The public hearing on this appeal was held on May 26, 1982.
Upon application of ERNEST E. WILSBERG, by Richard J. Cron, Esq.,
Main Road, Cutchogue, NY for a Variance to the Zoning Ordinance, Article
III, Section 100-31 for approval of insufficient area and road frontage
of two parcels located at Ole Jule Lane, Mattituck; bounded north by Ole
Jule Lane; west by Hunt and others; south by'Ole Jule Lane; east by Wils-
berg; County Tax Map Parcels No. 1000-122-5-12 and 13.
By this appeal, appellant seeks approval of the insufficient
area and width (road frontage) of two parcels (as indicated in attorney's
letter received May 7, 1982), and with 33,837 and 29,598 square feet
and each with 110' road frontage. Parcel I shows a proposed house with
setbacks and Parcel 2 shows an existing one-family private dwelling.
By a previous appeal (Appeal No. 2923), this board granted a variance
approving the construction of a 24' by 40' accessory building on the
easterly parcel (Proposed Parcel 2) which would be located northerly
of the 16' by 38' inground swimmingpool. Members of the board are
familiar with this property and the surrounding neighborhood, and it
is the opinion of the board that the relief requested herein is
reasonable under the circumstances. The parcels surrounding these
two parcels are found to be quite smaller than the subject parcels.
The board agrees with the reasoning of the appellant.
In considering this appeal, the board determines that the
variance request is not substantial in relation to the code
requirements; that the circumstances herein are unique; that
by allowing the variance no substantial detriment to adjoining
properties would be created; that the difficulty cannot be
obviated by a method, feasible to appellant, other than a
variance; that no adverse effects will be produced on avail-
able governmental facilities of any increased population; that
the relief requested will be in harmony with and promote the
general purposes of zoning; and that the interests of justice
will be served by allowing the variance as applied for.

RESOLVED, that the application of ERNEST E. WILSBERG be and
hereby is GRANTED approval of insufficient area and road frontage
of two parcels AS APPLIED FOR in Appe.a, 1 No. 2811.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces-
sa~ HARDSHIP becau~ it would prevent Petitioner from dividing a parcel
of land containing frontage on Ole Jule Lane on its northerly and
southerly boundaries into two residential lots. The area of Peti-
tioner's parcel is 32,837 square feet. It is intended to divide the
parcel into two residential lots of 16,418 square feet and 16,419
square feet. The divided lots would be given to Petitioner's two
sons to enable each to construct their own residence. A denial of
the application would compel the construction of a single family
residential dwelling having road frontage in both its front and rear
yards and wi~han area substantially greater than~her residential
properties in the vicinity.
2. The hardshipcreated is UNIQUEand isnotshared by alt properties alike in the immediate
vicinity of this property and in this use district because all other lots in the area
of equal or lesser size have been improved withresidential dwellings.
In the circumstances, the restrictions of the Ordinance are unique
to Petitioner's parcel and not shared by others.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because all of the rssidential improved lots
adjoining the Petitloner's premises on the West have areas of approx-
imately 11,000 square feet to a maximum of approximately 17,300 square
feet. Other parcels in the area approximate 20,000 square feet.
None of the improved lots in the area meet the current area and width
requirements of the Southold Town Zoning Ordinance.

Dear Sirs:
An appeal is pending before the Zoning Board of Appeals, pursuant
to application dated March 30, 1981, said hearing having been held in
abeyance pending a determination from the Suffolk County Department of
Health as to approval of water and sewage facilities at the proposed
premises.
An examination of the application will indicate that the applicant,
Ernest E. Wilsberg, owned a parcel of land immediately adjacent to his
residential premises consisting of 110 feet on one end of Ole 3ule Lane
and 116 feet on the other end, a distance between the two of approxi-
mately 275 feet on the division line and 323 feet on the other line.
It was proposed to divide this tract in two so that two residential
dwellings could be erected on the parcel. The Suffolk County Health
Department declined to approve a division of that parcel into two resi-

A new application was made to the Suffolk County Health Department
for the purpose of securing the approval of a single dwelling on this
large parcel in the vicinity of the residence of Ernest E. Wilsberg.
This application was duly granted by the Suffolk County Department of
Health as evidenced by a photocopy of the survey hereto annexed.
In the light of the foregoing, I should like the Board to consider
the previous application for a permit to divide amended so as to secure
a permit to divide the property as set forth in the enclosed three (3)
copies of surveys as amended February 16, 1982. You will note that
with the division proposed for the new dwelling, that such contains an
area of 33,837 sq.ft.
If all is satisfactory, I should appreciate being advised as to
a date and time that this matter will be scheduled for hearing.
In the light of the fact that the applicant's son, Paul Wilsberg,
would like to start construction of his new residence as quickly as
possible, I should appreciate any consideration that the Board might
give to scheduling an early hearing.

parcel into two residential lots of 16,418 square feet and 16,419
square feet. The divided lots would be given to Petitioner's two
sons to enable each to construct their own residence. A denial of
the application would compel the construction of a single family
residential dwelling having road frontage in both its front and rear
yards and.wid~an area substantially greater than~her residential
properties in the vicinity.

adjoining the Petitioner's premises on the West have areas of approx-
imately 11,000 square feet to a maximum of approximately 17,300 square
