The public comment period on the Draft Environmental Impact Statement Southold Gas
Station and Convenience Stone (May 2017) closed on September 13, 2017.
The Planning Board is requesting that your applicant prepare draft responses to the
substantive and general comments received on the DEIS (Attached). As required by
SEQR law, the Planning Board, as the lead agency will be responsible for the adequacy
and accuracy of the Final Environmental Impact Statement (FEIS).
The following materials are attached to facilitate the process.
1. A list of substantive and general comments prepared by the Planning Board
as lead agency.
2. Written comments (Appendix A) and the minutes (Appendix B) from the
August 14, 2017 public hearing on the Draft Environmental Impact Statement
Southold Gas Station and Convenience Store (May 2017).
The Planning Board has 45 calendar days from close of the hearing record to file its
accepted FEIS, however, the time may be extended if it determines that additional time
is needed to adequately prepare the FEIS. It is expected that additional time will be
necessary to complete the document.

SUBSTANTIVE AND GENERAL COMMENTS ON THE DRAFT ENVIRONMENTAL IMPACT STATEMENT
FOR THE SOUTHOLD GAS STATION AND CONVIENANCE STORE

SUFFOLK COUNTY, NEW YORK
All written correspondence is included in Appendix A. The public hearing transcripts are included
as Appendix B(August 14,2017). The following sections summarize the comments set forth in the
written correspondence and verbalized during the public hearings. Both substantive and general
comments,in either support or opposition of the proposed action,are included in the list. Suffolk
County Route 48 is abbreviated CR 48 and New York State Route 25 as SR 25.
Written Comments in Opposition of the Proposed Action
Brett Anderson
> There are already sufficient options in the immediate area for gas and a convenience store.
> What is the need for a garishly lit, corporate branded gas station to sell what residents of
Southold can already get,barely a mile down the road?

> Concerns regarding traffic,placement of pumps along with exits and entrances.
> The current business has not ever come close to the traffic on our street that a 12 pump,23+
car parking lot will generate if built.
> If approved there will be an increase in accidents at this intersection.
> It is totally irresponsible to have an entrance and exit on the south right merge onto Youngs
Avenue.
> The town,county and state will have to come up with solutions when the accidents with
potential fatalities start.
> The Traffic Study(Appendix 15)that was submitted to the Planning Board does not match
what we see here everyday.
> Some significant things to consider from the traffic study are peak tourism months. Peak
tourism months are now from May to the end of October. The study was done in
November.
> On page 3 of the(traffic)study the roadway network was noted. However,what wasn't
noted is Youngs Avenue as a 2 lane undivided roadway with no shoulders. This leaves a
driver with no room for error. When heading east on North Road/48,most drivers use the
right turn as a merge onto Youngs. What this means is that most cars corning onto Youngs
are coming at a higher rate of speed.
> On page 7 in table 1 the estimated increase of trips on a Saturday was 103. We find that
hard to believe when they recorded 210 actual trips going to and from 48.

data from pages 4-6.

Statement(FEIS). It is necessary to understand what compounds were found on the site in
order to properly assess existing conditions,explore potential remediation/mitigation
measures and evaluate the risk posed by any future site usage or conditions that could
further impact groundwater and soils.
> The DEIS does not discuss the site's existing conditions as related to any old underground
fuel storage tanks that may have been utilized when the site operated as a gas station
decades ago. The HIS should discuss the existence or absence of any bulk fuel storage tanks
and as necessary,propose for tank removal, soil testing and remediation prior to any project
approval.
> Site plan depicts two separate ingress/egress points. One located on County Road 48 and the
other on Youngs Avenue. The traffic study conducted by Schneider Engineering omitted
several crucial analyses in order to determine the project's impact on the subject intersection.
o Actual traffic counts were not taken during September—October. Such traffic
accounts should be required.

o There was no discussion of safety regarding left hand turns exiting gas station to
return County Route 48 via Youngs Avenue. The FEIS should explore the potential
accident risk associated with potential conflict between southbound traffic and
Youngs Avenue and traffic exiting the gas station attempting to return to Route 48.
> The Alternative"Reduction in Pump Island and Canopies"pg 70.Does not provide an
appropriate level of detail and analysis in order to assess its ability to mitigate the potential
visual impacts associated with the proposal.
> The DEIS discounts this alternative merely by stating that it's not feasible due to potential
marketing and business ramifications.
> The need for a gas station this size was not sufficiently justified by a market analysis,
therefore,it would be impossible to argue that a reduced alternative would negatively
impact the business aspect of the proposal.
> The discussion on the alternative should provide traffic and aesthetics and community
character. The following questions should be addressed in the FEIS:
o How many fewer vehicle trips will the alternative produce?
o What potential changes in the"level of service"will occur at the intersection of
Youngs Avenue and County Road 48?
o How might aesthetics,lighting and community character be amended to reduce
impact on the community with fewer pump station and canopies?
> The DEIS lacks a discussion of on how the Special Exception use meets the 23 standards.
This is a glaring omission that segments a crucial factor in the review process and approval
of this project. The FEIS must include a discussion of how the proposed gas station use
meets or does not meet the"special exception"use.

Town of Southold Planning Department Staff Comments
The Planning Board staff has reviewed the resubmitted Draft Environmental Impact Statement
Southold Gas Station and Convenience Store (draft EIS) dated May 2017 and have the following
comments and questions:

1. Page 7.
Staff disagrees with the following assessment.
The site falls within the New York State Scenic Byways area of CR 48, and within the
boundaries of the New York State North Shore Heritage Area Management Plan. Therefore
the existing land use, zoning and structures associated within the Town Code are considered
compatible with the transportation corridor and are representative of the region's scenic,
recreational, cultural, natural, historic and archaeological significance.
2. Page 10.
The DEIS indicates that a subsurface investigation was conducted by Berninger Environmental
Inc. and three (3) soil borings were performed in the vicinity of a suspected petroleum UST.
Why were only(3)soil borings sampled? What regulatory sampling protocol was used to
determine the number of adequate soil boring samples needed on site to adequately assess
potential contamination?
3. Page 11.
_The DEIS indicated that the SCWA provided the location of public water supply wells within
2,500-ft. of the subject site. The nearest wells are located 2,033-ft. northeast of the site,north of
i Old North Road.
Other SCWA wells are located at CR 48 west of the site and at a location east of Kennys Road;
each location is beyond the distance of 2,500 ft.
Please discuss and confirm with the SCWA that the past use of the site as a fuel station has
resulted in no impact to the water quality of the wellhead. Further, does the proposed project lie
in the"zone of influence"of the wellheads?
4. Page 12.
The DEIS states that:
The existing noise levels measured at the subject site and at nearby locations are expected to
remain at the same level under the proposed project scenario.
Staff disagrees with the above statement. Could you explain the rationale further?
On the same page it is stated that:

A temporary increase in noise may be experienced during certain periods of
construction activity which can be minimized by staging the hours of the work.
Is there a proposal for staged construction activities? Will construction be conducted on
Sundays and holidays?
5. Page 13.
Staff disagrees with the conclusion that the proposed 1920's theme design mitigates impacts to
aesthetics,community character and the Scenic Byway. See item regarding Section 6.4 below for
more detail.
6. Page 20, Section 5.2.
The lengthy discussion on the BP existing gas station located on County Route 48 and access
challenges is irrelevant in the context of environmental impacts that the proposed convenience
store and fuel station could generate.
7. Page 32. Section 5.4.
- The DEIS indicates that a groundwater monitoring well was installed and that the groundwater
! general horizontal flow direction is southerly and southeasterly.
The report lacks an in depth discussion on groundwater quality findings. Why was the
discussion omitted? Was groundwater sampling conducted on properties to the south?
Note that the Town Comprehensive Plan and chapters have not been adopted by the Town Board
and is in draft form. Reference should be noted as such.
8. Page 42. Section 6.4.
Section 6.4 ignores the obvious regarding the difference between one canopy and two. It is clear
that removing the front canopy mitigates the visual impacts and impacts to aesthetics, scenic
resources and community character on this scenic byway. It seems a stretch to state that adding
two gas station canopies will improve the situation at this site.
9. Pages 45-48. Section 7.2.
Where can the Berninger Environmental,Inc.report be found in the DEIS?
On Page 48 of the DEIS it states that:
Two (2)groundwater samples were collected from each soil boring located where a
suspected UST was formerly thought to have been located(based on interviews).

