The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval, In the event that such approval is necessary, the holder of this permit shall not commence operations here: under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees. of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume ali responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to pe~ons and property resulting from such operations. By such acceptance, the applicant also agrees to indemn:,- fy and save harmless the Town, and its officers, agents and employees from eny and all cIaims arising from operations under this permit and any and ali ac~ or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by ~is permit are being conducted, do, by the acceptance of this permit, give consent to the Town, ant: its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being eo~- ducted in conformity with this permit, : This operation will not substantially: A, Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation, C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and ye§e- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Mr. John Racanelli 2052 Fifth Avenue Ronkonkoma, New York 11779 Re: Wetland Application No.391 Dear Mr. Racanelli: The following action was taken by the Board of Trustees during their regular meeting held on June 26, 1986 regarding the above captioned matter. Moved by Trustee Krupski seconded by Trustee Goubeaud WHEREAS, Nov-Rac Corporation on behalf of John Racanelli applied to t~ Southold Town Trustees for a permit under the provisions of the Wetland OrdinAnce of the Town of Southold application dated March 31, 1986 , and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and it is noted for the record that they recommended approval theveof, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on~Jnne 26, 1986 at which time ali interested persons were given an opportunity to be heard, and it is noted for the record that there was no public opposition, and ~ WHEREAS, the Board members have p~rsonally viewed and are familiar with the premises in question and the surrounding area; and WHEREAS, the Board considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED, that Nov-Rac Corporation on behalf of John Racanelli BE AND HEREBY ARE GRANTED PEP. MISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD, NEW YORK TO construct a footbridge over the creek on appellants property located on Inlet Lane and Bay Road, Greenport, New York. This permit will expire on JUNE 26, 1987 if work has not commenced by said date. There are two inspections required. The Trustees are to be notified upon the completion of the work. Please note that there is a $5.00 Wetland Inspection fee now due and payable upon remittance your permit will be forwarded by mail. Page 2 No. No. No. 385 - George D. F. The CAC strongly recommends the applicant follow the planting scheme used by the neighbor to the north. Advise a 20' of natural vegetation between the yard and marsh. No. Want a detailed site plan as to buffer marsh. A proposed landscape scheme. Plans must be made to protect marsh from runoff. 389 - Edward Sayegh - Recommend APPROVAL. 390 - Nancy-Jo Cantrell - Recommend ~PPROVAL with the provisions that applicant does planting along shoreline to prevent further erosion (hardy ground hugging shrubs). Recommend DISAPPROVAL . until application is with clarification. , Frank Licari - Recommend ~PPR©VAL. ~ - Ethel and Arthur Toan - Recommend DISAPPROYAL. No -- erosion problem, therefore no need shown. There is no bulkheading in the immediate area adjacent to property. Do not want to set a precedent. NO. 37.7 - Albert Roke - Recommend APPROVAL. No. 378 - Louise~oyle - Recommend DISAPPROVAL. No reason for new bulkheading. Damage to marshland would occur if placed where proposed. 379 - Helmut Spi~zenberger - No recommendation for approval or disapproval° Approval would be moot, project is completed. Recommend FINS IMPOSED' OR MO~' BULKHEAD BACK. The CAC 'f~els punitive action must t~ke place. This action sets a precedent for "fast land". No. 380 - Joseph Duggan - Recommend APPROVAL.
