Dear Mr. Geideman,
After much serious discussion and as a result of our Field
Inspection on March 18, 1993, the Trustees considered your
request for a groin and conclude that none is needed for this
area and that its' benefits would be limited or in fact a very
detrimental precedent for the shoreline in this area.
The Board did not summarily reject this application but would
encourage you to withdraw it voluntarily and we will return your
application ~ee without question.
Should you wish to proceed, the Board will have to consider your
application more formally than the one you submitted and we will
need a licensed land survey showing the property at appropriate
scale with one foot contours of elevation being required for the
entire project area.
In addition to the new survey it is possible that this structure
would require an impact statement and or engineering study to
justify a permit for its construction.

Wetland Application No. 78-8-1 of EDWIN BRANDENBURG to
construct a single family dwelling and catwalk has been tabled by
the. CAC. The application is incorrect, it does not reflect the
proper physical condition of the property.

location, a 30' x 4' dock. 3' x 10' ramp and 6' x 30' float.

On a motion by Bruce Loucka, seconded by John Holzapfel, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 118-4-~, of ALICE OUINN to construct
a 65' groin to regulate and control beach area sand.
The Council recommends disapproval because no need is shown.

Dear Mr. Geideman:
Since we have not received a response to our letter dated April 23, 1993 (copy enclosed)
requesting additional information on the above-referenced project, we cannot commence our
review of your federal consistency certification. Please be advised that the U.S. Army Corps
of Engineers cannot issue a permit for this project unless the Department of State concurs
with your consistency certification. A copy of this letter has been sent to the U.S. Army
Corps of Engineers.
Because of your failure to respond in a timely manner, we are closing the file on your
application. Should you desire to reapply at some later date, please submit a new Federal
Consistency. Assessment Form (FCAF) and complete maps, site plans, sketches, photos, and
description of the proposed project at that time.

Dear Mr. Geideman:
The Department has reviewed the above referenced permit
application.
The proposal fails to meet a standard for permit issuance
(6NYCRR Part 661.9(b)(1)(iii)) in that it is not reasonable and
necessary in light to reasonable alternatives.
The nearbygroins do not appear to be trapping significant
amounts of sand. Beach elevation on the south side was
approximately one foot above that on the Leeward side. The beach
consists mainly of stones which will not move with normal literal
drift. This is why there is little difference between the
leeward side and the accretion side of the existing groins.
There does not appear to be significant erosion at the site.
The need for the structure has not been demonstrated. The tidal
wetland maps (photographs taken in 1974) show a beach width of
approximately 30' to apparent high water. Current beach width
appear to be 25' to apparent high water. A five foot change in
approximately 20 years is significantly less than the average
rate of erosion in this area.
Based on a conversation between our field inspector and the
applicant on si~e, it appears that the reasons for the proposal
are for usa of the groin as a boat docking structure and to even
out the beach. These reasons do not constitute necessity, and
this the proposal fails to meet the standard.
Should the applicant wish to pursue the applications, the
applicant must provide the Town of Southold information the Town
has requested regarding this matter. Upon receipt, the Town will
determine its interest in assuming Lead Agency status for the
State Environmental Quality Review. A Negative Declaration of
Significance must be issued, or a Final Environmental impact
Statement accepted by the Lead Agency prior to the application
being considered complete.

Upon determination of completeness, the Department will
refer the matter to the NYSDEC Office of Hearings for an
adjndicatory hearing. The applicant would be responsible for
showing that the proposal meets the standards for permit
issuance, and pay all hearing costs. The Department will
recommend denial.
Please notify me in writing as to how the applicant wishes
to proceed. If no response is received within 30 days of the
date of this letter, the Department will assume the applicant has
abandoned the proposal and the application will be withdrawn.
Should the applicant choose to pursue the matter after that date,
a new application packet, supplemental materials, andfee$ will
be required.

Dear Mr. Geideman:
Pursuant to 15 CFR 930.58. the following data and information is necessary to enable the
Department of State to adequately assess the coastal zone effects of this proposed project.
NYS CMP Policy #17 recognizes both the potential adverse impacts of flooding and
erosion upon development and upon natural protective features in the coastal area,
as well as the costs of protection against those hazards which structural measures
entail. The policy states:
"Non-structural measures to minimize damage to natural resources and property, from
flooding and erosion Shall be used whenever possible."
Please analyse the use of nonstructural measures to minimize damage to natural
resources and property at the proposed site from flooding and erosion. We offer for
your consideration the alternative of beach nourishment. This would consist of the
placement of sand above MHW.
Please furnish a copy of the legal basis for the right to place the groin in the
proposed location (i.e. proof of ownership of the [and beneath the proposed groin
or written permission of the land owner).
What is the rate of erosion over the last 30 years? Please provide documentation of
changes in the location of MHW ar the site, Please provide photographs and a
drawing of the area between and just passed the existing groins depicting MHW &
MLW.

Please ~xplain how the groin will control erosion for at least thirty years. How often
will sand be moved to bypass the groin and maintain the beach on the south side of
the groin. What measurements would be taken to determine the amount of sand to
place on the other site of the groin?
Please furnish the basis for your calculations that the rate of recession south of the
proposed groin will not be increased.
How far is the house from the bulkhead?
Please analyse several alternative gro~n designs in order to minim55--e the impaq upon
littoral drift and the down current (south side) rate of recession.
Please furnish a side-view of the proposed groin and any alternative proposed groin
in a larger format allowing for reading the vertical dimensions. Please consider an
alternative groin, no higher than 1.6' above MLW and with its waterward end at
MLW.
Also we offer for your consideration the modification of the proposed groin, in order
to minimize the impact upon littoral drift, to include placing sand on the up current
(north side) of the groin at the completion of construction.
Pursuant to 15 CFR 930.60(a), the review of your consistency certification will begin after
we receive and determine that the necessary data and information is adequate to assess
coastal zone effects.
Any additional information which you believe will facilitate our consistency review of this
project would be appreciated.
A copy of this letter has been sent to the U.S. Army Corps of Engineers.