Laboratory results found that to minor detections of less than 1.5 parts per billion
were recorded Two (2)groundwater samples were collected from each soil boring
located where a suspected UST was formerly thought to have been located(based on
interviews). Lab results from the groundwater samples were compared to the NYS
Standards outlined in the TOGS document described above. Two minor detections of
less than 1.5 parts per billion were recorded.
What compounds were tested for under the USEPA 8260 and 8270 BN methods referenced
on page 48? What compounds were detected? Could you confirm that the site was fully
investigated to determine the nature and extent of potential contamination pursuant to
NYSDEC sampling protocols?
Due to the historic use of the property as a gasoline station and"minor detections"why
weren't additional soil borings taken over a larger area of the site rather than the minimum of
three? A concern is that Unleaded Gasoline was on site, stored underground and dispensed,
and vehicles were repaired on site.
Was the site samples analyzed for benzene,toluene,ethylbenzene,and total xylenes(BTEX),
methyltertiary butyl ether(MTBE), and total petroleum hydrocarbons (TPH)?
The NYSDEC Site Investigation Protocols provided as Appendix 4 in the DEIS includes a
section on testing protocols for older gasoline product that states.
It is hard to distinguish between weathered gasoline product and fuel oil.
If you have a possible old leaded gasoline spill,you can ask the laboratory
to analyze the sample for lead but since lead doesn't travel very far in
soils, the laboratory may not find it in a sample taken at some distance
from the source of the spill. In addition, unless the laboratory can analyze
for organic lead, a total lead analysis will also measure natural organic
and inorganic lead levels and notjust lead levels due to the spill alone
(i.e., it ispossible to obtain a false reading, especiallyfor soils high in
inorganic lead). Reliable measures of organic lead contamination can only-
be obtained where background total lead concentrations are known or can
be analyzed.
For these reasons, therefore, we recommend that a TPH analysis also be
conducted to check for other less mobile petroleum constituents. For an
unknown believed to be, or to contain some kind of,petroleum product,for
older spills, or for known spills of diesel and fuel oils, the laboratory
should be asked to analyze the sample first for TPH using a gas
chromatograph (GC). This analysis detects straight-chain hydrocarbons
and aromatic constituents, and the results are reported as the sum of all
hydrocarbons in the sample, rather than as individual chemicals. The GC

analysis should then be compared against the patterns for different
petroleum product standards to determine if the pattern resembles,for example, gasoline-
type product or a fuel oil. If the tentative indication is
that the product is gasoline, the sample should be analyzed for BTEX.
Was this testing protocol followed if not,will it be followed if a suspected spill has been
discovered?
Was testing of the soil samples and groundwater conducted by a private or 'but-of-house"
laboratory approved by NYSDOH to perform the specific analyses required?
10.Page 49 and 50. Section 7.3.
The vacuum cleaner sound was recorded as 87 dBA higher than the maximum threshold of
85 dBA for an eight hour time period. What threshold is referenced here?
The statement that"there will be no noise above that which currently occurs from existing
traffic"is not accurate when the vacuum cleaner standard was found to exceed traffic
noise levels at the BP gas station. Is there a vacuum cleaner model designed to reduce noise
levels? The peak noise level is 94.75 dBA as indicated in Appendix 11. What generated this
- noise level?
Are the pumps proposed to have electronic screen advertisements that generate noise?
11. Page 58. Signage
The DEIS indicates that the sign will include illuminated fuel placards for regular gas,plus.
Super, diesel and E-85. The 36 square foot area,wall mounted convenience store sign will be
internally lit, and be located at a maximum height above finished grade of 15 feet. The
illuminated and internally lite proposed sign design does not appear to meet Town Code
regulations Article XIX. Signs § 280-87.
Provide analysis that the proposed signs meet Town Code. Does the sign design coincide
with the visual renderings in Appendices 26,27 and 28?
12. Page 60. Pedestrian and Bike Traffic
The DEIS links customer and pedestrian volume with potential impacts and discounts the
concern of public safety based on lack of significant numbers. Pedestrian safety is attributed
to well-designed pedestrian facilities such as sidewalks, signalized crosswalks and sufficient
signage and cues.
The claim that without an existing system ofpublic sidewalks, it is unlikely there are any
significant impacts to pedestrian traffic is unsupported. Conversely,without adequate

sidewalks connecting Youngs Avenue to the site for safe pedestrian access to the site,public
safety is at risk regardless of the number of pedestrians accessing the site.
13. Page 61.
The DEIS states:
The proposed action has no significant impact on the pedestrian access to the site,pedestrian
crossings at Youngs Avenue or pedestrian access to north and south crossing over CR 48
The TIS concluded there is no significant change in vehicular traffic between the build and
no-build alternatives. The conclusion as applied to pedestrian and bicycle public safety
indicates that pedestrians and bicyclists will be at no higher safety risk than under the build
and no-build scenarios. Mitigating measures would not be required under the build
alternative.
Staff disagrees with the above statement. The proposal to locate a more intense use
(including a Convenience Store)on the site that is expected to be frequently accessed by
pedestrians over an incomplete sidewalk system down Youngs Avenue will result in a higher
safety risk to pedestrians walking within the roadway. This use coupled with the surrounding
business zoned parcels within%4 mile of the parcel will generate pedestrian traffic.There is a
development only 2/10 of a mile down the road with 96 dwelling units in it.The fitness
center on the opposite corner could also generate pedestrians as customers there may walk
over to purchase items. In addition there is a 5-acre Business-zoned parcel at the northeast
corner and a 30-acre residential parcel about 1/10 of a mile away that are undeveloped and
both are potential future pedestrian generators.
The Convenience Store use,once created would become a destination for pedestrians within
the area,including patrons from the fitness center at the northwest corner of the intersection,
and the development of adequate, safe pedestrian infrastructure is warranted.
14. Page 66.
The DEIS references a scenic easement in the sentence.
There are other commercially developed projects within the scenic easement within Y2 mile of
the proposed project.
What scenic easement is being referred to?
15. General comment—the Comprehensive Plan Update is a draft and should not be used as
guidance in a DEIS because it has not been formally adopted by the Board.

Dear Mr.Wilcenski,
I write in connection with the application for approval of a site plan for a new gas station
and convenience store at 4540 CR 48. That application was the subject of a public hearing at the
August 16,2017 session of the Planning Board,which I was not able to attend.
The Board should reject the application. There are already sufficient options in the
immediate area for gas and"convenience store"type purchases. As to gas stations,there is
already a BP gas and convenience store approximately a mile down Route 48,as well as a Gulf
gas and convenience store even closer on Main Road. There is also a 7-11 convenience store
practically down the street in downtown Southold,to say nothing of various family-or local-
owned options for coffee and snacks in town(such as Southold Pharmacy,IGA,North Fork
Roasting Co.,and others).
What possible need is there for a(no doubt)garishly lit,corporate-branded gas station to
sell things that residents of Southold can already get,barely a mile down the road? There is no
need. The Planning Board should reject the application.

