Dear Mr. Krupski,
RE: 16215 Soundview Ave., Southold, NY
This new material, a corrected survey and an apologetic
letter from Mr. Van Tuyl, copies of both which are enclosed,
should be helpful in closing the file on this minor
misunderstanding.
If Mr. Van Tuyl's original survey had shown the true
location of the small platform, neither Mr. Boris Grzic, our new
neighbor, nor the Town would ever have become involved. Too, now
that Mr. Paul Te~enhuis oz the ~u.~.~ Department of~~e~'~,'~-',~
Soil Conservation Service has recommended we should leave the
platform alone, it would seem the interests of all parties are
satisfied.
I look forward to your agreement and thank you for your
patience and understanding.

Dear Mr. Petrie:
As per our conversation, I am enclosing copies
of your corrected survey of the Southold property, showing the
proper location of both your house and the platform. I am sure
you are relieved, as well as we are, to now have the true pic-
ture of things there.
As discussed, our field location of your house
was done correctly, b.ut there was an erroneous plotting of it
on the map, resultmng^an apparent 25-foot offset from the line
to the house. Our recent research and retrace found this situ-
ation to be in error, and thanks to your finding that pipe, we
now have the true picture, showing the offset to be 37~ feet, and
the much-discussed platform to be 13 feet clear of the line. We
have noted an amended date~ on your map, and are sending a copy of
your neighbor's survey to him with the correct notation.

Trusting that the matter has,caused you too much
trouble, and that all can be straightened out with the building
department of the Town, we apologize for the concern of all.

Dear Mr. Krupski,
I am reluctant no bring such a small mamner to one as busy
as you are but I'm confident this situation can be easily
resolved if the facts are clear and if i know exactly what I
should do to eliminate a zoning violation I received from the
town Augusn 15, 1995.
Here's the background.
* We built our house at 16215 Soundview Avenue twenty-three
years ago in the summer of 1972. with the scrap, lumber from the
new house, I constructed a very rudimentary platform maybe 4 ft.
x 6 ft. at the top of the cliff overlooking the sound
* Our daughter was married at the Presbyterian Church in
Southold on August 7, 1982. Since we planned the reception am
home, we replaced my rough handiwork with a new platform approx.
8 ft. x 10 ft. more than 13 years ago in the Spring of 1982. We
now find there's no evidence the platform builder got a building
permit.
* For all these years we have had no neighbors on either side
of our property. This changed recently when the property wesn of
us was recently sold.
* The land survey for the new owner showed, to our surprise, a
sliver of our platform was on his property.
(During negotiations for the purchase of the property nexn
to us some one (probably the realtor involved) checked with
the Town of Southold and could not find a building permit
for the 13 year old platform.)
* We have smnce worked out a very simple and amicable
arrangement with Mr. & Mrs. Boris Grzic, the purchasers of the
property next to us, so that the platform location is no longer
an issue, which leads us to the violation and the apparent
failure to apply for a building permit 13 years ago.
* I would like to do whatever you suggest to bring this to a
close. However, I am strongly convinced that to remove the
platform would do great ecological harm to a sensitive area of
the cliff. Please note that:
The US Department of Agriculture Soil Conservation
Service has examined our property, particularly the
face of the cliff and has recommended that the platform
should remain intact.
(Mr. Paul TeNyenhuis, of the Soil Conservation
Service, also makes the point on the enclosed copy
of his inventory and evaluation dated Sept. 8,
1995, that "Dense vegetation surrounds the deck on
all sides'~ and '~Removal of the deck will disturb
the existing vegetation".)
Wou!dn;t it be a logical solution for you and your Board of
Trustees to simply grant me a waiver on this minor matter? E.G.
"Waivers are granted for projects the Trustees feel are minor
matters which would have no environmental impact if imple-
mented''.*

SITUATION: A site inspection was performed at Mr. Petrie's home on Sound Ave. Extension
in Southold on September 8, 1995. Met Mr. Petrie at the house where he explained
he needs an evaluation of lhe, bluff and an overhanging deck to receive a Certificate of
Occupancy and permits from the Town of Southold.
The lot is heavily vegetated across the rear yard leading up to the bluff's
edge. No apparent erosion problems exist on the lot. One of two footpaths gently
slopes toward the bluff face leading to a stairwell. Repairs had been done due to
damage by past storm activity. All of the upper half to two thirds of the bluff face
is still heavily vegetated. Erosion has caused damage to the lower one third to half
of the bluff face. Much of this has been left bare and a vertical drop appears just
below the existing vegetation. There are no toe stabilizaiton structures at this site
or to either side. Debris has been piled along the toe, some on purpose, some by
storm tide deposits. The second footpath is flat to gently rising to the platform deck
overhanging the bluff. Dense vegetation surrounds the deck on ali sides.
SUGGESTED SOLUTION(S) ,
Toe stabilization is recommended but may be prohibitively expensive due to
lack of access. Contact Jay Tanski at New York Sea Grant Extension Service, phone
632-8730 for professional recommendations on toe stabilization structures. Permits will
be required for construction by New York State Dept. of Environmental Conservation
and the Town Planning Board.
Trees on the bluff create an erosion hazard. Remove them by cutting
them off at the base and dispose of them away from the bluff. However, leave the
root system intact so as not to disturb the bluff face.
Normally, we recommend cutting back the slope of the bluff to a natural
angle of repose, however in this situation you would lose your existing vegetation.
Therefore, after any construction and tree removal, plant the bare areas to 'Cape'
American Beachgrass by following the enclosed technical information.
Understand that if a hardening structure is not used to stabilize the toe
of the bluff then erosion may occur more rapidly.
The area surrounding the deck appears stable for now. If the toe con-
tinues to ero cb, loss of the deck will follow. Removal of the deck will disturb the
existing vegetation. Minor alterations to the deck are possible without disturbing
the bluff face. We recommend leaving the deck intact unless it becomes undermined.
