That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: DAVID KRUPNICK 880 DEEP HOLE DRIVE, MATTITUCK SCTM# 1000-115-12-13 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 16, 2018 regarding the above matter: WHEREAS, En-Consultants on behalf of DAVID KRUPNICK, applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 13, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3 and 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the non-permitted jet ski floats have been removed; the existing permitted dock does not exceed the one-third rule; and the most seaward single pile can remain as a tie-off pile only; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 16, 2018, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 C WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of DAVID KRUPNICK to install a 3'x12' hinged ramp and a 6'x20' floating dock situated in a "T" position, parallel to the shoreline and secured by two (2) 8" diameter two-pile dolphins off seaward end of existing 4' x ±46"fixed timber catwalk (with 1.7'x11' bench) to remain; cut existing dilapidated ±17' bulkhead and ±23' groin to grade; and connect water and electricity to the dock; and as depicted on site plan prepared by En-Consultants, dated April 13, 2018, and stamped approved on May 16, 2018. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, on May 9, 2018 the Southold Town Board of Trustees found the application of DAVID KRUPNICK to be classified as an Unlisted Action Negative Decision pursuant to SEQRA Rules and Regulations. A Long Environmental Assessment Form and a field inspection have been completed by the Board of Trustees, and it is hereby determined that it will not have a significant effect on the environment, and; f - WHEREAS, the Southold Trustees are familiar with this project having visited the site on September 12, 2017 and on May 9, 2018, and having considered En-Consultants plans for this project dated April 13, 2018 and survey of John C. Ehlers dated December 11, 2014, and last updated on February 14, 2018 showing the proposed dock and water depths, and; WHEREAS, in reviewing the project plans dated April 13, 2018 it has been determined by the Southold Town Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shellfishers: The plan allows a standard ramp to float design that will not impede access for those seeking shellfish and crustacea in season. • Scope in relation to view shed: The seasonal end of the proposed structure lies within the pier line of neighboring docks and as such the perspective will not be discernibly different. THEREFORE, on account of the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. In Mark Terry's LWRP Memo for the Krupnick property, I assume that by"as built dock structure" he is referring to the previously existing plastic floats that were installed without a permit(and triggered a violation). But as you've seen, those floats were removed almost 6 months ago; and the fixed dock that is presently in the water is a permitted structure in Krupnick's name (WP#1708). Thus, the records Mark references are outdated relative to the more recently - prepared land survey and photographs submitted with our application. And with respect to the waterway intrusion, please note that as indicated on the plans submitted with the application, the proposed floating dock would remain within the pier line established by the adjoining dock structures and would extend approximately 26 feet seaward of MLLW, i.e., 22 percent of the 119'width of the waterway. Because the maximum one-third intrusion would equal 39 feet, a boat with a beam of 10 feet could be comfortably docked on the outside of the float with a few feet to spare before reaching that limitation. And finally,the applicants would like to maintain the single pile located at the end of the dilapidated groin structure to be removed so that it can serve as a tie-off pile during storm/heavy wind conditions. We believe this is a reasonable alternative to proposing any new/additional tie—off poles. Obviously we can discuss further at the meeting but I wanted to make the Board aware of the above ahead of the hearing. Proof that the proposed dock structure meets the 1/3 rule has not been provided in this narrow portion of the creek. 9.3. Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The proposed dock structure will extend further into public trust waters. Further, the dock structure would result in a net decrease in public access to public underwater lands. The applicant currently enjoys access to public water via an existing, private, dock structure. The incremental and segmented extensions of permanent, private, dock structures into public trust waters does not meet this policy.