We have been residents of Youngs Avenue for almost 30 years. We have
lived here during many changes to our village. One of the biggest changes
is the volume of traffic. We continue to be very concerned about the gas
station and convenience store being proposed for the corner of Youngs
Avenue and Rte 48/North Road.
After reviewing the DEIS submitted on your web site we still have concerns
regarding traffic, placement of pumps along with exits and entrances.
The Renders A and B in Appendix 27 and 28 show 4 pumps facing the
North Road and 8 facing the residential area on Youngs Avenue with only 4
parking spaces fronting North Road and the majority sharing property lines
with the residential area. This rendering shows that the applicant is not
willing to be a good neighbor and has no regard for the residents of Youngs
Avenue to the south.
The businesses that are currently on site: Tidy Car, East End Camper and
Pete's Detailing have not ever come close to the traffic on our street that a
12 pump, 23 + car parking lot will generate if built.
If approved there will be an increase in accidents at this intersection. It is
totally irresponsible to have an entrance and exit on the south right merge
onto Youngs Avenue. The town, county and state will have to come up
with solutions when the accidents, with the potential for fatalities start.
This will be a burden to all taxpayers.
The traffic study, (Appendix 15), that was submitted to the planning board
along with the traffic response, (Appendix 25), does not match what we
see here on our street everyday. There is traffic here all year long
regularly, some hours more, some less, but continuous. We are a unique
street because we are a direct route to the village of Southold from North
Road. The only traffic light on Route 25 in our village is at the corner of
Youngs Avenue and Route 25, so we are always a more heavily travelled
street.
Some significant things to consider from the traffic study are peak tourism
months. In reality peak tourism months are now from May through the
end of October. The study was done in November. On page 3 of the study
the roadway network was noted. However what wasn't noted is Youngs
Avenue as a 2 lane undivided roadway with no shoulders. This leaves a
driver with no room for error. When heading east on North Road/48 most
drivers use the right turn as a merge onto Youngs. What this means is that
most cars coming onto Youngs are coming at a higher rate of speed.
On page 7 in table 1 the estimated increase of trips on a Saturday was
103. We find that hard to believe when they recorded 210 actual trips
going to and from 48. On pages 9 and 10 the pass by numbers in figures 5
and 6 should be looked at with the real data from pages 4-6.
On a recent afternoon July 13th at 3:40pm I started counting vehicles going
by my house both to and from the North Road/48. I counted 47 vehicles
which included 2 large trucks in 9 minutes. The formulas that were used
really don't address what's going on with the volume of traffic in our
village. We have seen a huge increase in the 2 years since the study was
done.
Our response has not taken into account all the other issues with lighting,
noise and potential crime. The traffic issues alone should be a reason to
stop this proposal from moving forward.

As current citizens of Southold,we owe it to ourselves and to all future generations of citizens to be
responsible stewards of all the town's assets.Real estate is finite and we should make sure that we use
our land wisely and insure that any commitments we make are in the best interest of the entire
community.
The community does not need another gas station as there are rarely,if ever,lines at the existing
stations. Putting oil tanks in the ground on the scale proposed is a major undertaking and
commitment. Oil spills and contaminations may happen. The costs of clean-up would be substantial
both monetarily and environmentally.
I am also very concerned about the quality of life issues that will come if this project is allowed to
proceed. There will be traffic pattern disruptions which will lead to increased accidents. This is already
a high traffic accident intersection. Both air and light pollution will increase,as will litter,in an
established residential community.In addition,we do not need another convenience store.
I have read stories in Newsday that this gas station chain has twice settled charges by the Department of
Labor relating to working conditions and wages. Why would we want to welcome someone to Southold
who is not concerned about,or fair to,it workers? What else maybe hidden from us at this point?
Please do not approve this project. It is not in the best interest of the Southold community and it will
not benefit our town.

A review of the Traffic Impact Study submitted as part of the DEIS for Southold Gas
Station&Convenience Store(1000-55-5-2.2)reveals that key traffic count data may be
unreliable for analysis.
In comparing the traffic count volumes reflected in the TIS with the turning moving
counts in Appendix A,there seems to be significant discrepancies:
Sat Peak: The Sat Peak data reflected in Fig.4(p.6)corresponds with the Mid-Day
Peak data in Appendix A.The Sat Peak data in Appendix A does not seem to
correspond to any data in Figures 2-4.
Mid-Day Peak: The Mid-Day Peak data used in Fig.2 (p.4)does not seem to
correspond to any of the data presented in Appendix A.
These discrepancies call into question the use of the data and the reliance on the data
throughout the TIS and casts doubt on the overall adequacy of the DEIS for public review.
I'm concerned that there is not sufficient time to properly analyze revised data prior to the
Public Hearing on August 14,2017.

Introduction
A traffic study was conducted by Elin Corwin, Carole Barron, Catherine Farley
and Anne Hawkins on September 4, 2017, Labor Day between 4:00 pm and 5:00
pm at the intersection of Rte 48 &Youngs Avenue in Southold, NY
This count was undertaken to establish the percentage of growth since our
original count on Labor Day, September 9, 2015.
We present raw data, counted in-person, on the date cited. No growth factors,
no seasonal factors etc. have been used. No extrapolations or reliance on data
from industry studies or analyses were utilized. This traffic study was conducted
by area residents who will bear the impact of any traffic increase.
Youngs Avenue is the main north-south route from Rte.48 to the Main Road in
Southold. This is due to the two traffic signals: one at the intersection of Route 48
and Youngs Avenue and the other at Young's Avenue and the Main Road. Many
large vehicles choose this cut over because of the southbound access lane at
Rte.48 and Youngs Avenue. These large vehicles include car carriers bound for
Mullins, tractor-trailers bound for the IGA, landscaping trucks with trailers and
limousines which can no longer make U-turns on Rte. 48.
Founders Village is located on Youngs Avenue, approximately 850 ' south of the
proposed "build" site. (photo p.7)
On September 4, 2017, Labor Day, a total of 1,428 vehicles & pedestrians were
counted between 4:00 PM and 5:00 PM. This included vehicles westbound
and eastbound on Rte 48 and northbound and southbound on Youngs Avenue. It
included cars, pick-up trucks, vans, buses and motorcycles. The vehicles
included ferry traffic for the holiday.
The above count (1,428)for Labor Day, 2017 shows an increase of 18% in total
vehicles and pedestrians over the totals for the same day and time in 2015 (see
comparison chart on p.2). The 2017 total of 1,428 is an increase of 28% Over
the 1,118 weekday pm count (highest) set forth in the DEIS TIS (which included
growth and seasonal factors).
Clearly, traffic has increased significantly in the last two years.

Concerns
Young's Avenue is a heavily trafficked road in the daytime. There is no sidewalk
north of Founders Village on the west side of Youngs Avenue and no sidewalk at
all on the east side of Youngs Avenue. There are no shoulders on the road.
Currently, it is not safe to walk or bicycle here. If the addition of a convenience
store at the intersection of Rte 48 &Youngs Avenue increases the volume of
area residents who rely on walking or bicycles for transportation, it may
significantly increase concern for public safety.
Traffic counts in this study for Youngs Avenue were 157 on Labor Day, 9/4/2017
(142 on Labor Day, 9/7/2015 and 207 on Wednesday, 9/9/2015). Vehicles
attempting to exit onto Youngs from the proposed gas station, to proceed either
SB, NB or even WB, would present dangerous conditions on Youngs at the exit
area.
There are 92 units at Founders Village with approximately 100 vehicles plus
those of guests, contractors and service providers entering and exiting Founders
Village daily, throughout the day and evening. On a daily basis non-Founders
Village vehicles use the Founders Village entrance/exit to turn around (photo
p. 9). Founders Village is happy to be a good neighbor and allow this
accommodation for the public but Founders Village will not be able to safely
tolerate an increase in "turnarounds" created by" gas station"traffic exiting onto
Young's Avenue in an attempt to proceed eastbound on Rte. 48 or northbound
on Youngs (photo p.9 & p. 10.)

Actual traffic counts were not taken, Importantly,they were not taken
during one of the region's most popular seasons-September and
October.Although"seasonal adjustment" factors were utilized,actual
traffic counts remain the best available data to assess the existing
conditions and such counts should be required for any commercial
project of this size and usage.
There was no discussion of safety regarding left-hand turns exiting the
gas station to return County Road 48 via Youngs Avenue. Given the
property's location on a busy corner,the FEIS should explore the
potential accident risk associated with the potential conflict between
southbound traffic on Youngs Avenue(off of Route 48) and traffic
existing the gas station attempting to return to Route 48.
Alternative"Reduction in Pump Island and Canopies"
The Alternative,"Reduction in Pump Island and Canopies" (p.70) does not
provide an appropriate level of detail and analysis in order to assess its ability
to mitigate the potential visual impacts associated with the proposal. The
DEIS discounts this alternative merely stating that it's not feasible due to
potential marketing and business ramifications. It's also important to point
out that the"need"for a gas station and of the size proposed was not
sufficiently justified by a market analysis,therefore,it would be impossible to
argue that a reduced alternative would negatively impact the business aspect
of the proposal.

