Town Clerk P.H. 11121117 @ 4:30 Pm LL Griffing St., Cutchogue Water Map Amendment RESOLVED that the Town Board of the Town of Southold hereby AMENDS resolution 42017- 817 adopted at the September 26, 2017 regular meeting to read as follows: WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County,New York, on the 26"' day of September, 2017 a Local Law entitled "A Local Law to Amend the Town of Southold Water Supply Plan Map to a Portion of Griffing Street, Cutchogue, New York , SCTM# 1000-102.00-05.00-009.004, now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the 24th day afOirteber-, 2017 at 9:01 a.m. 21" day of November,2017 at 4:30 pm, at which time all interested persons will be given an opportunity to be heard. The proposed Local Law entitled, "A Local Law to Amend the Town of Southold Water Supply Plan Map to Griffing Street, Cutchogue,New York" SCTM# 1000-102.00-05.00-009.004 reads as follows: LOCAL LAW NO. 2017 A Local Law entitled, "A Local Law to Amend the Town of Southold Water Supply Plan Map to a Portion of Griffing Street, Cutchogue, New York". BE IT ENACTED by the Town Board of the Town of Southold as follows: Section 1. Legislative Intent. This Local Law proposes to amend the Town of Southold Water Supply Plan Map to include the extension of a waterline to 260 Griffing Street, Cutchogue, SCTM 41000-102-5-9.4. Historically,the Water Supply Plan Map reflects the physical changes in the water supply network since 2000. The property owner, William J. Baxter, Jr., has represented to the Town that he wishes to include accessory apartments in the standard subdivision. In order for the Suffolk County Board of Health to allow this all lots in the subdivision must be serviced by public water. The extension of the transmission main is intended to supply the Baxter subdivision and is not intended to result in additional pressure in the area. Section 2. Enactment. Based on the goals of the Suffolk County Water Authority and Suffolk County Department of Health Services to provide safe drinking water to the Baxter subdivision, and upon our consideration of the recommendations of the Town Planning Department, and the public comments taken at the public hearing, we hereby amend the Town of Southold Water Supply Plan Map to include the extension of a water line to 280 Griffing Street, Cutchogue. Section 3. BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. In order to continue to protect the natural state of the shorelines and wetlands within the Town of Southold, it is the purpose of these amendments to provide herein for a strengthened system of local licensing of marine contractors in order to more fully protect homeowners and responsible marine contractors alike. II. Chapter 275 of the Code of the Town of Southold is hereby amended as follows: § 275-2. Definitions; word usage. COASTAL CONSTRUCTION - The repair, modification, re-construction or new construction of structures including but not limited to bulkheads, docks, floats,jetties, groins, catwalks, stairways, decks, revetments, any erosion or water control device. Included in this definition is landscape design, landscape architecture, the installation or maintenance of lawns, hedges, trees and other plantings or structural elements such as patios, decks, retaining walls, in-ground Southold Town Board Regular Meeting October 24, 2017 page 39 irrigation systems, or other work in and around wetland areas which requires a permit pursuant to this Chapter entitled Wetlands and Shorelines or Chapter 111 Coastal Erosion Hazard Areas of the Town Code. COASTAL CONTRACTOR - A person who carries out, engages in, undertakes or holds himself out to others as performing or available to perform coastal construction. § 275-3(a) Licensing of Coastal Contractors. A. Commencing January 1, 2018 it shall be unlawful for any person to engage in coastal construction in the Town of Southold without first obtaining a license from the Southold Town Clerk's Office in accordance with the provisions of this Chapter. Such license or a copy thereof shall be available at all of the contractor's work sites and shall be produced to any official having jurisdiction upon demand. Licenses for coastal contractors are non-transferable. B. Exceptions. No license shall be required for the following_ (1) An individual who engages in coastal construction on their own residential property. This exception shall not apply to corporations, limited liability companies or other unincorporated business entities. (2) An individual who performs labor or services for a licensed coastal contractor for wages or salary. (3) An architect, professional engineer, land surveyor or any other person who is required by state or Town law to attain standards of competency or experience as a prerequisite to engaging in such craft or profession and who is acting exclusively within the scope of the craft or profession for which he is currently licensed. (4) Any municipality or government agency. C. Fees. (1) The fee for a coastal contractor's license shall be set by the Town Board, and shall be paid upon the filing of each application. A license issued hereunder shall be for a period of one year from the date of issuance thereof. D. Insurance required. A coastal contractor shall have a certificate of insurance and workers compensation insurance covering liability upon applying for a coastal contractor's license and shall maintain such policy during the period the license is in effect. In addition to the above coastal contractors must provide proof of an issued Suffolk County Contractors license where applicable. Failure to maintain said coverage will provide grounds for revocation of the license pursuant to § 275-3a(E). E. Acknowledgement of Town Law Compliance All applicants for a coastal contractors license shall be required to read, review and provide an acknowledgement that they are on affirmative notice of Chapters 111 and 275 of the Town Code and agree to abide by the requirements set forth therein. They must further acknowledge that failure to do so may result in the revocation of the coastal contractors license. F. Revocation of license. Southold Town Board Regular Meeting October 24, 2017 page 40 (1) Licenses issued under the provisions of this chapter may be revoked by resolution of the Board of Trustees upon notice and hearing before the Board of Trustees. (2) Licenses may be revoked for failure of contractors to abide by the terms and conditions of Trustee Permits and/or violations of Section 275 of the Town Code. (3) Notice of the hearing before the Board of Trustees for revocation of a license shall be given in writing, setting forth the grounds of the complaint and the time and place of hearing. (4) Grounds for a hearing shall be a conviction for a violation of section 275-5 or 275-11 of the Town Code (5) Such notice shall be sent by certified mailing to the address provided in the application for the license on file in the Town Clerk's Office, or, in the alternative, to the license holder's last known address. Such notice must be mailed at least five days prior to the date of the hearing. (6) At the conclusion of said hearing, the Board of Trustees may, at their discretion, suspend or revoke the license or take no action. (7) In the event of two or more suspensions the Trustees may move to permanently bar the holder from license eligibility. (8) In addition to the revocation hearing, a violation of the provisions of this chapter may be separately maintained in the Town Justice Court in accordance with 275-16. 