N.Y. 11971 TELEPHONE ,616) 765-1809 ZONING BOARD OF APPEALS Appeal No. 2982 Application Dated Hay 4, TO: Environmen~ East, !nc. 3075 Indian Neck Lane Peconic~ NY 11958 1982 (as agent for Leighton Wigley) [Appellant(s)] At a Meeting of the above appeal · -on your '- IX]' [ ] [ ] the Zoning Board of Appeals held on May 26, 1982 was considered, and the action indicated below was taken Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a Request for Special Exception under the Zoning Ordinance Article , Section Request for Variance to the Zoning Ordinance Article , Section [ ] Request for The public hearin~ was held on May 26, 1982 concerning this matter. Upon application of Environment East Inc., 3075 Indian Neck Lane, Peconic, NY as agent for }eighton Wigley, for a Variance to New York Town Law, Section 280-a for approval of access over a private right-of-way located off the north side of Grand Avenue, Mattituc~, NY. Location of Proper~y: 3325 Grand Avenue, Mattituck, NY; bounded north by Black; west by Matti- tuck Creek; south by Ely; east by Black & Ely; County Tax Map Parcel No. 1000-107-1-12. The board made the following findings and determination: By this appeal, appellant seeks approval of access over a private right-of-way extending off the north side of Grand Avenue northerly 471.83 feet with a width of 30 feet and extending thence westerly 933 feet with a width of 25 feet to the premises mn question. The subject right-of-way has an excellent base and is the only viable, practical route no these premises. In considering this appeal, the board determmnes that the variance request is not substantial in relation to the code requmrements; that the circumstances herein are unique; that by allowing the variance no substantial detrimenn to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on avail- able governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance as indicated below. On motion by Mr. Douglass, seconded by Mr. Grigonis, it was RESOLVED, that Appeal No. 2982, application for Leighton ~ig!ey be and hereby is GRANTED APPROVAL OF ACCESS as applied for and SUBJECT TO THE FOLLOWING CONDITIONS: 1.