I write to you with respect to the application for approval of a site plan for a new gas
station and convenience store at 4540 County Road 48. I live on Kenney's Road,in the
immediate neighborhood of that proposed project.
I strongly urge the Board to reject the application. Among the many objections to this
" plan,I would like to focus on several of the goals set forth in the Town Comprehensive PIan.
The proposed gas station conflicts with all of them.
First,the proposed project runs contrary to the Comprehensive Plan goals with respect to
Economic development. As you are no doubt aware,that section of the plan focuses(rightly)on
developing sustainable businesses that,among other things,meet the needs of recent college
graduates,young professionals,and the like(Goal 1.9),focus on expanding businesses in
existing hamlets(Goal 2-2a),and aspire to certain site design standards(Goal 2-6). This bog-
standard gas station meets none of those criteria. Not a single young person, entrepreneur,artist,
farmer,or frankly anyone else will be more likely to stay and contribute to the community as a
result of this project,nor will the town business center be made more vibrant or sustainable
because of it.
Second,the Comprehensive Plan sets the following'goals with respect to"Community
Character":
® Goal 1.4,Enhance scenic qualities through design standards and recognition of
innovate site planning and architecture in public and private development
projects;
• Goal 3.5,Protect and improve the soils in the Town of Southold;
o Goal 3.6,Protect Town aquifers;
Goal 3.7,Protect and improve air quality in the Town of Southold.

The proposed business significantly expands the footprint o ( y
noticeable,and environmentally neutral)structure at the site. The project would take a small
building with a few RVs parked out front,and turn it into dead-end business with buried tanks,
lit canopies,pumps,no doubt bright colored lights,and an excessively large parking lot. What
possible need is'there for 29 parking spots? Why should half(or more)of that lot be paved?
Why impose further stress to the Town soil,air,and water quality? Why is Southold not looking
to the future and providing resources for electric vehicles?
Further, even though the proposed gas station is not directly at a scenic landscape and
waterscape,as set forth in the Comprehensive Plan,it sits among scenic farmland that is a core
reason why residents and tourists love Southold. People don't live,work,or visit Southold to see
a gas station(if they do,they can already see two up the street less than a mile away). They
come to see a small town with beautiful natural resources and family-owned businesses.
This is not about resisting common-sense,practical development in Southold. 1 believe
strongly that the Town must be smart and forward-thinking about development,to keep the
community moving forward,while preserving what makes it unique. Another gas station does
nothing to further those goals. In fact, it would set the town back. The Planning Board should
vote no.

Dear Planning Board Members:
I am writing in reference to the application for a gas station and convenience store to be
allowed at the corner of Youngs Ave, and Route 48 in Southold.
I am respectfully requesting that you deny this application for the following reasons:
• A traffic study done in November of any year does NOT fairly represent the traffic
situation on the North Fork for at least 6 months of each year. You as well as I know,
that if a traffic study is to be utilized in good faith to review this plan it should be one
done during the months of May through October and on a weekend as well as a weekday.
It is irresponsible utilize anything else.
• Youngs Ave. to Route 25 in Southold is the ONLY north/south connector with a traffic
light at both ends in the hamlets of Greenport, Southold and Peconic; making it an
obvious route for GPS followers, savvy local people (who know how hard it is to make
left hand turns in the summer), delivery trucks and the like. Adding tremendous volume
to the end of this road at Route 48 is inviting a potentially dangerous situation especially
with the design that allows exiting traffic onto Youngs Ave. BP Gas station is 2.6 miles
down the road and ALSO on the south side of the road. If there were any need for an
additional gas station, it would make much more sense for a gas station to be put on the
North side of the road. As it is,people traveling west on Route 48 who need gas must
make a u-turn on 48 to get to the BP. I can only imagine what the implications will be
for someone trying to get into this gas station that is traveling west on 48. Currently there
is no left turn lane at this spot to enter the proposed gas station. In fact there are left turn
only signals from Route 48 onto Youngs Ave. in both directions. flow is this intersection
going to be reconfigured to accommodate this and who is going to pay for it????
• What is the implication to our volunteer EMT's and firefighters? It is pretty obvious that
this proposal could generate more accidents at this already busy intersection. Will the
gas station guarantee financial support to our volunteers?

Gary and I have lived on Youngs Avenue for over 31 years.Our property borders the Tidy Car lot,the
proposed gas station site.
Unfortunately,we cannot attend the August 14th Planning Board meeting due to travel commitments.
We have asked my neighbor to read this letter on our behalf.
My neighbors and I are against the proposed gas station because we are very concerned that such an
establishment will bring a dramatic increase in traffic,noise,pollution and crime to Youngs Avenue,
destroying the character of our neighborhood,our peaceful enjoyment of our homes and also,the
quality of life for anyone using the road....
Youngs Avenue has seen a huge increase in traffic over the past 5 years,the street from Routes 48 to 25
Is a main access road to town(as anyone going to the IGA will attest)it is one of the most densely
populated roads in Southold,with well over 115 residents in less than a third of a mile,including over
100 residents at Founders Village.
Many well-known businesses and services including Agway,Burts Reliable,Capital One,the Train
Station,Taxi depot,the Town vehicle parking lot,and the Peconic Land Trust Agricultural Center at
Charnews farm,now a working farm and community garden are all operating on this same road.These
establishments all bring an increasing wave of traffic from their employees,customers and suppliers,in
the form of cars,trucks,including 18 wheelers,tractors,landscape vehicles,recreational vehicles and
even buses to our street.
Gas stations In addition to bringing traffic by their nature are magnets for armed robberies,drug traffic
and other types of illegal activity,as seen by the increasing numbers of reported crimes at these
locations on the East End and in island.They are also sites of pollution and environmental hazards,with
bright intrusive lighting,car and truck emissions,gas explosions,gas tank leaks and large vehicle crashes.
On a personal note,Gary and I were both born and raised in this town,it took us many years to save
enough money to buy our home and we are very worried about the impact of having a gas station as our
neighbor for all the reasons discussed in this letter.We want you to know that our home is our nest egg
and this gas station will negatively impact our property values,something we cannot afford as we

Yesterday morning I rode east from Hortons Lane, then west from Orient along Route 48
passing the intersection of Route 48 at Youngs Avenue both times. I was struck once again at
how inappropriate and unnecessary the proposal intended use for the present Tidy Car
property is.
As you know, I am a life-long resident of Southold. I've served my town in a variety of ways
as a volunteer since my retirement from the Southold school district after thirty years
teaching there. For the town alone I`ve served at various times on the Parks and Recreation,
the Historic Preservation and Tree committees. I still serve on the Tree Committee,
spearheaded the annual Arbor Day celebration involving all of the town's elementary school
youngsters as well as those at Head Start and the North Fork Learning Center. I've seen this
area change from something other than the pastoral area where my mom would take us by
pony cart up Hortons Lane to McCabes Beach.
1 know that some change has been inevitable and indeed necessary but fail to see ANY
VALUE to Southold town, particularly to the hamlet of Southold, in the proposal currently
being considered for the Tidy Car location.
NEED?
There are a number of gas stations throughout the town. One in Orient which provides
income for two or three families, two in the village of Greenport, one in Southold owned by the
group seeking to acquire the Tidy Car location (which by the way, eliminated full service
recently) and one in Peconic. A number more are situated in the Cutchogue and Mattituck
areas.
CONCERNS!
An additional targe commercial enterprise as proposed at that particular location makes what
is even now a dangerous intersection even more so. Picture a number of cars, let alone huge
trucks, entering and exiting from and to Route 48 as well as from and to Youngs Avenue. The
community of Founders Village is home to a primarily elderly group of folks. Imagine the
challenge to them in utilizing that intersection!
You are all Southolders, and 1 suspect you care for our town as much as I do. In the interest
of preserving some of what's left of our rural character as well as preventing the
establishment of a more dangerous intersection, I urge you to deny this application.