275-16. Compliance requirements; penalties for offenses. B For each offense against any of the provisions of this chapter or any regulations made pursuant thereto, or failure to comply with a written notice or order of any Director of Code Enforcement, Zoning Inspector, or Bay Constable within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor or their agents or any other person who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of the Director of Code Enforcement, Zoning Inspector, or Bay Constable shall be subject to the following fine schedule. Any person conducting operations within the jurisdiction of the Trustees without first obtaining a permit according to the procedures outlined in this chapter shall be subject to a fine of not less than $1,000 and not more than$4,099 $6,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. (2) Failure to comply with the terms of a permit. a Any person failing to comply with the terms of a permit shall be subject to a fine of not less than$500 $1,000 and not more than$4,909 $6,000. For each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine not less than$ 099 $2,000 nor more than$7, 90 $10,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. (3) Failure to heed a stop-work order. Any person conducting operations in direct contradiction to the terms of a stop-work order shall be subject to a fine of not less than $1,000 and not more than$4,900 $6,000. For each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine not less than $1,000 $2,000 nor more than $7,500 $10,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. (4) Restoration. In lieu or in addition to these punishments, any offender may be punished by being ordered to restore the affected wetland to its condition prior to the offense. Any such order shall specify a reasonable time for the completion of such restoration, which shall be effected under the supervision of the approving authority. The Trustees reserve the right to require specific replanting and restoration methods including specific survivability and success criteria. (-5) Failure to comply with a restoration plan. Any person failing to comply with the terms of a mandated restoration plan as detailed in Subsection!L41 of this section within the proscribed period of time for completion shall be guilty of an offense and subject to a fine of not less than $1,000 and not more than$4,000 $6,000. (6) For the offense of conducting or engagingin coastal construction project or business without having first obtained a license, or while his license is suspended or revoked, a violator shall be subject to a fine of not more than $5,000 for the first offense and not more than $10,000 for each subsequent offense. -0 7 Mitigation. When on-site wetlands restoration and creation may be unfeasible due to technical or other constraints, other mitigative measures, such as off-site wetland restoration or creation, may be required. (7) Other offenses. For an offense against any of the provisions of this Chapter not specifically designated above,a violator shall be subject to a fine of not more than $1,000. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. II. Chapter 189 of the Code of the Town of Southold is hereby amended as follows: Chapter 189. Parking Article I. Parking at Beaches Southold Town Board Regular Meeting October 24, 2017 page 43 § 189-3. Parking permits. Parking permits for parking vehicles in the parking areas designated in § 189-2 of this article shall be issued as follows: A. Resident parking permit. (1) A resident parking permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. Persons applying for a resident parking permit shall be requested to sign an application in affidavit form and submit for inspection the following as proof of residence: [Amended 5-25-1971; 3-25-1975 by L.L. No. 1-1975; 7-14-1987 by L.L.No. 11-1987] (a) A valid tax receipt stub for the current year for any taxable real property within the Town of Southold assessed in the name of the applicant. (c) Such other proof of residence as is satisfactory to the Town Clerk. (2) The Town Clerk or a person designated by the Town Clerk shall inspect such application to determine that the applicant is a qualified resident of the Town. Upon approval of the application, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall not be transferred to any other vehicle. Lessee parking permit. (1) A lessee parking permit shall be issued by the Town Clerk or a person designated by him to all persons who lease or rent property within the Town of Southold but do not qualify as residents as defined in § 189-3A hereof. (b) The persons occupying the same. (c) The term of such tenancy. (2) Upon a determination by the Town Clerk or person designated by him that the applicant is entitled to a lessee parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same manner as provided in § 189-3A(3) hereof. (3) The fee for the issuance of a lessee parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. C. Hotel-motel parking permits. (1) Hotel-motel parking permits shall be issued by the Town Clerk or a person designated by him to the owners or their designated managers of hotels, motels, rooming or boarding houses and trailer parks, for use by the paying guests temporarily residing therein. Persons applying for a hotel-motel parking permit shall present an application to the Town Clerk in affidavit form, signed by the applicant, setting forth: (a) The number of rental units available at the applicant's premises. (b) The number of permits applied for. (c) The designated business name, if any, of the premises applied for. (2) Upon a determination by the Town Clerk or a person designated by him that the applicant is entitled to such permits and upon payment of the required permit fee, permits shall be issued; provided, however, that the number of permits issued shall not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant's premises and shall be used only by paying guests occupying the premises for which such permits are issued. (3) Hotel-motel parking permits shall be transferable and shall be displayed on the dashboard on the passenger side of the vehicle. The owner or manager to whom such permits are issued shall make no charge for the use of such permits by such guests, but may require a deposit to ensure return of a permit. [Amended 11-24-1992 by L.L. No. 19-1992] (4) The fee for the issuance of a hotel-motel parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. D. One-day nonresident permits. (1) One-day nonresident parking permits may be issued for the parking of vehicles on the parking areas at Southold Town Beach, and Norman E. A resident applying for a guest parking permit shall present an application in affidavit form, signed by the applicant, setting forth the following: (a) The location of the property to be occupied by the guests. (b) The names and permanent addresses of the guests. (c) The length of time of the guest occupancy. (2) Upon a determination by the Town Clerk or person designated by the Town Clerk that the applicant is entitled to a guest parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same manner as provided in § 189-3A(3) hereof. (3) The fee for the issuance of a guest