and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the

cottage; a 10'x40'6"concrete patio with 3'x36 linear foot long walkways against northerly cottage

TERMS AND CONDITIONS
The Permittee 2 Peconic Road LLC residing at 1625 Naugles Drive Mattituck,New
York, as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 18, 2018 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of 2 PECONIC ROAD, LLC applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated October 31, 2017, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application for
the existing structures on the property that include three (3) existing cottages consisting
of an existing 24'2"x20'2" southerly one-story cottage with attached 10'x20' wood deck
that is to be removed; install a new roof, new siding, and to replace existing windows
with new enlarged windows and French doors; an existing 22'3"x32'6" one and one-half
story northerly cottage with 8'x22'3" attached enclosed storage area; install a new roof,
and perform repairs and maintenance to cottage; a 10'x40'6" concrete patio with 3'x36
linear foot long walkways against northerly cottage leading to an existing 8'4'x32' one-
story 2nd northerly cottage with 10'x20' concrete patio, install a new roof, and perform
repairs and maintenance to the cottage; existing stone wall located seaward of existing
8'4"x32' cottage; existing dirt/stone driveway; existing 9'2"x9'3" pump house; was found
to be Exempt from the Local Waterfront Revitalization Program policy standards, and,

WHEREAS, in accordance with Chapter 268, said application to clear vegetation/trees
within an approximate 19,000sq.ft. building envelope area was found to be Consistent
with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 18, 2018, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of 2 PECONIC ROAD,
LLC for the existing structures on the property that include three (3) existing cottages
consisting of an existing 24'2"x20'2" southerly one-story cottage with attached 10'x20'
wood deck that is to be removed; install a new roof, new siding, and to replace existing

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions to remove the existing 24'2"x20'2" southerly one-story cottage with attached
10'x20' wood; install a new roof, new siding, and to replace existing windows with new enlarged
windows and French doors; an existing 22'3"x32'6" one and one-half story northerly cottage with
8'x22'3" attached enclosed storage area; install a new roof, and perform repairs and maintenance
to cottage; a 10'x40'6" concrete patio with 3'x36 linear foot long walkways against northerly cottage
leading to an existing 8'4"x32' one-story 2"d northerly cottage with 10'x20' concrete patio, install a
new roof, and perform repairs and maintenance to the cottage; existing stone wall located seaward
of existing 8'4"x32' cottage; existing dirt/stone driveway; existing 9'2"x9'3" pump house; is EXEMPT
from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS items 'B"which states:
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site
(inplace), including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced,
rehabilitated or reconstructed without a permit and shoreline erosion control structures (including,
but not limited to, groins,jetties, bulkheads, filled piers) located within Great Peconic Bay,
Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island
Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and
Block Island Sound(excluding all creeks);
The proposal to clear vegetation/trees within an approximate 19,000 sq.ft. building envelope area is
recommended as CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided:
1. Due to the 20 percent slopes or greater in the area proposed to be cleared, it is
recommended that storm water/erosion controls are in place to prevent potential non-point
pollution to water bodies as long as the soil remains exposed and un-vegetated.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

I am scheduled to meet with you on Monday February 12, 2018. 1 am submitting
this information in anticipation of our meeting.
On October 31, 2017 1 filed two separate applications with two fees regarding
the above property. The (1) First application was for the removal of existing Marine
Structures and Proposed Marine Structures. The (2) Second application was for wetland
permit for the pre-existing dwellings and existing upland structures. My client wants to
make repairs to the pre-existing dwellings and clear land, as measured by the surveyor,
100' from wetlands.
The property had been used by the prior owners for commercial fishing and the
property became a dilapidated boat and fishing equipment storage area. There were
squatters in the cottages. My clients purchased the property, removed all the dilapidated
boats, tons of garbage, abandoned equipment and removed the squatters, leaving the
property clean and ready to be improved.
Since the filing of the application for the Marine structures, NYS DEC has made
certain recommendations which have been incorporated into the most recent Sea Level
Mapping survey prepared February 9, 2018 and herein enclosed.
(1) As to the first application: A Wetland Permit for proposed Marine Structures
filed October 31, 2017 ( Sea Level Mapping survey with cross section last dated
February 9, 2018)
(1) Remains of damaged 5' x 128' Wood Catwalk to be removed (dimensions from
surveyor)
(2) cut back 135 If of dilapidated bulkhead to 6"+/-above grade and plant area with alterna
flora 18" oc to restore area of intertidal marsh (approximately 2400 sq.ft.)
(3) proposed 140 If of rock revetment landward of scarp and Spring High Water (SHW):

(4) reconstruct 51'and 41'(92 If)of existing functional bulkhead in place and 2' higher than
existing, with c-lock vinyl, in place and new 18' return on west with Thru-Flo safety cap;

(6) Proposed 4' x 24' fixed walk to 3' x 18' seasonal ramp to 6' x 20' seasonal float
(7) new piles 8" diameter
As to the Second Application also filed on October 31, 2017: Wetland Permit for pre-
existing structures.
There are 3 pre-existing cottages, pump house and walkways, built prior to zoning
and prior to Trustees Wetland Permits. In order to make ordinary maintenance and
repairs we have filed a wetland permit application. All the cottages have pre-co's pending.
One cottage has a deck which was added by the prior owners many years ago which, if
retained, would require a variance. My client is removing the nonconforming deck as part
of the wetland permit covering all the existing structures.

simplified since we requested a wetland permit for the existing structures separately from
the proposed marine structures. The Board pulled the project from your November
calender until I revised the project descriptions. You may not have been aware that there