SCWA is unable to conduct a meaningful review of this project as the document does not contain
anticipated water usage,data essential to SCWA's review.
The application in its current form is incomplete. SCWA requests that anticipated potable water
usage data be provided in gallons per day and if applicable,separate water data in gallons per minute if
there will be an irrigation system.
Additionally, for clarification purposes,SCWA would like to point out that there is a SCWA
well field which has(3)three active wells located within 2,500 ft of the subject project. The section

I am writing regarding the proposed gas station at the comer of Young's Avenue and Route 48 in Southold. As
a lifetime northfork resident born in Greenport Hospital (that's what we used to call it),I have seen this area
change dramatically. Some change has been good while some not,but the essence of this area has remained
somewhat unchanged.
It is my opinion that this is a perfect location for such a facility. The existing traffic light provides safety and
the existing design for entering and exiting is logical.
Look around the town and compare older facilities and new. The Valero in Cutchogue,once Bobby Kull's shell
station,a well kept business,remains clean and maintained as opposed to the other main road station not to
mention Bootie Oats'old station that has been neglected. And the newly renovated station in Southold where
the owners are constantly working on the landscaping to improve the appearance of the yard while being the
only station servicing Southold.
The Young's Avenue site,a former gas and service station,is an ideal site for a gas station. This would not take
away from the appearance of our town nor would it create any traffic hazard as it is at the end of the street and
at a traffic light. If anything,this site would add relief to the building congestion at the Route 25 station.
Not only would this facility be a positive for Southold as it would provide choice and relieve congestion, it
would improve the appearance of our town. I believe it is in the best interest of the town as a whole to approve
this use. The immediate residential area is somewhat distant from the facility and Young's Avenue has
commercial properties at the south end already.
Consider what is best for the entire township and village. Approve this proposal.

The Planning Board staff has reviewed the resubmitted Draft Environmental Impact Statement
Southold Gas Station and Convenience Store (draft EIS) dated May 2017 and have the following
comments and questions:
1. Page 7.
Staff disagrees with the following assessment.
The site falls within the New York State Scenic Byways area of CR 48, and within the
boundaries of the New York State North Shore Heritage Area Management Plan.
Therefore the existing land use, zoning and structures associated within the Town Code
are considered compatible with the transportation corridor and are representative of the
region's scenic, recreational, cultural, natural, historic and archaeological significance.
2. Page 10.
The DEIS indicates that a subsurface investigation was conducted by Berninger
Environmental Inc. and three(3) soil borings were performed in the vicinity of a suspected
petroleum UST.
Why were only(3) soil borings sampled? What regulatory sampling protocol was used to
determine the number of adequate soil boring samples needed on site to adequately assess
potential contamination?

3. Page 11.
The DEIS indicated that the SCWA provided the location of public water supply wells within
2,500-ft. of the subject site. The nearest wells are located 2,033-ft. northeast of the site,north
of Old North Road.
Other SCWA wells are located at CR 48 west of the site and at a location east of Kennys
Road; each location is beyond the distance of 2,500 ft.
Please discuss and confirm with the SCWA that the past use of the site as a fuel station has
resulted in no impact to the water quality of the wellhead. Further, does the proposed proj ect
lie in the"zone of influence'of the wellheads?
4. Page 12.
The DEIS states that:
The existing noise levels measured at the subject site and at nearby locations are
expected to remain at the same level under the proposed project scenario.
Staff disagrees with the above statement.
On the same page it is stated that:
A temporary increase in noise may be experienced during certain periods of
construction activity which can be minimized by staging the hours of the work.
Is there a proposal for staged construction activities? Will construction be conducted on
Sundays and holidays?
5. Page 13.
Staff disagrees with the conclusion that the proposed 1920's theme design mitigates impacts
to aesthetics, community character and the Scenic Byway. See item regarding Section 6.4
below for more detail.
6. Page 20, Section 5.2.
The lengthy discussion on the BP existing gas station located on County Route 48 and access
challenges is irrelevant in the context of environmental impacts that the proposed
convenience store and fuel station could generate.
7. Page 32. Section 5.4.
The DEIS indicates that a groundwater monitoring well was installed and that the
groundwater general horizontal flow direction is southerly and southeasterly.

The report lacks an in depth discussion on groundwater quality findings. Why was the
discussion omitted? Was groundwater sampling conducted on properties to the south?
Note that the Town Comprehensive Plan and chapters have not been adopted by the Town
Board and is in draft form.
8. Page 42. Section 6.4.
Section 6.4 ignores the obvious regarding the difference between one canopy and two. It is
clear that removing the front canopy mitigates the visual impacts and impacts to aesthetics,
scenic resources and community character on this scenic byway. It seems a stretch to state
that adding two gas station canopies will improve the situation at this site.
9. Pages 45-48. Section 7.2.
Where can the Berninger Environmental,Inc.report be found in the DEIS?
On Page 48 of the DEIS it states that:
Two (2)groundwater samples were collected from each soil boring located where
a suspected UST was formerly thought to have been located(based on
interviews).
Laboratory results found that to minor detections of less than 1.5 parts per billion
were recorded. Two (2)groundwater samples were collected from each soil
boring located where a suspected UST was formerly thought to have been located
(based on interviews). Lab results from the groundwater samples were compared
to the NYS Standards outlined in the TOGS document described above. Two
minor detections of less than 1.5 parts per billion were recorded.
What compounds were tested for under the USEPA 8260 and 8270 BN methods
referenced on page 48? What compounds were detected? Could you confirm that the
site was fully investigated to determine the nature and extent of potential contamination
pursuant to NYSDEC sampling protocols?
Due to the historic use of the property as a gasoline station and"minor detections"why
weren't additional soil borings taken over a larger area of the.site rather than the
minimum of three? A concern is that Unleaded Gasoline was on site, stored
underground and dispensed,and vehicles were repaired on site.
Was the site samples analyzed for benzene,toluene,ethylbenzene, and total xylenes
(BTEX),methyltertiary butyl ether(MTBE),and total petroleum hydrocarbons(TPH)?
The NYSDEC Site Investigation Protocols provided as Appendix 4 in the DEIS includes
a section on testing protocols for older gasoline product that states.

It is hard to distinguish between weathered gasoline product and fuel oil.
TIf you have a possible old leaded gasoline spill,you can ask the laboratory
to analyze the sample for lead, but since lead doesn't travel very far in
soils, the laboratory may not find it in a sample taken at some distance
from the source of the spill. In addition, unless the laboratory can analyze
for organic lead, a total lead analysis will also measure natural organic
and inorganic lead levels and not just lead levels due to the spill alone
(i.e., it is possible to obtain a false reading, especially for soils high in
inorganic lead). Reliable measures of organic lead contamination can only
be obtained where background total lead concentrations are known or can
be analyzed.
For these reasons, therefore, we recommend that a TPH analysis also be
conducted to checkfor other less mobile petroleum constituents. For an
unknown believed to be, or to contain some kind of,petroleum product,for
older spills, or for known spills of diesel and fuel oils, the laboratory
should be asked to analyze the sample first for TPH using a gas
chromatograph (GC). This analysis detects straight-chain hydrocarbons
and aromatic constituents, and the results are reported as the sum of all
hydrocarbons in the sample, rather than as individual chemicals. The GC
analysis should then be compared against the patterns for different
petroleum product standards to determine if the pattern resembles,for example,
gasoline-type product or a fuel oil. If the tentative indication is
that the product is gasoline, the sample should be analyzed for BTEX.
Was this testing protocol followed if not,will it be followed if a suspected spill has been
discovered?
Was testing of the soil samples and groundwater conducted by a private or "out-of-
house" laboratory approved by NYSDOH to perform the specific analyses required?
10. Page 49 and 50. Section 7.3.
The vacuum cleaner sound was recorded as 87 dBA higher than the maximum
threshold of 85 dBA for an eight hour time period. What threshold is referenced here?
The statement that"there will be no noise above that which currently occurs from
existing traffic"is not accurate when the vacuum cleaner standard was found to exceed
traffic noise levels at the BP gas station. Is there a vacuum cleaner model designed to
reduce noise levels? The peak noise level is 94.75 dBA as indicated in Appendix 11.
What generated this noise level?
Are the pumps proposed to have electronic screen advertisements that generate noise?

