Project Description: Demolish and remove existing one-story, single-family

Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
survey prepared by Saskas Surveying Company, P.C., dated March 27, 2018
and stamped approved on May 16, 2018.
Special Conditions: Existing privet hedge to be maintained to no shorter than 3'
in height.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

LLC, both with a mailing address of 456 West 196 Street, New York, NY 10011 hereinafter referred to as
"DECLARANTS":
WITNESSETH:
WHEREAS,DECLARANTS are the owners of certain real property located 18915 Soundview Avenue,
Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map as District
1000, Section 51, Block 1, Lot 15, which is more particularly bounded and described as set forth in Schedule
"A" annexed hereto,hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS,the DECLARANTS therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a fifteen-foot wide vegetated"non-turf buffer" be established and maintained adjacent
to the bluff crest,
NOW,THEREFORE,the DECLARANTS do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained adjacent to the bluff crest on the subject premises a
fifteen-foot wide vegetated"non-turf buffer"as defined by Chapter 275 of the Town Code;and
2) These covenants shall run with the land and shall be binding on the DECLARANTS, their heirs,

STATEMENT OF EFFECT
The design of the overall site redevelopment will provide an improvement to the environmental condition of the site,
including the adjacent bluff,beach, and tidal waters,through an increase in the property's bluff setbacks and the project's
incorporated mitigation measures. Specifically,the site is presently characterized by a single family dwelling located 48
feet from the bluff crest with no drainage system to collect roof runoff, an antiquated septic system located 36 feet from
the bluff; and a lawn that extends to the edge of the bluff. The proposed project seeks to remove these existing structures
and construct a new dwelling located 52 feet farther landward of the bluff to achieve a bluff setback of 100', i.e., a 108%
improvement to the dwelling's bluff setback;to install a drainage system of leaders, gutters, and drywells to collect and
recharge roof runoff;to install an upgraded, SCDHS-approved sanitary system located more than 150 feet from the crest
of bluff and more than 230 feet from the surface waters of Long Island Sound; and to establish a 15-foot wide,
approximately 1,500 sf non-turf buffer along the top of the bluff in place of existing lawn. Together,the proposed
landward relocation of structures and additional mitigation measures will thus result in a substantial improvement to the
property's bluff setbacks; a potentially significant improvement to both groundwater and surface water quality through
improved treatment of effluent before it reaches the groundwater table; a reduction in potential roof runoff through
capture and recharge by the proposed drainage system;and improved capture and filtering of surface water runoff by the
non-turf buffer before it reaches the bluff,which also protects against potential top-down bluff erosion. Therefore,the
project will have a beneficial, impact on the environmental condition of the site and adjacent natural resoures.

POLICY 5.
The proposed site redevelopment includes the installation of a presently absent drainage system of leaders, gutters, and
drywells to collect roof and site runoff from the buildings being constructed more than 100 feet from the bluff;and a 15'
wide, approximately 1,500 sf non-turf buffer will be established adjacent to the bluff, which can serve both as a sink and
filter for stormwater runoff and contaminants. By thus increasing on-site groundwater recharge,reducing lawn areas,and
increasing the setback of lawn areas from the bluff and surface waters of Long Island Sound,the potential quantity of site
runoff reaching surface waters will be decreased; and the quality of runoff will be improved through a reduced
concentration of potential fertilizers,pesticides,and insecticides. Groundwater and ultimately surface water quality will
also benefit from the replacement of the nonconforming existing sanitary system located 36 feet from the bluff with a new
SCDHS-approved system located more than 150 feet from the crest of bluff and more than 230 feet from the surface
waters of Long Island Sound. Therefore,the project is consistent with Policy 5, as water quality and supply will be both
protected and improved as a result of the mitigation measures associated with the project.
POLICY 6.
The design of the overall site redevelopment will provide an improvement to the environmental condition of the site and
adjacent ecosystems, including the adjacent bluff, beach, and tidal waters, through an increase in the property's bluff
setbacks and the project's incorporated mitigation measures. Specifically, the site is presently characterized by a single
family dwelling located 48 feet from the bluff crest with no drainage system to collect roof runoff, an antiquated septic
system located 36 feet from the bluff; and a lawn that extends to the edge of the bluff. The proposed project seeks to
remove these existing structures and construct a new dwelling located 52 feet farther landward of the bluff to achieve a
bluff setback of 100', i.e., a 108% improvement to the dwelling's bluff setback; to install a drainage system of leaders,
gutters, and drywells to collect and recharge roof runoff,to install an upgraded, SCDHS-approved sanitary system located
more than 150 feet from the crest of bluff and more than 230 feet from the surface waters of Long Island Sound; and to
establish a 15-foot wide, approximately 1,500 sf non-turf buffer along the top of the bluff in place of existing lawn.
Together, the proposed landward relocation of structures and additional mitigation measures will thus result in a
substantial improvement to the property's bluff setbacks; a potentially significant improvement to both groundwater and
surface water quality through improved treatment of effluent before it reaches the groundwater table; a reduction in
potential roof runoff through capture and recharge by the proposed drainage system; and improved capture and filtering of
surface water runoff by the non-turf buffer before it reaches the bluff,which also protects against potential top-down bluff
erosion. Due to its location landward of the bluff crest, the project is exempt from the NYSDEC's permitting
requirements pursuant to Article 25 of the New York State Tidal Wetlands Land Use Regulations. Thus, for all of the
foregoing reasons,the project is consistent with Policy 6.

Dear Mr. Domino:
Several years ago, on behalf of our clients, we obtained authorization from the Trustees to
demolish the existing house; construct a new house approximately 100 feet from the bluff crest;
and construct a new swimming pool between the proposed dwelling and the bluff. Such
authorization was granted in the form of two approvals: Administrative Wetlands Permit No.
8417A, which was issued for the demolition and new dwelling construction on May 21, 2014,
and extended twice through May 21, 2018; and Wetlands Permit 8468, which was issued for the
swimming pool on July 23, 2014, and extended twice through July 23, 2018.
The owners are finally prepared to commence work and intend to have the swimming pool
construction completed before Wetlands Permit 8468 expires in late July, but in order to also
proceed with demolition and construction of the new house, they must secure a new wetlands
permit to replace Administrative Wetlands Permit No. 8417A, as it cannot be further extended.
To that end,please find attached an application for a new Administrative Wetlands Permit for the
proposed demolition and the construction of a new dwelling that continues to meet the 100' bluff
setback and is smaller than that previously approved, as depicted on a modified site plan
prepared by Saskas Surveying Company, P.C., last dated March 27, 2018 (copies included with
application). Please also note that the 15' nonturf buffer required by the prior permit was
covenanted in 2014 and is labeled accordingly on the site plan (copy of covenant included with
application).
