SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. Before
we get to the regular business of the agenda, Councilwoman Doherty has some special
presentations to make.
Councilwoman Doherty
COUNCILWOMAN DOHERTY: I'll have Dave Cichanowicz come up, he is the chairman of
the Tree Committee. And as you can see from all the posters around the room, we had a lot of
participants in our poster contest and there's a lot of talent out there, so it was very hard to pick
the winner and honorable mentions. This is the winning poster and we have the honorable
mentions next to it. So we have a gift for each person and I will hand that over to Dave.

DAVE CICHANOWICZ: Chairman, Southold Town Tree Committee. Alright, just a brief
discussion on the Tree Committee. Started many years ago to watch out and protect the trees
along the streets and highways of Southold Town. So our Committee constantly is reviewing the
trees throughout, seeing where we need new trees, where the trees are damaged or diseased, to
manage them and try to maintain the integrity of Southold Town trees as it always has been.

Now with that, we always try to teach our young that this is the way going forward, you know,
pay attention to the growth and the greenery in the town, and it's a great thing to be involved
with. I am grateful to many of our members who are sitting here in our front row and a few that
didn't make it today but we all work hard to keep our town green. Along with that, the yearly
poster contest that we have gets the kids involved and as you can see throughout the whole room
which I have to give extra kudos to the staff from the Supervisor's office that helped put all these
posters up on display and they did a great job. So with that being said, our first or our grand
prize winner from all of Southold Town which does include Fishers Island and this is the first
year since I have been chairman that we had a Fishers Island winner, it is for Ellie Bloethe. And
this is the poster that won overall and she will also get this certificate of congratulations from the
town as well as a $100 gift card. That she can have fun with and Louisa Evans will be taking it
back with her.
JUSTICE EVANS: She was thrilled, she found out the news a couple of weeks ago.
MR. CICHANOWICZ: And Peter Burr, I have been in contact with, we are going to arrange,
there is also a tree that is going to be planted at the school in her behalf.
JUSTICE EVANS: That's wonderful.
MR. CICHANOWICZ: And that's courtesy of the Tree Committee. And secondly, honorable
mention from Cutchogue East Elementary is Rihanna Lutz. Is Rhianna Lutz here?
Congratulations, great job. We have this certificate for you and most important, $50 gift card.
The next one in is Jocelin Campos from Southold Elementary. Congratulations. Number four is
Nate Stevenson from Oysterponds, here you go. Congratulations. And last but not least is Anna
Cooper from New Suffolk School. I don't see Anna, so we will make sure she gets her prize.
Thanks very much, all you guys. You did a great job. Lots of effort.

RESOLVED that there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 14th day of March, 2018, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280-13 Accessory Apartments in Accessory
Structures" and be it further
RESOLVED that the Town Board of the Town of Southold held a public hearing on the
aforesaid Local Law at which time all interested persons will be given an opportunity to be
heard, now therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 280-13 Accessory
Apartments in Accessory Structures" reads as follows:

A Local Law entitled, "A Local Law in relation to Amendments tot Chapter 280-13
Accessory Apartments in Accessory Structures"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose. To provide more Affordable Housing opportunities within the Town of
Southold.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
§ 280-13 Use regulations.
[Amended 3-14-1989 by L.L. No. 3-1989]
In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and no
building or part of a building shall be erected or altered which is arranged, intended or designed
to be used, in whole or in part, for any uses except the following:
B. Uses permitted by special exception by the Board of Appeals. The following uses are
permitted as special exception by the Board of Appeals, as hereinafter provided, and, except
for the uses set forth in Subsections B(1), (13) and (14) hereof, are subject to site plan
approval by the Planning Board: [Amended 3-14-1989 by L.L. No. 3-1989; 5-20-1993 by
L.L. No. 6-1993; 12-21-1993 by L.L. No. 3-1989; 11-29-1994 by L.L. No. 26-1994; 12-

(13)One accessory apartment in a lawfully existing detached accessory garage, barn or
storage building, subject to the following requirements:
(a) The accessory apartment shall contain no less than 450 square feet and
shall not exceed 750 square feet of livable floor area and shall have no
more than one bathroom.
(b) A minimum of three off-street parking spaces shall be provided on
premises.
(c) Not more than one accessory apartment shall be permitted on a lot.
(d) The accessory apartment shall meet the requirements of an apartment as
defined in § 280-4 hereof.
(e) The entirety of the living floor area of the accessory apartment must be on
one floor of the accessory structure.