parking permit shall be such fee as shall be prescribed by a resolution of the Southold Town Board. F. Nonresident seasonal beach parking permit. Beach parking permits for nonresidents for the period January 1 through December 31 may be issued by the Town Clerk of the Town of Southold upon application therefor at a sum prescribed by resolution of the Southold Town Board, which annual sum shall inelude be for the vehicle only. and beat tr-ai . A Trailer Permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. For the purpose of ensuring fishermen and shell fishermen parking access to the beaches, creeks and waters within the Town of Southold when such parking access is normally closed (10:00 p.m. to 6:00 a.m.), the following exception to § 189-2G is hereby created: [Added 8-10-2010 by L.L. No. 8-2010] (1) Night fishing parking permit. A night fishing parking permit shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who hold a resident, lessee or guest parking permit. (2) Any motor vehicle having a night fishing parking permit shall be deemed not to be in violation of§ 189-2G or § 189-3G where both the night fishing permit and the resident, lessee or guest parking permit are properly displayed. (3) The following rules and regulations apply: (a) At the time a motor vehicle with a night fishing permit is parked at a location during a time in which parking is normally prohibited by § 189-2G and § 189-3G, the occupants of the vehicle must have fishing equipment and be actively engaged in fishing. The permit is nontransferable and valid only for vehicles bearing the license plate number on the permit. (b) Fees. There shall be no annual fee for night fishing permits. (c) Duration of permits. All night fishing permits provided for in this section shall expire at the same time as the resident, lessee or guest parking permit. (4) Other regulations. Persons using parking areas pursuant to the provisions of this section shall comply with all other laws, ordinances, rules, regulations and restrictions thereto II. Southold Town Board Regular Meeting October 24, 2017 page 51 Helen Finnegan, President CAST HELEN FINNEGAN: Good evening, my name is Helen Finnegan and I am the President of the Board of Community Action Southold Town, CAST. Our executive director, Cathy Deverato is actually at training in North Carolina and won't be back until next Friday but she, through me, extends her apologies for not being able to be here and meet you all tonight. I think most of you know that CAST has been serving the community since 1965 to create and provide a safety net for neighbors in need as well as to have programs that promote self-sufficiency for those neighbors to (inaudible) have their own ability to manage their lives. CAST's vision is that for every neighbor, basic needs are met and we can provide tools for them to build a better life for themselves. In 2017, we had several people changes, the first being that Denis Noncarrow who had been our president for four years, met his term limit. It's the only officer position that we have at CAST that has a term limit. So he stepped down as president but has remained on the Board and is about to enter his 11 t" year as a member of the Board. Our second big change, is that Linda Ruland who was our executive director for the previous two years elected to retire and she left big shoes to fill, as did Denis. So I took over for Denis in January of this year and Cathy Deverato in June after Linda left us at the end of March. The reason that I handed out the fliers, our fall newsletters, is that it has all the numbers of things that we have done and rather than take your time and recite them all, there's a little blue box in there and you can just take a look at the various activities we do and the number of people that we have served. But I would just like to highlight two of those, one is, we have had year to date which is nine months, nearly 7,500 individual visits to CAST. We have served 693 households, and the reason that I am confident in these numbers is we had a volunteer couple from Southold who built a program for us so we now have an i-pad entry system where people literally come in, they sign in and it gives them the opportunity to say they are here for the food pantry, I am here for the sharing room which is clothing and household goods, I am here for assistance with benefits and so our tracking has become much stronger. What we do is among the people we serve are struggling seniors, veterans, immigrant single mothers and children, these are the members of our community who have been disproportionately impacted by the growing challenges that we all face. Increased housing costs, energy, food and healthcare costs, lack of affordable housing, limited full-time year round employment opportunities, some stagnant wages and finite transportation options. And CAST strives to assist people in each of those areas, in order to help them to again, move toward self-sufficiency. It's not our goal for us to provide these services to everyone throughout their entire lives. Just as important, is we actually serve the residents of Southold Town by providing a direct, local way for neighbors to help neighbors. As I think many of you know, the vast majority of our funding is from private individual donations. We have a small grant from the County, we appreciate that, it's less than you have been able to give us in the past, and we have just gotten a grant from Bank of America but everything else is just individual donations. We have very generous neighbors here and we are grateful for everything that they do. in the food pantry, we've done over 1,000 distributions, just year to date, nine months. And this is historically where we have applied the finds that the town has been able to allocate to us. As I said, I won't go through everything that we do because it's all in that brochure but we do our best on minimal amounts of money for the people that we serve. We do seasonal programs as well, many of you are familiar with the Feed a Kid program which is when kids are out of school, if they are in school lunch programs during the year, we actually feed them over Christmas, we feed them over the winter break and we feed them over the summer. We have a school supply Southold Town Board Regular Meeting October 24, 2017 page 52 drive, we were able to do almost 50% more in backpacks, so this year we had backpacks that were filled with notebooks and pens and rulers and everything that every child would need and that was available to anyone in the community. We had people who were regular users of CAST and we had parents who heard about the program and just came in and asked if they could get one as well. And so everybody is welcome at CAST. It's not a need based organization. You can come in and you can get help on anything that you need. So just in closing, I just would llike to say that it is a testament to the town that we actually are in our 52nd year of existence. That this town has kept it afloat this long is amazing. And we are grateful to you for all of your support over the years and look forward to your continued support in the next year if possible. So thank you very much. SUPERVISOR RUSSELL: Thank you. Supervisor Mussell Karen MacDonald Butterfly Project KAREN MCDONALD: Hello, my name is Karen McDonald, I am here to represent an organization called the Butterfly Effect