The DEIS indicates that the sign will include illuminated fuel placards for regular gas,
plus. Super,diesel and E-85. The 36 square foot area,wall mounted convenience store
sign will be internally lit, and be located at a maximum height above finished grade of 15
feet. The illuminated and internally lite proposed sign design does not appear to meet
Town Code regulations Article XIX. Signs §280-87.
Provide analysis that the proposed signs meet Town Code. Does the sign design coincide
with the visual renderings in Appendices 26,27 and 28?
12. Page 60. Pedestrian and Bike Traffic
The DEIS links customer and pedestrian volume with potential impacts and discounts the
concern of public safety based on lack of significant numbers. Pedestrian safety is
attributed to well-designed pedestrian facilities such as sidewalks, signalized crosswalks
and sufficient signage and cues.
The claim that without an existing system ofpublic sidewalks, it is unlikely there are any
significant impacts to pedestrian traffic is unsupported. Conversely,without adequate
sidewalks connecting Youngs Avenue to the site for safe pedestrian access to the site,
public safety is at risk regardless of the number of pedestrians accessing the site.
13. Page 61.
The DEIS states:
The proposed action has no significant impact on the pedestrian access to the site,
pedestrian crossings at Youngs Avenue or pedestrian access to north and south crossing
over CR 48
The TIS concluded there is no significant change in vehicular traffic between the build
and no-build alternatives. The conclusion as applied to pedestrian and bicycle public
safety indicates that pedestrians and bicyclists will be at no higher safety risk than under
the build and no-build scenarios. Mitigating measures would not be required under the
build alternative.
Staff disagrees with the above statement. The proposal to locate a more intense use
(including a Convenience Store)on the site that is expected to be frequently accessed by
pedestrians over an incomplete sidewalk system down Young's Avenue will result in a
higher safety risk to pedestrians walking within the roadway. This use coupled with the
surrounding business zoned parcels within V4 mile of the parcel will generate pedestrian
traffic.There is a development only 2/10 of a mile down the road with 96 dwelling units
in it. The fitness center on the opposite corner could also generate pedestrians as
customers there may walk over to purchase items. In addition there is a 5-acre Business-
zoned parcel at the northeast corner and a 30-acre residential parcel about 1/10 of a mile
away that are undeveloped and both are potential future pedestrian generators.

The Convenience Store use, once created would become a destination for pedestrians
within the area, including patrons from the fitness center at the northwest comer of the.
intersection,and the development of adequate, safe pedestrian infrastructure is warranted.

14 Murphy. A resident of (Inaudible)
15 Lane. This is my first Planning
16 Board meeting. So I am not familiar
17 with procedures but wanted to ask a
18 few questions and ask a few questions
19 or two; is that appropriate, Jim?

21 certainly make a statement and we
22 will answer questions, if we can.
23 MS. MURPHY: Well, if nothing
24 else, you can think about them.

5 accepted the fact that the area that
6 I grew up in and care deeply about
7 will be losing more of its small town
8 rural flavor and appeal, with the
9 approval of a project of this
10 magnitude. It's very discouraging
11 for me. I wondered about the need
12 for this project. I wondered what
13 the benefit is for the Hamlet of
14 Southold. I can't imagine folks
15 coming off the ferry and not filling
16 up before getting on the ferry since
17 I don't know what services will be
18 available on the Long Island side.
19 They also have wonderful snack bars
20 on the ferry, most of them anyway.
21 Has consideration been given to the
22 additional dangers at this
23 intersection that will be created by
24 this huge proposed project? Quite
25 frankly, I shudder just thinking

1 about it. Honestly speaking, the
2 only gain that I can see will be a
3 financial one to the group making
4 this proposal. Am I wrong about
5 that? Thank you.

8 MS. CORWIN: Ellen Corwin,
9 Founders Village. I apologize for
10 being a little nervous up here. This
11 is not exactly where I wanted to be.
12 But I don't want to pass this corner
13 every afternoon and know that I did
14 whatever I could to stop this. Even
15 if it is a little difficult. I would
16 like to start with a few general
17 comments before I talk about the
18 traffic studies. The prior use
19 argument that is referred to in this
20 application, seems week. The prior
21 use was 60 years ago. One or two
22 pump gas station combined with a
23 garden center. I wasn't there then
24 but it seems like a fairly passive
25 operation. This is a lot of gas

1 station. A large gas station and
2 convenience store and it changes
3 Southold forever. I would like to
4 start with the traffic studies. Our
5 own, the one that Founders Village
6 prepared and the one included in the
7 DEIS. I am hoping others here
8 tonight will get up and speak to
9 community character and scenic
10 impact. A traffic study was
11 conducted by Founders Village on
12 September 7, 2015 which was Labor Day
13 between 4:00 P.M. and 5:00 P.M. at
14 the intersection of 4B and Youngs
15 Avenue. A second count was taken on
16 Wednesday, September 9th between
17 7:30 and 8:30 A.M. at the entrance to
18 Founders Village on Youngs Avenue.
19 Unfortunately, I did not see any
20 comparable area time included in the
21 DEIS traffic. Our traffic study was
22 submitted to the Planning Board on
23 August 7th and is part of this file.
24 We presented raw data counted in
25 person on the dates cited. No growth

1 factors, no seasonal adjustments. No
2 extrapolations. No reliance on data
3 from industry studies or analyses
4 were utilized_ This traffic study
5 was conducted by area residents who
6 will bear the impact of any traffic
7 increase_ Youngs Avenue is a main
8 north/south route from 48 to the Main
9 Road in Southold. This is due to the
10 traffic signals. One at the
11 intersection of 48 and Youngs and the
12 other at Youngs and Main Road. Many
13 large vehicles chose this cut-over
14 because of the southbound access lane
15 on 48 and Youngs Avenue. These large
16 vehicles include car carriers bound
17 from Mullens. Tractor trailers bound
18 for the IGA. Landscaping trucks with
19 trailers, limousines which can no
20 longer make U-turns on 48. It also
21 seems to be a preferred route for the
22 Southold Police and Fire Departments.
23 Founders Village is located on Youngs
24 Avenue approximately 850 feet south
25 of the proposed build site. On Labor
August 14, 2017 14
1 Day, a total of 1,214 vehicles were
2 counted between 4:00 P.M. and
3 5:00 P.M. This included vehicles
4 westbound and eastbound 48 and
5 northbound and southbound on Youngs
6 Avenue. It included cars, pick-up
7 trucks, vans, buses and motorcycles.
8 And obviously with the time included
9 ferry traffic for the holiday. On
10 September 9th, a total of 207
11 vehicles, bicycles and pedestrians
12 were counted between 7:30 A.M. and
13 8:30 A.M. on Youngs Avenue at
14 Founders Village entrance. This
15 included northbound and southbound
16 vehicles, cars, pick-up trucks, vans,
17 buses, bicycles and pedestrians on
18 Youngs Avenue. This count further
19 substantiates the existing traffic
20 count on Youngs Avenue cited on the
21 Labor Day count. We have three main
22 concerns here. Youngs Avenue is a
23 heavily traffic road in the day time.
24 There is no side walk north of
25 Founders Village on the north side of

1 Youngs Avenue. And no side walk at
2 east side of Youngs Avenue. There is
3 no shoulders on the road. Currently
4 it's not safe to walk or bicycle
5 here. The addition of a convenience
6 store at the intersection of 48 and
7 Youngs Avenue will increase the
8 volume of area residents who rely on
9 walking or bicycles for
10 transportation. This may
11 significantly increase concern for
12 public safety. The traffic counts in
13 this study for Youngs Avenue were 142
14 on Labor Day. 207 on the weekday
15 morning of 9/9. Vehicles exiting
16 onto Youngs Avenue from the proposed
17 gas station to proceed either
18 Southbound, Northbound or even
19 westbound and east bound because they
20 couldn't even safely exit onto 48
21 would present dangerous conditions on
22 Youngs Avenue at the exit area. Our
23 third concern is about the impact at
24 the entrance of Founders, Village.
25 There are 92 units at Founders

1 Village, with approximately 100
2 vehicles plus those of guests,
3 contractors and service providers
4 entering and existing Founders
5 Village daily throughout the day and
6 evening. on a daily basis,
7 non-Founders Village vehicles use the
8 Founders Village exit to turn around.
9 We're happy to be a good neighbor and
10 allow this accomodation to our
11 neighbors but we will not be able to
12 safely tolerate an increase in
13 turnarounds creating by the gas
14 station traffic exiting onto Youngs
15 Avenue in an attempt to change
16 directions to proceed northbound on
17 Youngs. To either go east or west on
18 48. The traffic study in the DEIS
19 presented data for three time
20 periods. Midday and P.M. on a
21 weekday and early afternoon on a
22 Saturday. All were conducted in
23 November, 2015 and used an industry
24 growth factor and industry seasonal
25 adjustment factor. Somewhat

