The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibilit~ in applying for or obtaining such approval In the ' event that such approval is necessary, the holder of this ~ermit shal not commence operations here; under until such approval has been obtained in writing. The failure to obtain such other approval when' required shall suoject this permit to immediate revocation by the Trustees upon receipt by the Trustees- of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all resoonsibility for operations under- taken pursuant to this permit, and shall take all precautions for the orevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmtess the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by ~is permit are being conducted, do, by the acceptance of this permit, give consent t.o the T~wn, a?d its officers anci employees to enter upon the premTses where such operations are uemg con~uc~ea to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. Thi~operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidit¢ or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife ano vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal wa~ers of the town. G. Change the course of any channel or the natural movement or tic,vol any waters. H. Weaken or undermine the laterat support of other lands in the vicinity. Otherwise adversely affect the health, safety an, d general welfare of the people of the town. Dear Mr. and Mrs. Rathgeber: The following action was taken by the Board of Town Trustees during their regular meeting held on February 28, 1989 regarding the above matter: WHEREAS, Eh-Consultants on behalf of Kenneth and Christine Rathgeber applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 8, 1988, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and reco~anendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 28, 1989 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that Eh-Consultants ON BEHALF Kenneth and Christine Rathgeber BE AND HEREBY IS GRANTED PERMISSION UNDER THE W£TLAB-D ORDINANCE TO: Remove and replace 211' retaining wall, backfill with 1500 cubic yards of clean fill to be trucked in from an upland source, plant indigenous species of vegetation along bulkhead to retain runoff inst~l ~r~ contain roof runoff. / This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said pro3ect. Please take notice that this declaration should not be considered a~ determination made for any other department or agency which may also have an application pending for the sa/ne or similar project. Box 1179 Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL V~-To: Southold Town Trustees From: Southold Town Conservation Advisory Council Dated: January 24, 1989 Re: Wetland Application Recommendations The following recommendations were made by the Southold Town Conservation Advisory Council at a meeting of the Council held Tuesday, January 24, 1989: RESOLVED to recommend to the Southold Town Trustee approval with stipulations Wetland Application No. 11-88-104-13-5 of En-Consultants, Inc. for Kenneth and Christine Rathgeber to remove and replace (in same locations and configuration) 211± 1.f. of retainin§ wall which is to connect to existing walls to north and south. The figure includes sections around existing concrete block "bath house" which is being undermined. Approximately 1,490 c.y. of clean sand and loam to be trucked in from an upland source to be used for backfill and rehabilitation of existing eroded slope. Following grading, slop~ to be planted with such species as Rosa rugosa, bayberry, beachgrass, etc. to stabilize. The Council approves with the stipulation that applicant put in retaining wall in line with neighbors' install drywells to contain roof runoff, and suggest, if necessary, terrace the sloping ground. RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 11-88-104-8-1.1 of Connie Cross for Environmentals Nursery to install two 10'x 30' bermed areas, with natural rock outcroppings and appropriate plantings au entrance to Nassau Point. The Council approves with the stipulation that applicant limit the height of the berm to no higher than 2'. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 11-88-136-1-41/42 of James E. Fitzgerald, for Ira Wechterman to construct a wood deck attached to house, extending To line of retaining wall; construct walkway 34' x 3', and floatinq dock 12' x 4'; and install two piles to secure floating dock.