Project. We are a non-profit organization, we are a mentoring and empowering group for young girls, ages 6 to 14. A completely free program. I don't know if any of you are familiar with our program, maybe not, we are currently headquartered in Riverhead, with our meetings. We meet with our girls every two weeks. We have meeting places both in Riverhead and in Bellport but I would like you to read our mission statement so you understand a little bit about what we do. Our mission is to empower young girls by giving them the tools to assist in achieving emotionally stable and self-confident futures, which will bring forth a generation of women who are strong, independent and knowledgeable. It is our goal to ensure that every girl who is enrolled in the program has a fair chance to broaden their horizons, while eliminating obstacles such as mobility, cultural differences and finances. With the help of the many communities, every child will experience diverse activities that will mold and challenge their minds while promoting academics, hard work and self-confidence. The Butterfly Effect Project will provide a safe place for young girls to be free, expressive and prosperous. Involvement in this program today will ultimately have a positive impact on their lives tomorrow. This is a completely free program for all girls. We reach out to girls (inaudible) socioeconomic, ethnic areas. We started three years ago with just eight girls. We currently have 80 girls enrolled in both locations and we are serving girls in Riverhead, Westhampton, Southampton, Mastic Beach. We would like to bring our program to Southold because we think there is a need here. We think that probably there are underserved girls and other girls that maybe are just being missed in school or at home for whatever reason. We provide speakers, we promote academics, smart choices, field trips. We provide girls things like if they need hygiene products, school supplies and like I say, the program is free for everyone. We pretty much do our own fundraising, we beg, we borrow, we think about stealing but we don't. We are on the verge of getting some grants, we are hoping to get more. Our founder, Tijuana Fulford was a disadvantaged child herself, grew up in Riverhead, was lucky enough to have a mentor. The Town Historian in Riverhead, Justine Wells, actually mentored her as a child. She was able to finish school, go to college. She is a professional and her passion was to start to give back to Southold Town Board Regular Meeting October 24, 2017 page 53 girls that otherwise might be missed. She is actually at the Southampton Town meeting tonight doing the same thing. So my husband and I are here pitching for her. we would love to start a pilot program in Southold and move our services this way, any consideration you guys could give us for grant money we would be deeply, deeply appreciative. Thank you. Susan Cutrone, Maruen's Haven SUSAN COTRONE: Susan Cotrone, Maureen's Haven. Good evening. My name is Susan Cotrone and I am a proud member of the Board of Director's for Maureen's Haven. I also own East End bagels in Southold and I am a teacher at North Fork Head Start. Thank you for the opportunity to address you this evening to request funding to support our life-saving work. Maureen's Haven provides safe, warm temporary shelter to homeless individuals from November 1- April 1 by utilizing over 23 houses of worship located throughout the twin forks. Members of 17 congregations and community organizations offer additional support and help comprise the over 1,500 dedicated and selfless volunteers that provide an estimated 20,000 hours of community service to our guests. Maureen's Haven is responsible for screening and transporting homeless guests to the host facilities each evening. In October 2011, we opened a day center in order to provide services focused on building self-sufficiency and provide respite during the day for those in need. All are welcome at the day center, clothing, food and case management services are available. We also partner with other agencies to provide mental health and substance abuse treatment. Some of our host congregations offer free medical care provided by volunteer doctors and nurses from the nearby community hospitals and clinics. For this upcoming 2017-2018 shelter season, we are hoping to establish a critically needed foot clinic. Last winter we served 357 individuals over 115 nights. Our average number of guests per evening was 46 with a high of 53. Overall, 5,983 beds were made for the season. Of that total, 80% were male and 20% were female. At least half of our guests are temporarily or `first- time' homeless. Generally, they are the working poor who have suffered setbacks like job loss, illness, loss of transportation or divorce. The other 50% of our guests are chronically homeless. They often face one or more serious issues, including mental illness, addiction and cognitive or developmental disabilities. According to Housing and Urban Development (HUD) 2014 point in time report, 34% of the total homeless population is under 24 and tragically, most of our statistics bear this out. An unfortunate continuing trend for us has been the influx of young people. On any given night, 39% of our guests have been under the age of 25. Of those, 50% have been under the age of 21. This 39% indicates a very slight decrease from the previous year but one that is neither statistically significant nor any less alarming. Many are runaways or former foster children who have aged out of state services or they have been victims of abuse or homophobia at home. Well known throughout the communities as a safe haven, we are often the first point of entry for the newly homeless. We believe that our reputation for compassion and inclusiveness is what has attracted so many young people to continue to seek solace and shelter from us. Through Maureen's Haven, our homeless guests can access programs that meet their immediate needs, support them through transitional periods and lead them back towards self- sufficiency and long term success. We assist homeless adults to acquire supportive housing through Suffolk County's Single Point of Access and more recently, the Housing First Model in partnership with the Long Island Coalition for the Homeless. We help our guests with securing entitlements and advocate for them tirelessly. In an effort to provide services to the homeless in Southold Town, we have partnered and collaborated with the faith communities of Southold First Southold Town Board Regular Meeting October 24, 2017 page 54 Presbyterian Church, St. Peter's Lutheran, St. Patrick's, Southold Unitarian, and the civic organizations of the Southold Rotary, local Boys and Girls Scout troops and many others to provide overnight shelter, nutritious meals and other supportive services. We are very appreciative of the past support we have received from the Town of Southold and respectfully request funding once again in support of our program. We ask the Town Board to consider an allocation of $5,000 to assist in the cost of screening and transporting our guests to the host facilities throughout the season, ongoing operations of our day center and to offset the salaries of the program staff. For 2017, we have that planned and for 18 we plan on continuing that because there is quite a bit to do. II. Chapter 275 of the Code of the Town of Southold is hereby amended as follows: § 275-2. Definitions; word usage. COASTAL CONSTRUCTION - The repair, modification, re-construction or new construction of structures including but not limited to bulkheads, docks, floats, ietties, groins, catwalks, stairways, decks,revetments, any erosion or water control device. Included in this definition is landscape design, landscape architecture,the installation or maintenance of lawns, hedges, trees and other plantings or structural elements such as patios, decks, retaining walls, in-ground irrigation systems, or other work in and around wetland areas which requires a permit pursuant to this Chapter entitled Wetlands and Shorelines or Chapter 111 Coastal Erosion Hazard Areas of the Town Code. COASTAL CONTRACTOR-A person who carries out, engages in, undertakes or holds himself out to others as performing or available to perform coastal construction. 