(f) The existing accessory structure shall comply with all other requirements
of this chapter.
(g) Approval of the Suffolk County Department of Health Services of the
water supply and sewage disposal systems shall be required.
(h) No bed-and-breakfast facilities, as authorized by § 280-13B(14) hereof
shall be permitted in or on premises for which an accessory apartment is
authorized or exists.
(i) Occupancy of resident structures on the premises shall be subject to the
issuance of an annual rental permit in accordance with § 280-13D and the
following requirements:
[1] The owner of the premises shall occupy either the existing
single-family dwelling unit or the accessory apartment in the
detached accessory structure as the owner's principal residence.
The other dwelling unit shall be leased for year-round occupancy
evidenced by a written lease for a term of one or more years to:
[a] A family member; or
[b] To a resident who is currently on the Southold Town
Affordable Housing Registry and eligible for placement.
[2] Rents charged to a resident on the Affordable Housing Registry
shall not exceed the rent established by the Town Board annually
pursuant to § 280-30(F) of this Code.
[3] No accessory apartment shall be occupied by more than the
number of persons permitted to occupy the dwelling unit under
Section 404 of the Property Maintenance Code of the New York
State Uniform Fire Prevention and Building Code.
[4] An accessory apartment shall only be occupied or otherwise
utilized in accordance with the certificate of occupancy issued for

the dwelling unit.
(j) The Chief Building Inspector, Zoning Inspector, and Town personnel who
are engaged in the enforcement of the provisions of this chapter are
authorized to make or cause to be made inspections to determine
compliance with this chapter and are authorized to enter upon any
property for the purpose of said inspections.
W No special Exception shall be granted unless the Zoning Board of
Appeals, in addition to the considerations, determinations and findings
required in 280-142 and 280-143, specifically finds and determines the
following:
(1] That therantin the he Special Exception will not adversely impact
the privacy and use and enjoyment of any adjoining parcel.
[2] That the granting of the Special Exception will not adversely
impact the character of the neighborhood in which it is located.
F31 That the cumulative effect of approving_the present application
along with previously approved applications will not have a
cumulative adverse impact on the surrounding neighborhood.
j4] That the cumulative effect of approving the present application
along with previously approved applications will not have a
cumulative adverse impact on the school district in which the
property is located.
f 51 That sufficient off-street parking exists on the subject property to
accommodate the proposed accessory apartment.
[6] Whether adequate buffer yards and screening can and will be
provided to protect adjacent properties possible detrimental
impacts of the proposed use.
§ 280-15 Accessory buildings and structures.

In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and
R-400 Districts, accessory buildings and structures or other accessory uses shall be located in the
required rear yard, subject to the following requirements:
A. Buildings with a flat or mansard roof shall not exceed 16 feet in height and shall be set
back at the minimum required for a sloping roof.
B. Buildings with a sloping roof shall be subject to the following height and setback
limitations:

C. Such buildings shall not exceed 660 1,000 square feet on lots containing up to 20,000
square feet and shall not exceed 7-50 1,200 square feet on lots 20,000 square feet to
60,000 square feet. On lots over 60,000 square feet, no accessory building shall exceed
3% of the total size of the parcel.
D. Dormers are permitted on accessory buildings up to 40 80% of the roof width. This
restriction shall not apply to buildings receiving a certificate of appropriateness from
the Town of Southold Historic Preservation Commission pursuant to Chapter 170 of
the Town Code.
E. Any accessory structure that is not a building shall not exceed 18 feet in height and
shall be set back at the minimum required in Subsection B above.
F. In the case of a waterfront parcel, accessory buildings and structures may be located in
the front yard,provided that such buildings and structures meet the front-yard
principal setback requirements as set forth by this Code, and the side yard setback
requirements for accessory buildings in Subsection B above.
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the partso decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of the New
York Codes, Rules and Regulations which requires all elected and appointed officials whose terms start

