Goehringer, ~"Jzo5 NG BO~D OF ~P~ ) be denied and GPG: lk Chairman By this appeal, appellants seek permission to locate a divi- sion line in their proposed subdivision, presently pending before the Planning Board, as shown on survey made by Young & Young,L.S. dated November 4, 1981 for Reliable Associates leaving a sideyard setback of 3.4 feet on.the proposed corner parcel and .3' setback for the small accessory shed and 2' setback on the most northeast- erly proposed parcel. The total area of the land in question is 44.187 acres and applicant proposes to comply with all other rules and regulations in this subdivision. The new lot line proposed in this application is shown to cut through a building situated between proposed Lots 1 and 2 north of the large framed barn, and it is the feeling of this board that the structure should be either destroyed, removed entirely from the premises, or relocated as permitted by the building and zoning codes. The board also feels that the relief requested is reasona'ble and most feasible under the circumstances. In considering this appeal, the board determines that the variance request is not substantial in relation to the code requirements; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obvi- ated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available govern- mental facilities of any increased population; that the relief requested will be in harmony with and promote the general pur- poses of zoning; and that the interests of justice will be served by allowing the variance. On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to approve the application of William J. Clark, Esq. for Joseph Yaboni and Myron Hauptman in Appeal No. 2926, SUBJECT TO THE FOLLOWING CONDITIONS: 7 (1) That the building presently existing through which the subject division line is made: (a) be destroyed, (b) be removed and relocated onto either parcel in compliance with zoning; or (c) be removed entirely from the property; (2) That this matter be referred to the Suffolk County Planning Commission pursuant to Sections 1323, et seq. of the Suffolk County Charter. SAWICKI TO: FROM: DATE: SUBJECT: Southold Town Planning Board Southold Town Board of Appeals November 18, 1981 Proposed Division or Set-Off of Parcels Gentlemen: Referred to you herewith for your consideration and determination pursuant to Section 106-13, et seq. of the Code and the established procedures is the following: Joseph Yaboni and Myron Hauptman (by William J. Clark, Esq.) Appeal No. 2926. Applicants wish to divide premises into three parcels as follows: Lot 1 containing an area of 40,497 square feet; Lot 2 containing an area of 86,694 square feet; and Lot 3 containing an area of 41.267 acres. The premises in question is located at the southeast corner of Elijah's Lane and Oregon Road, Mattituck. Several buildings are existing on these premises and a copy of the proposed minor subdivision map is attached herewith. The Building Inspector has disapproved applicants' application to subdivide and create three lots due to insufficient sideyards on proposed Lots 1 and 2, and a copy of his disapproval is also attached.