275-3(a) LicensinjZ of Coastal Contractors. A. Commencing January 1, 2018 it shall be unlawful for any person to engage in coastal construction in the Town of Southold without first obtaining a license from the Southold Town Board Regular Meeting October 24, 2017 page 56 Southold Town Clerk's Office in accordance with the provisions of this Chapter. Such license or a copy thereof shall be available at all of the contractor's work sites and shall be produced to any official having jurisdiction upon demand. Licenses for coastal contractors are non-transferable. B. Exceptions. No license shall be required for the following_ (1) An individual who engages in coastal construction on their own residential property. This exception shall not apply to corporations, limited liability companies or other unincorporated business entities. (2) An individual who performs labor or services for a licensed coastal contractor for wages or salary. (3) An architect, professional engineer, land surveyor or an other who is required by state or Town law to attain standards of competency or experience as a prerequisite to engaging in such craft or profession and who is acting exclusively within the scope of the craft or profession for which he is currently licensed. (4) Any municipality or government agency_ C. Fees. (1) The fee for a coastal contractor's license shall be set by the Town Board, and shall be paid upon the filing of each application. A license issued hereunder shall be for a period of one year from the date of issuance thereof. D. Insurance required. A coastal contractor shall have a certificate of insurance and workers compensation insurance covering liability upon applying for a coastal contractor's license and shall maintain such policy during the period the license is in effect. In addition to the above coastal contractors must provide proof of an issued Suffolk County Contractors license where applicable. Failure to maintain said coverage will provide grounds for revocation of the license pursuant to § 275-3a(E). E. Acknowledgement of Town Law Compliance All applicants for a coastal contractors license shall be required to read, review and provide an acknowledgement that they are on affirmative notice of Chapters 111 and 275 of the Town Code and agree to abide by the requirements set forth therein. They must further acknowledge that failure to do so may result in the revocation of the coastal contractors license. F. Revocation of license. (1) Licenses issued under the provisions of this chapter may be revoked by resolution of the Board of Trustees upon notice and hearing before the Board of Trustees. (2) Licenses may be revoked for failure of contractors to abide by the terms and conditions of Trustee Permits and/or violations of Section 275 of the Town Code. (7) In the event of two or more suspensions the Trustees may move to permanently bar the holder from license eligibility. (8) In addition to the revocation hearing, a violation of the provisions of this chapter may be separately maintained in the Town Justice Court in accordance with 275-16. 275-16. Compliance requirements; penalties for offenses. B For each offense against any of the provisions of this chapter or any regulations made pursuant thereto, or failure to comply with a written notice or order of any Director of Code Enforcement, Zoning Inspector, or Bay Constable within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor or their agents or any other person who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of the Director of Code Enforcement, Zoning Inspector, or Bay Constable shall be subject to the following fine schedule. Each day on which such violation occurs may constitute a separate, additional offense.[Amended 12-18-2007 by L.L. leo. 23-2007; 3-23-2010 by 1..[,. No. 1-20101 f l) Failure to obtain a permit. Any person conducting operations within the jurisdiction of the Trustees without first obtaining a permit according to the procedures outlined in this chapter shall be subject to a fine of not less than $1,000 and not more than$4,000 $6,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. ,(2J Failure to comply with the terms of a permit. {a) Any person failing to comply with the terms of a permit shall be subject to a fine of not less than$5-98 $1,000 and not more than$4,088$6,000. For each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine not less than$ 000$2,000 nor more than$ 508 $10,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. D) Any person failing to comply with posting the permit and/or the requirement for supporting plans to be available for immediate inspection pursuant to § 275-10 shall be subject to a fine of not more than $1,000. (3) Failure to heed a stop-work order. Any person conducting operations in direct contradiction to the terms of a stop-work order shall be subject to a fine of not less than $1,000 and not more than$4,080$6,000. For each subsequent offense, the Southold Town Board Regular Meeting October 24, 2017 page 58 violator shall be guilty of a misdemeanor punishable by a fine not less than $1,000 $2,000 nor more than $7,509 $10,000 or a term of imprisonment of not less than 15 days nor more than six months, or both. (4) Restoration. In lieu or in addition to these punishments, any offender may be punished by being ordered to restore the affected wetland to its condition prior to the offense. Any such order shall specify a reasonable time for the completion of such restoration, which shall be effected under the supervision of the approving authority. The Trustees reserve the right to require specific replanting and restoration methods including specific survivability and success criteria. (5) Failure to comply with a restoration plan. Any person failing to comply with the terms of a mandated restoration plan as detailed in Subsection 13(4) of this section within the proscribed period of time for completion shall be guilty of an offense and subject to a fine of not less than $1,000 and not more than $4,000 $6,000. (6) For the offense of conducting or engaging in any coastal construction project or business without having first obtained a license, or while his license is suspended or revoked, a violator shall be subject to a fine of not more than $5,000 for the first offense and not more than$10,000 for each subsequent offense. (6) (7) Mitigation. When on-site wetlands restoration and creation may be unfeasible due to technical or other constraints, other mitigative measures, such as off-site wetland restoration or creation, may be required. (7) Other offenses. For an offense against any of the provisions of this Chapter not specifically designated above,a violator shall be subject to a fine of not more than $1,000. II. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. I do have a signed affidavit here that this has been noticed on the Town clerk's bulletin board and in the Suffolk Times. I do have a letter here from the Suffolk County Department of Economic Development and Planning that this is to be considered a matter of local determination, that there is no apparent significant county-wide or inter-community impacts. A decision of local determination should not be construed as either an approval or a disapproval. That's it. Mike Domino, President , Trustees MIKE DOMINO: Mike Domino, presently President of the Southold Board of Trustees along with Vice-President John Bredemeyer. Speaking in support of the coastal contractors, 915. We wanted to take this opportunity to thank the Town Board, code committee, Town Attorney Bill Duffy and Assistant Town Attorney Damon Hagan for their assistance in developing this Southold Town Board Regular Meeting October 24, 2017 page 59 resolution. Several years ago it became evident that a new class of customers were overloading our offices with repeat violations because they recognize that violating the terms of the permit and paying a small fee resulted in increased profits. Not only did the penalty part of the code fail to stop these repeat offenders, it did not adequately address the protection phase of the environment. The resolution before you will develop a licensing process that requires each applicant to assert that he or she is cognizant of and respectful of the town code relevant to our wetlands. The first violation of the code will result in an increased fine and subsequent violations may result in the loss of the license to operate in Southold Town. Hopefully this will prevent recidivism and make it easier for our office to concentrate on valid applications. Once again, we support this resolution. Thank you for your time. Former Board President, I don't need to speak at length on this because President Domino spoke eloquently and the institutional memory of two Town Board members and former Trustees goes a long way. And one in particular, Jill Doherty, when I was a Trustee back in the mid 80's and 90's, things were a lot different then. We would make suggestions to homeowners and applicants and permit expeditors and I would say our level of compliance was about 99 percent. And this new class of customers is exactly what Mike Domino spoke to and actually this actually, this is a work product that includes not only Bob Ghosio and Jill Doherty but also two other prior Town Attorney's that helped bring cases before town court and I would say we are dealing with one or two hard cases that speak to a problem which is largely indifference, indolence, actually indignation. We have some people now that will lay false claims against our Board, they will actually claim that we are not holding public meetings. This Board is totally transparent, we meet, we gladly meet with everyone. We have this great architectural pre-submission conferences and we gladly meet during work session. Great opportunities to educate people during our normal permit process but this new class of customers is what we have all had to deal with. Thank you, I appreciate it. (1) Hotel-motel parking permits shall be issued by the Town Clerk or a person Southold Town Board Regular Meeting October 24, 2017 page 64 designated by him to the owners or their designated managers of hotels, motels, rooming or boarding houses and trailer parks, for use by the paying guests temporarily residing therein. Persons applying for a hotel-motel parking permit shall present an application to the Town Clerk in affidavit form, signed by the applicant, setting forth: (a) The number of rental units available at the applicant's premises. (b) The number of permits applied for. (c) The designated business name, if any, of the premises applied for. (2) Upon a determination by the Town Clerk or a person designated by him that the applicant is entitled to such permits and upon payment of the required permit fee, permits shall be issued; provided, however, that the number of permits issued shall not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant's premises and shall be used only by paying guests occupying the premises for which such permits are issued. (3) Hotel-motel parking permits shall be transferable and shall be displayed on the dashboard on the passenger side of the vehicle. The owner or manager to whom such permits are issued shall make no charge for the use of such permits by such guests, but may require a deposit to ensure return of a permit. (3) The fee for the issuance of a guest parking permit shall be such fee as shall be prescribed by a resolution of the Southold Town Board. F. Nonresident seasonal beach parking permit. Beach parking permits for nonresidents for the period January 1 through December 31 may be issued by the Town Clerk of the Town of Southold upon application therefor at a sum prescribed by resolution of the Southold Town Board, which annual sum shall include both the vehicle and boat trailer. [Added 7-14-1987 by L.L. No. 11-1987; arnended 10-23-1990 by L.L. No. 21-1990; 10-18-1994 by L.L.No. 21-1994; 2-23-1995 by L.L. No. 4-1995] G. Trailer Permit. 1. A Trailer Permit shall be required for any trailer used to launch a boat at the boat ramp or road end locations set forth in section 189-2 B or C. 2. A Trailer permit shall be required at all times to park a trailer in any of the parking areas designated in sections 189-2 A, B, or C. 3. A Trailer Permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. Persons applying for a Trailer Permit shall be required to meet the same requirements set forth in section 189-3 A. 4. A trailer Permit shall be affixed to the tongue of the trailer. 5. The fee for a Trailer Permit shall be set from time by time by resolution of the Town Board. H, Commercial Boat Hauler/Launcher Permit. Any business engaged in the launching of transporting and/or launching boats shall be required to obtain a Commercial Boat Hauler Permit. 1. A Commercial Boat Hauler/Launcher Permit shall only be issued by the Town Clerk or a person designated by him to an individual or corporate entity engaged in the business of transporting; and/or launching boats with a principle place of business located in the Town of Southold. 