Town of Southotd Southold, New York 11971 Re: Carleton Granberry, Architect House Construction - Fisher's Island Dear Mr. Lessard: Pursuant to your request for a determination on the aeed of a Wetland Permit for the above captioned matter, please be advised that I have personally viewed the subject premzses and determined that the Trustees do not have jurisdiction in regard to this matter. In considering this determination, please take further notice that this declaration should no~ be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. tf the plan of construction is altered to a distance closer then 75' please contact this office, as it may be necessary to reinspect the property again. Porter ~/ Trustees File 7 July 1986 Building Inspector Southold NY 11971 CARLETON GRANBERY ARCHITJ~CT HOUSE FOR ELIOT H PORTER/FISHERS ISLAND Building permit was denied 11 June on the basis of house located too close to a bluff or bank adjacent to Long Island Sound. This raises a question of code application to this particular situation, and of definition and location of bluff or bank. The bluff on Isabella Beach to the east has sub- sequently been located and the house site moved diagonally back north and west to clear the top of the bluff by 100' The site is at the top of a slope which descends southward toward lowland and beach and the water which is over 200' away at its nearest point. We believe (a) that the bluff is as located on the U~ited States Coast and Geodetic Survey, Chart 13214 verified by Chandler Palmer & King survey of 18 June 1986, (b) that when you get around behind the bluff the ground to the south below the proposed house location is not in the code context of a "bluff or bank" but rather a contoured slope facing more down the length of the beach than paralleling it and within accepted en9ineering limits to resist erosion and safely support the foundations (c) this slope is of a more stable soil consistency than the sand banks facin§ Long Island Sound on the north shore of Long Island, (d) this lot is not adjacent to Long Island Sound. In this respect the code is specific and unequivocal. Article 100.119.2 sub paragraph A applies only to "Lots adjacent to Long Island Sound". This lot is nearly 2 miles from Long Island Sound on Block Island Sound. Sub paragraph B covers lots adjacent to tidal water bodies "other than Long Island Sound" and r~quires a 75 foot set back. Neverth~ess the building is set back over 200' as noted above. For these reasons we believe this location is not to the requirements and respectfully request that be granted accordingly.
