Dear Mr. Quigley:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, September 18, 2019:
WHEREAS, on August 5, 2019 an application for a Transfer of Wetland Permit#3770'
from Thomas Prokop, as issued on August 25, 1989; and for an Administrative
Amendment to Wetland Permit#3770 for the existing 4'x26' dock and 3'x12' ramp in
lieu of what was originally permitted was submitted; and
WHEREAS, on August 22, 2019 and on September 11, 2019 the Board of Trustees
inspected said property for the proposed request; and
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area; and,
WHEREAS, the Board has considered all of the documentation submitted concerning
this application; and,
WHEREAS, on August 22, 2019 and on September 11, 2019, the Board of Trustees
found insufficient water depths, and that existing structures were not in conformity with
the original permit; and

WHEREAS, the Board of Trustees determined that the existing Wetland Permit#3770
should not be transferred as the existing structure is not in conformity with the original
permit; and
THEREFORE BE IT RESOLVED, that the Southold Town Board of Trustees DENIES
WITHOUT PREJUDICE the Transfer of Wetland #3770 from Thomas Prokop to
Kenneth Quigley, as issued on August 25, 1989; and Administrative Amendment to
Wetland Permit#3770 for the existing 4'x26' dock and 3'x12' ramp in lieu of what was
originally permitted.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Board Members,
I am requesting an amendment to existing Permit#3770, issued August 25, 1989.
The existing dock was not included in the language of the permit.
Upon review of Meeting Minutes dated August 24, 1989,by the Town Attorney,the board acknowledged the
existence of the dock.
The attached drawing represents the configuration of the water access structures at the time of our purchase of
the property.
A site visit was performed by the board on May 11,2019 in reference to a previous application that has since been
withdrawn.
I am available to answer any questions or address any concerns the Board might have including my attendance at
the September Work Session.

Dear Mr. Prokop:
The following action was taken by the Board of Town Trustees
during their regular meeting held on August 24, 1989 regarding the
above matter:
WHEREAS, Thomas D. Prokop applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated Sept. 18, 1988 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on August 24, 1989 at whick time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
-the town,
NOW, THEREFORE BE IT
RESOLVED that Thomas D. Prokop BE AND HEREBY IS GRANTED PERMISSION
UNDER THE WETLAND ORDINANCE TO:
Construct 5' x 14' float, 4' x 6' ramp, inst~ll 2 pilings. Property
located at Little Peconic Bay Lane, Southold, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for
work to be done below Mean High Water Mark:
$105.00 5' x 14' float
36.00 4' x 6' ramp
50.00 2 pilings
$191.00 total fees

The Southold Town Conservation Advisory Council made the following recommendations
at its regular meeting held Tuesday, March 9, 1989:
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
Wetland Application No. 12-7-88-81-1 of Paradise Point Association to maintenance
dredge 500 ¢.y. of materail from mouth of basin off Southold Town Harbor with
spoil to be placed as shown on submitted plan. The Council approves provided
the spoil is not placed in spoil area II (other side of bulkhead) and that the applicant
limit any spartina damage to an absolute minimum.
Basin Road, Southold.
RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application
No. 12-88-38.1-1-22 of Crescent Beach Condo Association to construct a fixed dock
150~ x 4', a I0' x 3' ramp to a 6' x 20' float.
Foot of Maple Lane, East Marion.
RESOLVED to recommend to the Southold Town Tcustees approval of Wetland Application
No. 1-5-139-1-21 of Zahra Benz to build (replace) catwalk, ramp and floating dock.
575 Westview Drive, Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
Wetland Application No. 12-4-88-90-1-16 of Thomas Prokop to construct a boat dock,
retaining wall and floating dock. The Council recommends approval provided that
the applicant removes the pipe located at the side of the dock leading into the water.
The Council suggests applicant reroute to a drywell.
Little Peconic Bay Lane, Southold.
RESOLVED to recommend to the $outhold Town Trustees approval with a stipulation
of Wetland Application No. 3-1-89-23-1-14.6 of Anthony and Rosemary Bolletino to
construct accessory swimming pool and tennis court. The Council approves but has
serious concerns about the placement of the pool and its proximity to the ground-
water. The Council suggests that perhaps the applicant should be required to
build the pool with the bottom at least 1' above groundwater.
Main Road, East Marion.
The Council made an inspection of 79-5-20.5 (Ray Kerister) to determine whether
the project was within the Trustees iurisdiction as requested by the Southold Town
Planning Board. The Council advises that the parcel contains freshwater wetlands
and marsh areas and is within the Trustees jursidiction.

In response to ~our letter regarding the newly installed dry
e~-~ I hope the' 'following wilt be helpful in answering your
questions.
The new dry well services only the front gutter runoffs as
runoffs already had dry wells.
!. The new dry well is located where The crushed stone ends
in the rear oi the property.
2~ The construction is of cement block placed around the
perimeter with the holes facing out. The center of the well is
filled with stone and broken uD ce~en~ blocks. It is
approximately 3' deep and 3' wide~