2. The fee for a Commercial Boat Hauler/Launcher Permit shall be set from time by time by resolution of the Town Board. G.I. Night fishing parking permit. For the purpose of ensuring fishermen and shell fishermen parking access to the beaches, creeks and waters within the Town of Southold when such parking access is normally closed (10:00 p.m. to 6:00 a.m.), the following exception to § 189-2G is hereby created: [Added 8-10-2010 by L.L. No. 8-2010] (1) Night fishing parking permit. A night fishing parking permit shall be issued by the Town Clerk or a person designated by the Town Clerk to all persons who hold a resident, lessee or guest parking permit. (3) The following rules and regulations apply: (a) At the time a motor vehicle with a night fishing permit is parked at a location during a time in which parking is normally prohibited by § 189-2G and § 189-3G, the occupants of the vehicle must have fishing equipment and be actively engaged in fishing. The permit is nontransferable and valid only for vehicles bearing the license plate number on the permit. (b) Fees. There shall be no annual fee for night fishing permits. (c) Duration of permits. All night fishing permits provided for in this section shall expire at the same time as the resident, lessee or guest parking permit. (4) Other regulations. Persons using parking areas pursuant to the provisions of this section shall comply with all other laws, ordinances, rules, regulations and restrictions thereto II. Karen Rivera KAREN RIVARA: Good evening, my name is Karen Rivara and I am owner of Aeros Cultured Oyster Company in Southold and a resident of Greenport. Some folks in shellfish farming industry, we are concerned about the commercial permit and it sounds to me like it's really targeted toward commercial boat haulers and their use of the ramps but I am basically just here to make sure because most of us will launch our boats in the spring and then pull then in the fall. That's pretty true of most people that work on the water,just to make sure that that's the target that you, you are looking at commercial users who are boat haulers and I think it sounds like also you are limiting that permit for commercial boat haulers to Southold Town businesses and so people from out of town that are engaged in boat hauling would not be able to use our ramps for launching boats and hauling them, so just clarification of that and just to find out what this new trailer permit might cost,just out of interest. So just to answer some questions that people have asked me about it. COUNCILWOMAN DOHERTY: Sure. To make it clear, the commercial fishermen will be charged the residential rate and it will be a resident sticker. Southold Town Board Regular Meeting October 24, 2017 page 67 MS. RIVERA: Okay. COUNCILWOMAN DOHERTY: The Town Board is going to go over fees for 2018 but in previous discussion we hadn't made any definite fee changes yet but we propose not to change the fee for a resident parking sticker. So, but we have changed it to a two year sticker. so currently it's $10.00, for a two year sticker it would be $20.00. you would have to get a sticker for the vehicle and a sticker for the trailer. MS. RIVERA: Okay. COUNCILWOMAN DOHERTY: And you are correct in the assumption of the commercial boat haulers is for the town businesses. And there is, for other businesses or other non-residents, we hope to have a state ramp on the bay side in the next year and there's a couple of state ramps on the sound side, so non-residents still have access to the bays through the state ramps. MS. RIVERA: Okay,thank you. SUPERVISOR RUSSELL: I can speak for my perspective, any fee, the reason we created the permit requirement law, fees get done by resolution at any Board meeting but I can tell you from my perspective I wouldn't want to charge any more than a nominal amount, simply to pay for the administration of it. the reason for the permit isn't to create revenue, it's to simply identify resident who are permitted to use the ramp from non-residents who wouldn't be permitted to use the ramp. I am here this evening to request that our Town Board review our current town codes with regards to helicopter landings in open farmfields, vineyards and any other type of vacant, open land whether privately owned or being used under the agricultural preservation laws. I understand based on the most recent Shinn/Blade promotional event, Southold Town Board was looking to start addressing stricter code and language and stricter code enforcement. Thank you for that. many tax payers want to discourage any misuse of air space and most importantly, of our Southold Town Board Regular Meeting October 24, 2017 page 68 precious land. There is no doubt that Blade is knocking at our door and they are looking to service the north fork. As a, I want to share an email I received today from a Southampton Helicopter Advisory Committee member which they are also looking to get the Southampton Board to increase their penalties. So if I could share that with you, this is information based on East Hampton but again, they are trying to get Southampton to implement the same, so East Hampton prohibits landing anywhere other than designated airports although the fine is ridiculously low, like $200, so I hope we do not consider that amount of money but our advisory committee in Southampton has requested Southampton to enact similar legislation with a fine for $1,000 for the first offense, increasing by the same amount for each subsequent offense. They are also asking for Southold Town to do th e same. Each town should exert maximum authority over its waters as well. In order for any code to be strong aside from language, is penalty. I would also suggest that we also duplicate or implement higher landing penalties. If penalties are high, it would discourage any possible landings here in Southold Town. As a taxpayer and resident I appreciate all efforts that our Town Board does to preserve Southold Town. And on a separate note, I wish to share the following exciting news. Governor Cuomo signed the bill A.8.5523/54333 which is a home rule bill meant to ensure that the participation of the voters in any long term financial commitment of the Town of East Hampton may wish to enter into with the Federal Aviation Administration for improvements to the town owned airport. So this is a huge victory not only for East Hampton Town taxpayers but it is also a victory for Southold, Riverhead, Shelter Island and Southampton townships. This was an east end effort to get the Governor to hear us and sign the bill. This could not have been done without the help of the Assemblyman Fred Thiele, Senator LaValle and our own Legislator Al Krupski submitted a fantastic letter of support to Governor Cuomo. I would like to publicly thank these elected officials, our Town Board and all others who understood the importance of this bill. Today is a victorious day for the east end and I thank you all for your support. SUPERVISOR RUSSELL: Thank you, Teresa. Just to assure you, actually the current code prohibits those landings in AC zones etc., we think it's clear. However, we had discussed today creating-legislation to adopt that makes it bold and crystal clear, you know, we know the code doesn't permit it but lets' make it bold and clear so others do. we also sent a letter to Blade Incorporated today and it said "To Whom it May Concern, I am an attorney for the Town of Southold and I am writing with regard to certain recent reports that Flight Blade has advertised and intends to offer flights to wineries within the Town of Southold. Please be advised that the landing of helicopters at a winery is not an allowed use under the town code. The increased frequency of helicopters over the town has had a great adverse impact, quality of life..." I won't read the whole thing but largely it covers what we have been talking about for years and we demand `accordingly the Town demands that Blade Incorporated cease and desist with illegally conducting flights within the Town in violation of the Southold Town code.' We did send this today. MS. MCCASKIE: Awesome. SUPERVISOR RUSSELL: Also, I will tell you on the other thing with the ,airbase, they