap (bottles, cans, plastic etc. ) only partially detracts from the general beauty of the wetlands, which is a haven for flora and fauna. I would be very proud to own, such a natural creek and marshland, and would spend considerable time and money to clean it up. I was told that there is a possibility of a "right of way" existing. However, if that is so, it is purely theoretical for the following reasons: 1. There is no access to the creek from the road, except across private property. 2. Some of the property owners already own the land from Inlet Lane across the creek to the beach. 3. Noone can use the creek for walking, because he would sink into the ,mud. In fact, noone uses the creek to walk in or over. The ad_vantage_tome of_this proposed_purchasewould be the opportunity to clean up and beautify the areas, pride of ownership and possible increase in value of my property. The advantage-to_=the_town_ would bethe__cleanup_ of whatis__ now becoming_a__garbage_dump,_an =-in dcreased-taxes_., In summary, I wish to purchase from the town, the wetlands on the eastern edge of my property, which is approximately 30i6actyards deep and 250 feet long. 2. GREENPORT, L.I., NEW YORK 11944 September 15, 1983 To: Southold Town Board of Trustees Re: Property at Gull Pond Inlet Dear Sirs: You will recall that onone or two occasions in the past, Marvin and Sarah Rauch, who own property at Manhasset Avenue which abuts Gull Pond Inlet, have asked the Town Trustees to quitclaim to them the bed of Gull Pond Inlet abutting their property. By letter of September 7, . 1983, William H. Price, attorney for Mr. and Mrs. Rauch, has again made such request. A copy of Mr. Price's letter is enclosed herewith for your information. I believe that I had discussed this matter with Mr. Stoutenburg some time ago. By way of background, the Town acquired a portion of the beach front lying between Gull Pond Inlet and Gardiner's Bay in 1967 from Clinton A. Hommel, et al. A copy of such deed is enclosed herewith for your information. You will note, in the next to the last paragraph on page 1 of the deed, that the conveyance was made subject to three recorded right of ways over the property. At the time that the Town acquired this property, an attempt was made to extinguish the right of ways across the property in exchange for the bed of Gull Pond Inlet to the abutting owners. However, this attempt was not successful for the reason that one of the property owners refused to sign a quitclaim for his interest in said right of way. You will also note, in the last paragraph of the first page of the deed, that if such right of ways were terminated, the Town would agree to construct a fence along the south boundary of its property. You will also note in Mr. Price's letter that Dr. Rauch has volunteered to obtain all required consents from the property owners to eliminate the right of way in exchange of a quitclaim of all or a portion of the bed of Gull Pond Inlet. In view of the foregoing, I would suggest that the Trustees again look into this matter to decide whether or not they wish to Southold Town Board of Trustees -2- September 15, 1983 eliminate the right of way across the Town beach in exchange for quitclaiming the bed or a portion of the bed at Gull Pond Inlet. If the Trustees wish me to meet with them, I will be happy to do so. I am also enclosing herewith a 1961 Van Tuyl Map which shows the area in question.