SUPERVISOR RUSSELL: That completes the agenda. Would anybody like to address the
Town Board on any issue?
Robert Dunn
ROBERT DUNN: Robert Dunn, Peconic. We had an incident at the beach this weekend. There
were some children playing and they chose to march through some freshly planted grass areas.
Whereupon I said something to their parent and she replied to me that there ought to be a sign
up, I showed her all five of them that were within 200 feet of her that she wasn't paying any
attention. This was the same sign that's been used at both Kenneys and McCabes, it was just
revised of course (inaudible). At that time, she assigned me a new name, Grandpa Ahole, and
ranted on me, I shouldn't do this, I shouldn't talk to her. Lady, your kids are beating up the
beach. She, I am going to call the cops, me, be my guest. The cop comes and he talked to her,
he talked to me and he did what he was supposed to do, he mediated. And he did a very good
job, and he went off but what I am getting around to is we ,need to establish some kind of
behavior that is acceptable in the public areas in the town and unacceptable. What is acceptable
and what is not acceptable. To give you a little background, you all know I have been doing
stuff for the beach but this year, I started in December and I planted 5,000, this is all by myself,
5,000 grass plugs. I started in December and the last time you saw me at the Post Office was the
day I finished. The first bout, that night I slept in the intensive care ward at St. Francis hospital
and had heart surgery the next morning.
JUSTICE EVANS: It's good to see you here.
COUNCILMAN DINIZIO: I'm glad you got them transplanted, Bob.
MR. DUNN: I waited about a month and went back at it, so I kind of put my heart in it and it's
really hard to see people destroying things unnecessarily. I know you got an email yesterday
with a picture. I come home from work and there's four guys, they could have been anywhere
from 16 to 20, actually damming up the channel at the beach. They brought shovels and pails
with them, so this was organized. The police didn't have to be called, I asked them what they

were doing, I said you can't do that. a reporter from Patch happened to be there taking pictures,
and I told them no, you can't do that and said as a matter of fact, you ought to dig it back out.
And they did and they left.
COUNCILMAN GHOSIO: Was there any reason that they gave for even doing it to begin with?
MR. DUNN: No. People do this all the time, Bob.
COUNCILMAN GHOSIO: They try to dam up the opening.
MR. DUNN: They try to dam up and this year it's going to be worse than ever because with the
storms we had, there's all kinds of debris on the beach. now I have been doing it for years, there
used to be, prior to the last few dredging things, there was debris from some houses that were
there, a lot of bricks and stuff and kids would build dams, mostly little kids. Little kids you can
understand, they are little kids but their parents are responsible. And you know, if you can't
control your kid put a leash on them. I don't know what to say, I don't want to see any kids with
leashes on them but I don't want to see our thing destroyed. I lived through the 70's in New
York City, I'd see what happens when society lets loose, I have seen the outcome of that and the
decay that slowly slips in and kind of wrecks things for everybody. And then you have got to
pull back real hard and you have got to get a guy like Giuliani, just throw everybody in jail.
That's, it works but it shouldn't never gotten there and it shouldn't get here, here. On the other
beaches where you have attendants you don't have a problem but there's a lot of places, not just
Goldsmiths but there's a lot of places in this town that are unattended and people need to know
there is a consequence for bad behavior and just because it's public property doesn't mean you
can just go do whatever you want to do.
COUNCILWOMAN DOHERTY: Yes, it's getting to the point where we have people that come
out here for the summer, they see open space, they think there's no boundaries. And like you
say, they just do what they want to do and they don't understand the significance of our wetlands
and what it takes to protect it.
MR. DUNN: I heard you guys discussing for 20 minutes this morning of how to solve the
problem of people driving the wrong way down a one way street. I mean, these are just
unacceptable behaviors. You shouldn't have to figure out a way to get around them, I mean if it
was me, impound the car, take away the license and that's it. Give them a $600 fine and you'd
only have to do that twice, it would stop. I bet if you do a survey, you would find out that out of
every 10 people that drive the wrong way down a one way street that three of them do it
regularly. Because it's a convenient way for them to get home, get to the bar, get to the railway
station or do whatever they want to do. so that's where things begin to decay whether it's
driving the wrong way down the street or making a bonfire at the beach that you shouldn't do,
fixing your car at the end of a roadway, changing your oil and letting it run into the sand, these
are all things we know people do and I think the town, the board, needs to step up and create a
code of conduct. You know, that, let's say in the instance of Sunday, if a police officer has to get
involved, well, the police are trained now to try to mediate things, to knock down the tension,
well, first you find out if somethings wrong. If somethings wrong, you don't mediate wrong.

