N.Y. and subject to the Terms and Conditions Jlsfed on the reverse side hereof, of Southold Town Trustees authorizes and permits the following: To construct a deck 10'4" across extending outward from bat~ house and 30' across. all in accordance wlth the detailed specifications as presented in the originating application. IN WITNESS WHEREOF, The said Board of Trustees here- by causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this dat,e. TERMS and CONDITIONS The Permittee Vincent J. Petrozzo residing at 9980 Nassau Point Road, Cutcho~ue N. ¥~ as part of the consideration for the is~ance of the Permit does understand ~ prescribe fco the fol- lowing: 1. That the said Board of Trustees and the Town of Sonthold axe released from arty :md all damages, or claims for damages, of suits arising directly or indirectly as a result of :my opec- at:ion performed pursuant to this permit, and the said Permittee will, at his or bet own expense, defend any and ail such suits initiated by third parties, and the said Permittee assumes full liablii~ with respect thereto, to the complete exclusion of the Board of Trustees of the Town of $outhold 2. That this Permit is valid for a period of 2 4 mos. which is considered to be the estimated time required to complete the work involved, but should drcomstancas warrant, reque*t for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Pemaiteee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orizatinn was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreaso~nable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass :md repass along the beach between high and Iow water marks. 7. That ff future operations of the Town of Southuld require the removal and/or alterations in the location of the work herein authorized, or fi, in the opinion of the Board of Trustee% fl~ work shall cause unreasonable obstructaon to free navigation, the said Permlttee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee ox the completion of the work an~- orized. 9. Petrozzo 9980 Nassau Point Road Cutchogue, NY 11935 Re: SCTM a1000-119-1-19 Dear Mr. Petrozzo: The following action was taken by the Board of Town Trustees during its regular meeting held on August 1, 1991 regarding the above matter: WHEREAS, VINCENT J. PETROZZO applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 8, 1991 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 1, 1991 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT VINCENT PETROZZO BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: construct a deck 10'4" across extending outward from bath house and 30' across. Located at Nassau Point Road, Nassau Point. This permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit Issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this projeet.
