Dear Mr. Raynor:
with respect to your letter of January 11, 1991 I can report
several developments in reference to "community" marina
proposals which may help guide you in any possible submission to
the Town for the Posillico property.
In December 1990 the'Trustee office conferred with the Town
Attorney who recommended the matter of the zoning applicability
of R40 and R80 sites use for "Community" Marinas be reviewed by
the Zoning Board Chairman. I believe the Town Attorneys have a
problem with the Town Code as it currently reads with respect to
this matter. We are presently awaiting a response form the
ZBA Chairman.
In addition to the basic code questions the Trustees also
transmitted to the Town Attorney and Zoning Board Chairman our
position in favor of "Community"marinas with certain
environmental controls (notably no loss of shellfishing). Our
developing a position in these matters will enable the Town Code
Committee to draft possible code amendments which will protect
all concerned.
The last item of interest which directly affects marina
proposals are communications we are continuing to have with the
NYSDEC with respect to their policies surrounding the newly
adopted FDA Marina Guidelines.
From these communications it would seem that boats at open
moorings will not require shellfish closures, whereas closures
at docks will take place with as few as 10 or 11 boats with or
without marine sanitation devices (MSD's$ on said boats.
Control of MSD's will reduce the area of closures.

Dear Mr. Clancy:
Your letter of June 25, 1990 and copy of you~ letter of June 4,
1990 to the Planning Board reached my desk simultaneously
yesterday.
On June 12, 1990, the Board of Trustees made a second visit to
the site in question; the first having been a month earlier with
only two board members present. These visits were the result of
a request by Henry Raynor, Jr., as agent for the owners, as to
the feasibility of providing a community marina or moorings at
the site(s) to serve the residents of the August Acres
subdivision.
As a result of the Board's site visit and its concerns, I haye
been directed by the Board to investigate the basic building,
zoning, and access issues before responding to Mr. Raynor in
writing.
Since we have no application before us and Mr. Raynor is
interested in building a suitable project with full input, your
concerns could be invaluable.
When I have had time to complete by investigation for the Boar6,
I will automatically send you a copy of my letter to Mr.
Raynor.
Please do not ~nesitate to call if I may be of further assistance
in this matter. I can be reached at home most evenings from

Dear Mr. Bredemeyer:
I am writing as a follow-up to the June 15th letter from the
Planning Board regarding SCTM1000-53-3-18 and 1000-53-3-15.1.
While I am glad to hear there are no current sub-division
applications, I can not stress enough the view of this
association that these two plots are totally unsuitable for any
and all development. As I mentioned in my June 4th letter, this
property is sandy beach and beach grass bounded by Pipes Cove and
Pipes Creek.
We urge the Town to look very closely at any proposed development
of this property. We also suggest that the Town might want to
look at this property for possible acquisition as Town property.

Dear Mr. Clancy:
The Planning Board has reviewed your letters of June 4,
1990.
The Board waived site plan approval for the structure at
the Corazzini Brothers site SCTM$1000-53-2-28, because the work
consisted of replacing the existing hopper and conveyor. A
Building Department permit was issued for the replacement of the
conveyor and hopper.
The storage trailer that is stored on SCTM$1000-53-2-9 was
issued a six (6) month permit by the Southold Town Board on
April 10, 1990. The Town Clerk's office will be able to answer
further questions on this matter.

The Planning Board does not have a subdivision application
for SCTM~1000-53-3-18. However, since it adjoins Town-owned
underwater land. your inquiry has been forwarded to the Board of
Trustees.

I am the current president of this homeowners' association on Conkling Point
in Greenport.
Some association members recently brought to m,v attention the placement of
survey marker~ on ~t 1000-53-3-18. On May 25th, I checked with Town Hall
to see if there were ~y applications pending on this lot. There were no~e.
W}~ile st~rvey markers are not a defi~Hte sign of pending activity, they do
raise the issue of the stdt~bility of this lot for development. T}~s lot
is botm~ded by Pipes Cove and Pipes Creek. It consists of sandy beach and
beach grass. In some past, severe storms, it has been completely covered
by the tide.
It is inaccessible for hea~ de~do'_pment equipment and really inaccessible for
even light development equipment.
Tt~s association wot~d like the Town to look vet? closely at ~y proposed
development, of this lot, Tn fact, in o~' minds, the lot is ui~st~table fox'
development. The same applies to adjoi~,~- Lot 1000-53-$-15.1.

Please refer to your 11-8-89 letter (~opy attached).
I was at Town Halt on May 25th and saw that a building permit was issued
for Lot 1000-53-2-28 on 3-27-90 for the purpose of replaci~w the
existing hopper axed conveyor. In my 9-25-89 letter, I expressed this
association's concern reg~'~ing the height of the new structure. Am t
correct in a~sumi~ that the height is acceptable to the Town?
As of May 25th, there was nothi~ on file in your office, the B~lding
Departme~t or the Zoz~ug Board regarding current acti vi ty for
Lot 1000-53-2-9. However, a large trailer is currently stored on this
lot ~nd appea~ to be use~ for commercial s~orage. The t~ailer appears to
be connected to electrical service. There also appears to be some
constructdon underway ~o~n~d the trailer. Given that there is no activity
in any of t~e Town departments chaz~ed with regulating property use, I
would like to know if this trailer use is acoept~ble to the Town?
I would like to add that this association zs very interested in seeing buainess
continue, eorpm~d, and prosper in $outhold Town. Our interest, however, is
bai~auced with a concern that development, whether cemmercial or residential,
is done in a way to protect Town resources.

Association
Dear Mr. Clancy:
The Board has received your letter. It is hoped that the
following information answers your questions.
With regard to the hopper structure at the Corazzini~Bros.
site, the Building Department has notified the property owner[s)
that approvals are needed from the Planning Board and the Zoning
Board of Appeals. To date, this Board has not received an
application for an amendment to a site plan. Therefore, we are
not in position to offer further comment on this particluar
matter.
With regard to the electrical service on the lot numbered
Suffolk County Tax Map Number 1000-53-2-9, the Planning Board is
not aware of any proposed development plans for the s~e.
The lot is zoned Light Industrial. However, it does not
conform to the minimum required lot area for this district. If
and when an application is made for site plan approval, the
Planning Board will have to review the matter to determine
whether the proposed use is in conformance with the uses allowed
by the Town Zoning Code. And, since the lot is an undersized
lot, the Planning Board would have to wait for Zoning Board of
Appeals to rule on whether the necessary area and setback
variances could be obtained. A copy of this letter and your
letter is being senu to the Zoning Board of Appeals, in case an
application has been made to that Board of which we are unaware.
If the property owner should make an application to develop
this parcel, the neighbors can review the application in the
office and discuss their concerns with either Board at their
public meetings or in writing.
If there are further questions, do not hesitate to contact