had never bothered asking the airbase. I had actually, when I found out, I went to call Paul Pawlowksi, he had not only already knew about it, he called them to tell them promptly that you Southold Town Board Regular Meeting October 24, 2017 page 69 are prohibited from landing at this airbase. He took very swift action to let them know they are not welcome there. and as you're probably aware in the news article today, the owner of the winery said it's been cancelled. MS. MCCASKIE: That's a successful thing. I appreciate everyone's hard work on it. the public has been very supportive of it as well and again, for East Hampton, this is a huge, huge victory. So big celebrating tonight. Thank you. SUPERVISOR RUSSELL: Thank you, Teresa. Thank you for everything you are doing. I don't know that I have met anybody that works harder than you. which means you work me hard. COUNCILMAN GHOSIO: I can tell you, serving as the liaison to the helicopter committee, you are absolutely right. it is amazing what she does as the head of that committee. SUPERVISOR RUSSELL: The FAA is afraid of her. I am not kidding. Lynn Summers, Southold LYNN SUMMERS: As well they should. Lynne Summers, I am in Southold now. I always think I am in Mattituck, I was there 40 years but moved 5 years ago. But I will always be in Mattituck. In researching the ownership of Mattituck Airport LLC and Airstrip, LLC. There is a name of one person by the name of Steven David Marsh. It appears in two places. I had my little conversation with Paul Pawlowski this morning. As of this morning, well, maybe they were going to grant a nice, well, they made a mistake kind of thing. By this afternoon, it had changed. When I called Blade myself at 2:38 yesterday afternoon, Blade said to me just blithely from their public relations department, oh, yes, Steve Marsh granted us permission months ago. Now, what I want to know in this jurisdiction, Steve Marsh lives in Portland, Oregon and we, and I said to Paul Pawlowski, I know he is a friend and he is your partner, but he doesn't see what we see. You are the one that gets the bad press here, you're the neighbor. So maybe we need to talk a little bit to Steve Marsh because if this was one of these deals where they went to who they think is the owner but it's not very clear when people would look it up who the owner is. on some documents it says Paul Pawlowski and others it says Steve Marsh. Is everybody aware it's not consistent. How, I guess they have to correct that because how many people really own those two entities? SUPERVISOR RUSSELL: That's, how you choose to hold title to something is completely up to you, that is not up to the town to mingle in. MS. SUMMERS: Okay. So, as it stands, Blade thought it was Steve Marsh and that is who they must have contacted. That's what they said to me. SUPERVISOR RUSSELL: Okay, well, first of all, I can't speak for the veracity of Blade's claim but I can tell you Paul had contacted me because he saw it and he took swift action. Now we should all clarify that the town code prohibits landings in farm fields which if you go to the Blade website just two months ago, they were nice enough to offer up six or eight farms for Southold Town Board Regular Meeting October 24, 2017 page 70 landing. Regarding whether it can or can't take off from an airport, I won't speak to that tonight because they would really submit an application to the Building Department so it could be vetted. I can't say whether they are allowed there or not but I can tell you I understand suspicions, I understand concerns. It's been an airport for 50 or 60 years, shortly after it was acquired, Paul did come and talk to me about, you know, they don't want to do anything that's going to be damaging to the community. You know... MS. SUMMERS: Well,that's what he said. SUPERVISOR RUSSELL: I don't want to hold him up and flog him tonight. We'll have conversation with him and figure out where it's going. MS. SUMMERS: They want to keep it private and by saying no as they did, it is setting the precedence but why, my confusion was, who really does own the strip and the, that's what I wanted to clarify. SUPERVISOR RUSSELL: Two separate corporations. MS. SUMMERS: Two separate corporations. Okay. SUPERVISOR RUSSELL: Who the principals are, we don't know. They are not required to disclose it to us. Would anyone like to address the Town Board on any issue? Jim Underwood,Laurel JIM UNDERWOOD: Jim Underwood, Laurel. The question is we were focusing on Blade but how are landings monitored at individual wineries? Because it is happening. SUPERVISOR RUSSELL: Yes, I am aware of one that just happened about a month and a half ago. MR. UNDERWOOD: One happened this weekend or maybe it was last weekend but who, how do we find out about this? Are the wineries, because this is going to be the next wave. SUPERVISOR RUSSELL: I have a great deal of concern, absolutely, I agree. What we plan on doing, what we discussed as a Board is first we are going to notify all of the winery owners to let them know it's a prohibited use on farmland. Any company that seeks to violate the town code, our action will be swift and it will be severe. We are right now, like I said, drawing bolder lines in the code but I don't think under any circumstance this Town Board is ready to accept helicopters, unless you are a crop duster right now, helicopters for transport on farm land is simply not allowed. MR. UNDERWOOD: Okay,thank you. SUPERVISOR RUSSELL: Sure. Southold Town Board Regular Meeting October 24, 2017 page 71 COUNCILMAN GHOSIO: So far when its occurred, we seem to find out about it within 15 minutes, there are people that are watching. COUNCILWOMAN DOHERTY: Yes, and to remind people that we have means of 24/7 reporting this in the town. Bill Duffy is in charge of the town enforcement and we can get somebody out there right away. SUPERVISOR RUSSELL: I would also point out, that use is a use violation that would go to the property so any property owner that's allowing flights to come and go on their, they are in violation of the code and they are subject to the prosecution of the code. MR. UNDERWOOD: Inaudible. SUPERVISOR RUSSELL: That's a use violation, ultimately they get issued a use violation. Right now the use violation for that, really there's no separate scale for violation of helicopters, it's a violation, a use violation. The violation would get issued and ultimately get adjudicated by and decided by the judge. Yes? MS. MCCASKIE: I know that there is one gentleman that does agricultural... SUPERVISOR RUSSELL: Yes. MS. MCCASKIE: He has a location behind King Kullen. SUPERVISOR RUSSELL: Yes. Teresa McCaskie MS. MCCASKIE: And if somebody was to land there per se, that is a helipad and that gentleman owns that helipad. Would he be able to grant someone permission to land on his property? SUPERVISOR RUSSELL: No. A property owner can't give someone permission to violate the town code. It would be a use violation. In his instance, he has a bona fide business. MS. MCCASKIE: It would go back to the use violation. SUPERVISOR RUSSELL: Helicopters used for transport would not be permitted there. you can't waive the Southold Town code because you want to let someone use your property. MS. MCCASKIE: So his only rights are for the use of the crop dusters? SUPERVISOR RUSSELL: That's his current use. MS. MCCASKIE: Okay. Thank you for clarifying.