1 difficult to compare to our data
2 which we used actual holiday volumes
3 on Labor Day and earlier A.M.
4 traffic on a weekday on Youngs
5 Avenue. To keep it simple and
6 hopefully stay out of the weeds here
7 and, use the following comparison. On
8 Labor Day we counted a total of 1,214
9 vehicles on 48 and on Youngs Avenue.
10 This is without any growth factor.
11 Using the DEIS highest count, which
12 was the weekday P.M. count, which
13 included the growth and seasonal
14 factors, the total count was 1,118
15 cars -- vehicles. That is almost
16 100 vehicles less. Also from the
17 DEIS study, they estimated based on
18 industry data the total trips in and
19 out of the gas station. And their
20 estimates were, range from 100 to
21 150 vehicles in and out just during
22 peek hours. They also state a
23 pass-by rate of 630. Again, using
24 industry data. I believe this means
25 those vehicles, 63% of the vehicles

1 going into the gas station and coming
2 out were already on the road and
3 decided to stop for gas. So no
4 increase. However, where is the logic
5 of the conclusion throughout the
6 study of no significant impact_ 630
7 were already on the road. 37, aren't
8 they an increase? I would like to
9 quote a few of the traffic studies
10 that they draw. "The analysis of both
11 crucial intersections show that the
12 traffic generated by the proposed
13 development is a minor impact on the
14 intersection of 48 and Youngs Avenue.
15 Accident data indicates the
16 intersection of 48 and Youngs Avenue
17 is not considered a high accident
18 location. There is no significant
19 change in vehicular change in the
20 build or the build alternative. The
21 proposed action has no significant
22 impact on the pedestrian access to
23 the site. Given the usage and
24 location, the site is not likely to
25 generate significant pedestrian

1 traffic." I think this is absolutely
2 not true. This will attract increase
3 foot, bicycle and vehicle traffic
4 from the surrounding area. The study
5 further states that existing traffic
6 signal provides control mechanism for
7 pedestrians to cross north and south
8 of Youngs Avenue over County Road 48.
9 According to the traffic engineer
10 study, the adjacent intersection has
11 pedestrian push buttons to activate
12 an east-west crossing phase with
13 7 second walk phase. Followed by a
14 20 second interval. I hope that
15 means a total of 27 seconds. These
16 are located on the northwest and
17 southeast corners. It also states
18 that there no pedestrian signals and
19 pedestrian must take their cue from
20 the traffic signal. I invite the
21 Board members to stop by this
22 intersection and push the button to
23 cross from the southeast corner on
24 48 at Youngs to the northeast corner
25 on 48. I have been there. I don't

1 know where in the sequence you can
2 possibly decide it was safe to step
3 off the grass. I can't imagine what
4 it like today. I can't imagine what
5 it's going to be like with cars
6 coming in and out of the gas station
7 coming onto 48 and Youngs Avenue. If
8 you are on foot or on a bicycle and
9 probably not even a car. I have a
10 few closing comments. I would like
11 to let the other people here speak.
12 I would like to come back to the
13 podium and discs the underground
14 storage tanks if nobody else here is
15 prepared to do that. I would ask the
16 Planning Board to please review and
17 consider the current letters in the
18 file. And the letters in the file
19 two years ago and the petition signed
20 by almost 300 residents. Just
21 because an area is zoned for business
22 and a business wants to be there,
23 doesn't mean it has to be. There
24 could be nothing automatic just
25 because the code is met. This

1 application requires ZBA variances
2 but there is no variance for changing
3 the character of Southold. If you
4 allow a 12 pump gas station and a
5 19-hour convenience store, you have
6 changed our landscape forever. 1

13 MR. BASIL: My name is Michael
14 Basil from Southold and I live on the
15 north side of Sound Avenue. Also I
16 am an employee of the current east
17 end campers and I am standing on that
18 spot for about 14 years now, 7 days a
19 week. One of the things that I think
20 about the traffic study is, that I
21 think it all changed the current
22 traffic, because I live on the north
23 side of Sound Avenue. For me to get
24 fuel in the morning, I have to travel
25 down Youngs Avenue to get to the only

1 current gas station that we have in
2 Town. So I think by having a second
3 fuel station here, it will alleviate
4 all that traffic that is going from
5 the north side of Town to the south
6 side of Town daily and that means a
7 lot of the trucks and landscapers and
8 like. I have also had the
9 opportunity to meet the gentleman
10 that is going to be putting in the
11 gas station. And I will say that
12 based on the fact that he owns the
13 only other gas station in Town, and
14 he works 7 days a week, I think that
15 this gentleman is only going to
16 improve the Town. Because he has
17 already done so at his current
18 station. Lots of flowers. He has
19 not changed the building size. And I
20 think that is what he is proposing
21 here. Not to change the building
22 size or the lot size. Really change
23 the area dramatically. So I am here
24 just to say that on a positive note
25 that I think once this fuel station

1 is in, you are going to see a lot
2 less traffic going from the north
3 side to the south side searching out
4 gas, because again, being on that
5 property for 14 years, 7 days a week,
6 I do get tons of people coming off
7 the ferry who didn't realize that we
9 don't have a lot of fuel from the
9 ferry. And that existing right now,
10 looks like a fuel station. They pull
11 in and ask where can I get gas. 1
12 point that they have to travel to the
13 south side of town. That is the
14 nearest one. So they are causing a
15 lot of traffic. But now they will
16 come into that station and continue
17 onto their route. And again, a lot
18 of people follow their Google maps.
19 And when they get off the ferry, the
20 Google maps don't show them and they
21 gave to go over to 25. So here they
22 will come into the station and
23 continue on their way to the other
24 counties.

4 Talerico_ I live at 2895 Youngs
5 Avenue. Nice to meet you, Mike. On
6 Youngs Avenue we call it, "untidy
7 car, " but that is an inside joke. I
8 am going to do two things. Gary and
9 Joan Remke who live next door to the
10 proposed site are unfortunately
11 unable to attend tonight. So they
12 have asked me to read a letter to the
13 Board on their behalf. "Gary and I -
14 have lived on Youngs Avenue for over
15 31 years. Our property borders the
16 Tidy Car lot. The proposed gas
17 station site. My neighbors and I are
18 against the proposed gas station
19 because we are very concerned that
20 such an establishment will bring a
21 dramatic increase in traffic, noise,
22 pollution and more importantly crime
23 to Youngs Avenue. It will destroy the
24 character of our neighborhood and the
25 peaceful enjoyment of our homes_ And

1 the quality of life for everyone
2 living on the road. Youngs Avenue has
3 seen a huge increase in traffic over
4 the past five years. The streets for
5 Route 48 to 25, is main access to
6 Town, as anyone going to the IGA can
7 attest. And is one of the most
8 densely populated roads in Southold.
9 With well over 115 residents in less
10 than a third of the mile, including
11 the residents at Founders Village.
12 Many well known businesses and
13 services including Agway, Burt's
14 Reliable, Capital One, the train
15 station, the Taxi Depot, the Town
16 vehicle parking lot, the Planning
17 Board and the Peconic Land Trust at
18 Charnuse Farm are all on the same
19 road. These establishments all bring
20 an increasing wave of traffic. From
21 their employees, customers and
22 suppliers in the forms of cars,
23 trucks, including 18-wheelers,
24 tractors, landscaped vehicles,
25 recreational vehicles and even the

1 Hampton Jitney bus to our streets.
2 Gas stations in addition to bringing
3 traffic by nature, are magnets for
4 armed robberies, drug traffic and
5 other types of illegal activity. As
6 seen by the increasing numbers of
7 reported crimes at these locations on
8 the east-end and in island. There
9 are also sites of pollution and
10 environmental hazards with bright
11 intrusive lighting, car and truck
12 emissions, gas explosions, gas tank
13 leaks and large vehicle crashes. On
14 a personal note, gary and I were both
15 born and raise in this Town. It took
16 us many years to save enough money to
17 buy our home. And we're very worried
18 about the impact of having a gas
19 station as our neighbor for the
20 reasons discussed in this letter. We
21 want you to know that our home is our
22 nest egg, and this gas station, if it
23 goes through would negatively impact
24 our property value. Something we
25 cannot afford as we approach

4 For myself, two years ago we
5 gathered over 260 signatures on a
6 petition to protest the plan to build
7 this gas station. A number of our
8 neighbors are here and we have sent
9 letters again to the Board. Our
10 position has not changed. We ask you
11 to really take into consideration the
12 concerns of people in the neighborhood
13 and not allow this petition to go
14 through. Thank you very much.

