Abigail Wickham, Mattituck ABIGAIL WICKHAM: Good evening, Abigail Wickham, representing the applicant William Baxter, my office is in Mattituck. Thank you for considering this request. It is merely a short extension of the public water main into a hamlet business district. The proposed office and retail uses in the commercial district of this subdivision have already been approved by the Health Department for well water and can be accommodated with well water but the extension of the water main will provide not only a more reliable and presumably safer water supply but most importantly will enable the inclusion of accessory apartments within the buildings to be constructed here. (No response) Southold Town Board Regular Meeting November 21, 2017 page 29 Closing Comments Supervisor Russell SUPERVISOR RUSSELL: That concludes the business. Just to go back and organize my thoughts on court, actually it's the youth court that Lynn is organizing on behalf of the Town. The East End Intervention Court was actually under the leadership of Justice William Price and I am quite certain that Justice Hughes will do an excellent job. Would anybody like to address the Town Board on any issue? Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. Back in September I raised the issue of dogs on beach and I kind of smelled it was going to get a hot button issue if I pursued it and I didn't think it was appropriate to pursue it with an election upcoming, so I let it die. It shouldn't die. There needs to be fairness there. In other words, if dogs are going to be allowed, they should be allowed on all the beaches and if they are not going to be allowed, they shouldn't be allowed on all the beaches. I am okay with the dogs, you can h ave all the dogs you want on the beach, I am fine with it but then it should be on all the beaches. The thoughts I presented then and that I will reinforce now is I think that people were actually sending people away from the beaches that don't allow dogs to one beach and probably some others. I haven't done a survey on it but I happen to live at the one beach where I know they are sending them because I have had people tell me that. when you go down on that beach and there are four or five dogs and there's no lifeguard there so people don't follow, some people, a few people don't follow rules and you go down there and there are four or five dogs running around unleashed. That's a recipe for disaster because running next to them might be a couple of two year olds, four year olds and a lot of kids and dogs are dogs, so I don't know what the answer is but I know the situation you have got now is not fair to that beach and it should be addressed somehow. Do I think you should ban dogs? No. Would it be nice if people followed the law and kept their dogs on the leash and then maybe we wouldn't have a problem? Yeah. But they don't. so my feeling is, let dogs go to the other beaches and then you won't have them centered on one beach and if they did go to the lifeguard beaches, the leash law would be enforced because just as the lifeguard can say now you can't bring your dog on the beach, they can say your dog has to be on the leash. So that solves the problem. I don't know if you all see it that way, I don't know if everyone sees it but there needs to be a solution that I am sure there are a few of the road ends that are being abused too. Some road ends are more popular than other, some road ends become de facto beaches because they've got a nice sand trim. Others are really rocky that nobody cares about, so.... SUPERVISOR RUSSELL: Those are two separate issues, one is the consistency of the zoning which is, I have to agree with you that it's not consistent and it's not fair, it's a shame that we have actually shown favoritism to certain beaches. That said, I think Bob, the issue we should focus on is the enforcement. I think we need to put a plan together this winter to beef up enforcement at that beach, at the very least, even if the code isn't consistent or fair at the very least we can enforce what we adopted otherwise we wasted our time with the code a few years ago and we will work on a plan for enforcement of the existing code. Unless Board members want to take the issue up for discussion but at the very least, we should focus on enforcement. Southold Town Board Regular Meeting November 21, 2017 page 30 COUNCILMAN GHOSIO: I wasn't on the Board at that time that this was set in motion but I do remember it being a real hot button issue. MR. DUNN: It was. It raised a lot of stuff and I don't want to go back there and I don't want to ban dogs. I am fine with dogs on the beach, I really am but what I am not fine with is a whole bunch of dogs on one beach whether it's in front of my house or somebody else's house unleashed. That's a problem. That's a recipe for disaster, it really is. When you see five or six dogs running up and down the beach uncontrolled and there's kids there. It's you know, a recipe for disaster. If one of those dogs turned on a little kid, all of those dogs will turn on a little kid. Everybody says not my dog but every dog that has ever done it is owned by somebody that said not my dog. If it was enforced and people understood, I mean, I have seen people on the beach with their dogs, I don't know why anybody wants to bring a dog to the beach personally, and hold them, I mean, let them run on the beach, I can see that but I personally would not take a dog and sit him on the beach for four or five or six hours. I mean, you see them panting. But I just think the uncontrolled nature of it and if you can enforce it, I would say that works, as long as it's enforced. The leash aspect of it. SUPERVISOR RUSSELL: I will be perfectly candid and I am probably going to put a grenade on the table, that code was a bad code because we did not have the resolve and we did not show the leadership that we needed to show at the time the issue came up. We had people that were urging us to ban dogs from the beach, we had people that were urging us to let dogs on the beach. ultimately we produced a somewhat fractured code because we were trying to go as far as we could without getting the other side angry. MR. DUNN: Understood. SUPERVISOR RUSSELL: And it's such an emotional issue that ultimately, like I said we passed something on, we tried to make both sides as happy as we could and we passed a fractured, bad code. I am going to take full responsibility as one of the six people that created that and adopted it. MR. DUNN: I am not going to call it bad, I just think it's got a hole in it. SUPERVISOR RUSSELL: It's a bad code. MR. DUNN: I don't want to argue the definition bad, but I mean... SUPERVISOR RUSSELL: We didn't have the courage to say... MR. DUNN: I think you tried, it's just, there's a hole in it and I don't think anybody ever expected that parking lot attendants would be sending people to another beach as a result of it. that's what's happened and then word has gotten out and there are people that are very devoted to their pets and that's fine and noble and they don't want to leave them at home and that's fine too but then put them on the leash. And if it was one dog, if it was only one dog running around Southold Town Board Regular Meeting November 21, 2017 page 31 you live with it but I mean, one day there was six. Usually it's a couple but when it gets to six, that gets crazy. Not to mention the potential for dog waste and all that other stuff. SUPERVISOR RUSSELL: We didn't have the courage to, people that didn't want dogs on the beaches at all, we didn't have the courage to say we are sorry, they should be free. The people that thought dogs should have unfettered access to every beach out here, we didn't have the courage to say you're right, but like I said, we crafted code frankly under the guise of compromise. And we didn't get it right. MR. DUNN: Okay. Where do we go? SUPERVISOR RUSSELL: Well, I am going to focus on enforcement next, at the very least let's enforce what we have. We need to put a plan together, if we need to start making attendants available to other beaches to enforce the very code we voted for, so be it. That's not impractical. We provide attendant coverage at a lot of the beaches. Somebody has to monitor. The only way you are going to enforce is to monitor and we will discuss how to best do that this winter and of course, do it as economically, efficiently as possible. MR. DUNN: You only need a couple tickets. SUPERVISOR RUSSELL: Yes, that I agree with. MR. DUNN: You know, five or six tickets the month of June, problem solved. COUNCILMAN GHOSIO: We are going to have to tackle a few issues concerning enforcement this winter. MR. DUNN: I am sorry. COUNCILMAN GHOSIO: We are going to have to tackle a few issues as far as enforcement is concerned certainly, you know, over the winter getting ready to go into season again. This will be one of those... SUPERVISOR RUSSELL: It should be part of the global discussion as we look to put management plans together for the beaches. A few months ago we refused to write day passes for one beach. That was necessary given the volume of use that beach was getting but this year, that was a stop gap measure, it shouldn't be the fall back and the only action we take. We need a global management plan for all of the beaches. The road ends are a completely different story. We have got dozens and dozens and dozens. Right now we should at the very least focus on beaches that the public uses as beaches. MR. DUNN: Mmmhmm. But some of the road ends like the one by the electric, it was a motel and now the electric union has it... SUPERVISOR RUSSELL: Oh, yes, Duck Pond. Southold Town Board Regular Meeting November 21, 2017 page 32 MR. DUNN: That's technically a road end but it's used like a beach, isn't it? SUPERVISOR RUSSELL: Well, we can identify ones that are used more like beaches there... MR. DUNN: It's not fair to those people either. SUPERVISOR RUSSELL: Ironically I think Bailie Beach is in that same bailiwick. So there's some, we can identify those, I just don't think there are some we are going to have to, frankly, we can't just get to everything, you are talking about hundreds of beaches but let's focus on the main ones. MR. DUNN: Okay, okay. Thank you. COUNCILMAN RULAND: I would tend to think that maybe we could look at the playing field. To the Supervisor's comments, we have some experience now on how well or not what we adopted works and it appears that it doesn't work as one would have intended that it should have worked. One of the common denominators is that all dogs should be on a leash because we had that debate before and certainly you know, I am willing to look at that because that is the common denominator for a problem when you have animals that aren't. And it's always the other guys dog that never caused the problem to your point and it's certainly well taken but I think that while the majority of people do want to do the right thing, enough of the people haven't done the right thing that we may have to make a change and I think if the field is level and to the Supervisor's point about enforcement, it makes it easier because you are not picking and choosing on this venue you may be able to do it and that venue well you can't do it there. the other thing that I have noticed if you travel to other jurisdictions, it's really clear. If you are going on the beach, the animal must be on a leash and there's no discussion about that, the animal must be on a leash. Whether there's a lifeguard there or you're there taking a stroll on the beach, okay, and you encounter someone else's dog or dogs that are not under the direct control of the person that's with them because they don't have a leash. MR. DUNN: Ninety five percent of the people that go on that beach walk past a sign that is 18 inches by two foot... COUNCILMAN RULAND: I don't disagree with you, sir, at all okay but that comes back to the Supervisor's original point, that if as part of a global approach we have got to look at a different way of enforcing what's there, then so be it but I think at the same time maybe we might just want to look at the playing field and as a group decide we should level it as much as we can. MR. DUNN: Right. COUNCILMAN RULAND: I tend to agree with you, I don't know why anybody would bring a dog in the blazing sun to the beach but... MR. DUNN: It's not my idea of fun for a dog.