They shouldn't be doing that. that's where things went bad. From there it decayed, maybe you
try to mediate there but I mean when someone is driving a car the wrong way, you can't mediate
that. when someone is building a damming up a waterway, you don't mediate that-hey stupid,
you are wrong.
SUPERVISOR RUSSELL: Can I just, there's a couple of things there, first the trampling
through the grass and your interactions with the mother speaks volumes of why the kid tramples
through the grass. And that's bad behavior. I don't know how we create code to change that.
The other thing with the guys with the dam, I'll give them a little slack. Maybe they just weren't
aware of the environmental consequence or impacts of what they were doing, rude behavior but
they rectified it at the very least.
MR. DUNN: They were respectful, they were okay. You know, they didn't like being told they
couldn't play their game but that wasn't, that was ignorance.
SUPERVISOR RUSSELL: That's what I thought that was.
MR. DUNN: It really, it wasn't vicious, when I first saw them doing it, I thought they were
trying to create a pool so they could catch bait fish. It was on the outgoing tide, so there's
always bait fish on the outgoing tide, so I thought maybe they were doing that but it's really not
the way to do it because you guys were just there two months ago doing the dredges and I mean,
what happens there is you put up a little dam and the water, the tide coming in brings in sand, it
backs that up and then when the tide comes back out, it brings sand and now you have just raised
the level of bottom biters by three or four inches in one night. And you could say, what's the big
deal? The big deal is you should have been here in January when we had an extreme high tide
and there was nowhere for it to go, so the neighborhood flooded four times in two days and it
happened again in January and that time it stayed for a week because it froze, you know, you
couldn't ride on Second Avenue, it was one big four inch thick ice pack. And again, I don't
think that the focus of any of that should be only Goldsmiths because I know the problem exists
all over and there's abuses all over and do I think you are going to send police out to you know,
do they have the time to go out checking all of this? No but to establish a list of practices and
what is not acceptable so that it's there so that it's another tool in their tool box and when they
get somewhere, and they assess something and they say oh no, you can't do that, there's no
discussion on that. This is something you can't do and if your child is doing it, then you have
got to stop them. Just, I don't want to beat a dead horse.
SUPERVISOR RUSSELL: I know, it's just, your idea of a code of conduct is compelling, the
questions is the enforcement component of it and I have got to be honest, kids trampling the
grass in the middle of the summer and we have a bar fight in the farm fields somewhere, where's
the priority? That's bad behavior that probably needs to be addressed and that's criminal
behavior.
MR. DUNN: Oh, sure.

SUPERVISOR RUSSELL: It gets to the point and this is another thing also, that kid, he's got,
we all know why he is doing what he is doing but there's so much bad conduct taking place with
the explosion of tourism and I don't want to sit here and just pick on tourists but all you see is
the complete mindset that they come out to the country and the country doesn't have any rules,
motor vehicles law or anything else evidently because people take an awful lot of liberties. And
some of it is enforceable because it's vehicle traffic violations, some that is just bad behavior
that's enforceable and a lot of it is just rudeness and complete inconsideration. I don't know how
you legislate to stop that.
MR. DUNN: I don't either, that's (inaudible) I leave that for you guys. But it's not just
tourists...
SUPERVISOR RUSSELL: Oh, I agree 100 percent.
MR. DUNN: It really isn't. you know there's a lot of people out here that love to hide behind
that finger pointing, people from the city. I am from the city and I am the guy that has planted
14,000 pieces of grass. So...
SUPERVISOR RUSSELL: Yeah but you are emotionally invested in this community. Look, I
agree 100 percent, we cannot excuse people who live here year round and their behavior, the
litter that is taking place, late in the season that's fishing, those aren't people that are coming
from outside of Southold Town, these are people that we know are fishing. We can't excuse
them.
MR. DUNN: Or what happens on Monday afternoon at 3:00, it's not tourists.
SUPERVISOR RUSSELL: You can't give locals a pass but at the same time, I think the
problem with the tourists or the population explosion is just extrapolated...
MR. DUNN: It multiplies.
SUPERVISOR RUSSELL: Yes, it multiplies...
MR. DUNN: It goes up exponentially. But they are not the only ones.
SUPERVISOR RUSSELL: I agree.
MR. DUNN: And as far as my investment, the town owns the beach and all of that and I truly
respect that but there's a view there that's mine. So I mean, I do it for myself too, it is not
entirely altruistic.
SUPERVISOR RUSSELL: You know, one thing I would say is my, I just hope on the police
report they actually spelled your last name with a D not an A. So I just hope they got the facts
right on that.