16 MS. MARA: Hi my name is Cheryl
17 Mara. I live at 3225 Youngs Avenue
18 and I have been there since 1989.
19 Some of you know me. I grew up here.
20 And I sent a letter during the time
21 period for my husband and myself.
22 Here is the big concern here, Youngs
23 Avenue going from north to south to
24 the Village is a unique street. It's
25 a heavily trafficked street. It has

1 always been a heavily trafficked
2 street. That is why we had fenced in
3 our backyard for our kids and our
4 dogs as they were growing up. We
5 always knew that. The traffic study
6 -- actually both traffic studies,
7 Founders Village and the one in the
8 DEIS, that was done in 2015, don't
9 even begin to address what has
10 happened in this area in the last
11 year, year and a half. I mean,
12 everybody you talk to and live here
13 year round are always talking about
14 the traffic in general all over the
15 Village and the Town. So that in
16 itself, we have been discovered, I
17 believe. And that time period, the
18 tourism time period has extended
19 itself from May to October because --
20 just because of the agriculture and
21 the things that go on here. I am
22 very, very, very concerned that
23 somebody is -- more than one somebody
24 is going to be seriously hurt at this
25 intersection. If you look at the

1 site plan, the entrance on Youngs
2 Avenue alone, on that -- people use
3 it as a merge. It's not an exact
4 turn to come down Youngs Avenue.
5 That to me in itself is very scary.
6 What I found very interesting about
7 the site plan and which I have a very
8 big problem with, is that if this is
9 a business and someone has a business
10 in this town and wants to be a good
11 neighbor, then why are there eight
12 pumps at the back of the building and
13 only four facing the north road? I
14 mean, that property line of theres,
15 shares Joan and Gary Remke's property
16 line. And the site itself, that site
17 plan, could have been done a little
18 differently as far as I am concerned.
19 And I do not believe and in all do
20 respect to Mike, I do not believe
21 that traffic will be reduced if
22 people can get their gas at the end
23 of our street. I really don't
24 because it is the street to get to
25 the only light on Route 25 in the

1 Village of Southold. And that's it

6 Hawkins. I am a resident of Founders
7 Village. I live in the first
8 building that is on the exit side of
9 Founders Village. And I sit in my
10 kitchen and I watch in time, using
11 Founders Village as a turnaround
12 because they made a mistake. We had
13 to paint arrows on the pavement --
14 this is not your problem, but go in
15 and out of the exit entrance. And
16 the thing is, the increase problems
17 of the exit and entrance of the gas
18 station, I see it as a major hazard.
19 People going westbound are going to
20 have to turn onto Youngs Avenue and
21 then turn into the gas station_ And
22 then the people going out, if they go
23 right and find they wanted to go
24 left, they're going to be turning
25 around in Founders Village. That is

1 one of my many concerns. But I
2 really thank Ellen for her diligent
3 efforts and there was another person
4 involved that did do this traffic
5 study. They determined that there is
5 a tremendous amount of traffic there
7 already. And we are very concerned
8 amount the safety of our residents.
9 And the safety of Southold Village
10 residents in general in that area.
11 The entrance and the exits strike me
12 as very dangerous. Thank you.
13 MS. CORWIN: I just wanted to
14 spend a few minutes on the
15 underground storage tanks. Mike, I
16 have high respect for your onsite
17 observations but I haven't been out
18 here forever but I haven't run into
19 anyone ever that said, "Gee, I wish
20 we had another gas station here." In
21 the executive summary, of the DEIS,
22 under mitigating measures, it states
23 that in May of 2015, a subsurface
24 investigation was performed. Soil
25 samples were taken within the

1 vicinity of suspected underground
2 storage tanks. The location of
3 which were based on "interviews.of
4 where the tanks were." This resulted
5 in readings indicative of no action.
6 So I think we're saying here that
7 they poked around a bit where they
B thought they might be based on
9 interviews and came up with nothing.
10 So they are saying that if something
11 turns up during the build, they will
12 make the right phone call they're
13 supposed to. The summary, also
14 deals with the septic, drain and
15 pools behind the building. The
16 storm drain detected semi-volatile
17 organic compounds. Whatever that
18 might be. Levels that exceed
19 Suffolk County Department of Health
20 action levels. It notes the
21 applicant will clean out the storm
22 drains recommended and have them
23 retested_ Page 11 of the summary as
24 the site investigation conclusions
25 that some have results of soil and

1 groundwater analysis which did not
2 indicate conditions of environmental
3 concerns and recommended no cleanup
4 action, with exception of cleaning
5 the leaching pool. Goes on to say
6 that based on the Berringer Report,
7 the suggestion that a spill has
8 occurred requires remediation is
9 unsubstantiated. What spill are we
10 talking about here? Continuing on
11 Page 11, "conformalance to the
12 standards will mitigate potential for
13 groundwater contamination generated
14 at the site. The existing private
15 well will be disconnected and closed
16 in accordance with New York State DEC
17 and Southold Department -- Suffolk
18 County Department of Health
19 requirements, thus eliminating the
20 pathway to groundwater and a
21 connection to the Suffolk County
22 Water Authority. Further discusses
23 the Suffolk County Water Authority
24 public wells near the site." What
25 about private wells? Founders

1 Village has six private wells within
2 a 1, 000 feet of this site. Although
3 they are currently used for
4 irrigation, pollution will affect our
5 entire complex. Are there no other
6 private wells on Youngs Avenue
7 within 500 feet of this site? I
8 would be surprised if there weren't.

16 Southold. I just want to say that I
17 am kind of familiar with the DEIS
18 site plan. I think it's appropriate
19 use of that property. And I have
20 also been told that the owners do
21 intend to provide at least one
22 full-service gas station pump, which
23 I think we need in this area. I
24 have a mom. I don't think she will
25 pump her own gas. So I think this

1 will support our community well. So
2 I support this project.

11 MS. MARCU: My name is Pat Marcu.
12 I am recently moved to Founders
13 Village. And know very little about
14 the background of this only of what I
15 picked up at this meeting. One of
16 the appeals of Southold Hamlet and in
17 totality east-end, the North Fork has
18 been the rural character. And the
19 fact that at night, it's dark. And
20 you can see the stars. Some times of
21 the years, you can see the Milky Way.
22 It was mentioned, something about the
23 light pollution. You're talking
24 about an activity that is going to go
25 19 hours out of 24, 7 days a week.

1 You can't tell me that there are
2 going to be tall bright lights. And
3 it has been touched on by some of the
4 other folks here, about changing the
5 character of the hamlet_ Just think
6 about the amount of light. I mean,
7 the increase in traffic. The hazards
8 at the intersection, they're a given.
9 But you're going to have significant
10 light pollution. Also, I am unaware
11 of any background for the use of the
12 land prior where there would have
13 been storage tanks. I think that
14 could potentially be a really
15 significant thing. Things I have
16 read over the decades about the
17 North Fork is that there was concern
18 about pollution from things like
19 temic (phonetic) and other pesticides
20 of sorts. You have oil tanks. I
21 presume they are oil or gas tanks.
22 You don't know what could be under
23 them. I think it would be very
24 prudent to find out if in fact there
25 are tanks and that there might be a

1 plume somewhere. Just saying.
2 VICE-CHAIRMAN RICH: Thank you

4 comment that at one point there was a
5 gas station there years ago. I don't
6 know what the condition of the tanks
7 were or if they have been removed.
8 But new tanks will have to be
9 double-walled, if this is approved.

13 MS. MARCU: For over 40 years my
14 husband and I owned an insurance
15 agency. And we had significant
16 numbers for auto body and gas
17 stations. And one of the ongoing and
18 I am taking 15-20 years down the road
19 after discovery of gas leaks, they
20 were still remediating through the
21 State of New York. So I can't speak
22 to it but I can tell you my
23 experience was, these things don't go
24 away easily.
25 VICE-CHAIRMAN RICH: I didn't say

1 that it was. I just stated there was
2 a gas station years ago. And if this
3 is approved, Suffolk County Health
4 Department, they're very stringent.
5 It's not to say that this is going to
6 be approved or not approved.
