Comments regarding resolution 271
SUPERVISOR RUSSELL: I just want to comment, I think there's a lot of misunderstanding
here and it's unfortunate, maybe some information that isn't, is honest. We got the letter
yesterday from several organizations regarding this who had actually expressed opposition.

That's fine. The Town Board is actually voting down the public hearing tonight, so that will end
any legislative action on our part. some of the concerns were raised was, the organization said
there was no input or comments, the fact of the matter is we have been discussing this for some
time now. The, we had code committee meetings that were publicly noticed that very few people
attend,we have actually had the discussion with the Chairman of the Agricultural Advisory
Committee of Southold Town participating in the meetings. We have actually, the, we also, I
guess this letter said in fact we had attempted to do so previously which is I presume do discuss
the issue with us, none of the organizations had come to me, to want to discuss this issue. I can't
speak for the rest of the Board, no one has come to me and I actually, if you look at the list, we
have people Duncan Kennedy from the North Fork Promotion Council, I have met with Duncan
several times over the past few weeks. He never raised the issue. George Haas was part of the
meetings, again, never raised the issue. Danielle LaScala, First Friday's-Mattituck Chamber of
Commerce, we've had regular conversations because the Town has supported First Friday's every
chance we get. Andy McCaskie, I just saw him at a Mattituck High School event, never raised
the issue with me. Richie Vandenburgh has been in touch with town because of a special event
application, never raised the issue. There is also just some clarification, by and large, the
legislation is administrative in nature. there is one aspect of it, I think that was just a result of
miscommunication of the Town Board and the Town Attorney's office and that is the provision
for the one permit per six events that was lined through. The Town Board needs to address that
because there's a lot of,there's some people that are applying for these applications and they're
supposed to be specific events and they are really applying for days. That is not necessarily
operating in good faith. We need to close that loophole but we decided at the time that the entire
code needs to be revisited. It's a large undertaking so we are going to set that to the side and take
care of all those other issues when the time comes. But by and large, this is administrative. That
was our intent. If that one provision alarmed people, our mistake.
COUNCILWOMAN DOHERTY: Excuse me, can we make it clear that we are not holding the
public hearing?
SUPERVISOR RUSSELL: Yes. I would,please, welcome you to stay so that we can have a
larger discussion on this after we have voted on the agenda.

2409 2010 ten-wheel drive Truck Tractor Freightliners for snow removal. The vehicles are being
purchased from the State of New York Department Office of General Services for a total of

RESOLVED by the Town Board of the Town of Southold that the Highway Department Spring
Cleanup will start on Monday, April 16, 2018 in Laurel. Our Highway crews will remove only

Leaves Must Be In Bio-Degradable Paper Bags,NO EXCEPTIONS. We can only pass through
an area once; be it further
RESOLVED that the Town Board hereby authorizes the acceptance of residential brush free of
charge for four weeks, at the Southold Town Compost Facility in Cutchogue (leaves are always
accepted free). This four-week grace period is for those homeowners who wish to take their
brush directly to the Town's compost site themselves. The grace period will start Saturday,
March 31, 2018, and end Monday April 30, 2018; be it further
RESOLVED that commercial landscaping and tree removal companies will no longer be

way. It will be the homeowner's responsibility to make certain that their contractor(s) haul their
yard debris to the Cutchogue Compost Facility as anyone observed dumping in the Town right-
of-way will be fined for illegal dumping; and, be it further
RESOLVED that the Fishers Island Spring Clean-Up will also commence on Monday April 16,
2018.
RESOLVED that the normal tip fees for brush disposal at the Cutchogue Compost Facility shall
be waived for residential vehicles for the period March 31, 2018 through April 30, 2018; and that
tip fees for brush shall be reduced for commercial vehicles to $30/ton for the period from March
31, 2018 through April 30, 2018; and be it further
RESOLVED that for the purposes of this resolution, residential vehicles shall be defined as any
vehicle with a resident disposal permit issued by the Town Clerk of the Town of Southold
carrying less than one ton of debris (including trailers), or for vehicles without a permit, any
vehicle with a less than one ton carrying capacity (including trailers); and that commercial
vehicles shall be defined as any vehicle with a commercial disposal permit issued by the Town
Clerk of the Town of Southold, or for vehicles without a permit, any vehicle with a carrying
capacity of one ton or greater; and be it further

AND AUTHORIZING THE ISSUANCE OF BONDS IN THE
PRINCIPAL AMOUNT OF $500,000 TO FINANCE SAID
APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to construct improvements to sidewalks and related
drainage improvements. The estimated maximum cost thereof, including preliminary costs and
costs incidental thereto and the financing thereof, is $500,000 and said amount is hereby
appropriated for such purpose. The plan of financing includes the issuance of bonds in the
principal amount of$500,000 to finance said appropriation, and the levy and collection of taxes
on all the taxable real property in the Town to pay the principal of said bonds and the interest
thereon as the same shall become due and payable.
Section 2. Bonds of the Town in the principal amount of $500,000 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (herein called the "Law"), to finance
said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 24 of the
Law, is ten (10) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution for the purposes for which said bonds are authorized.

The foregoing statement of intent with respect to reimbursement is made in conformity with
Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
Section 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and of any bond anticipation notes issued in anticipation of said
bonds, and the renewals of said bond anticipation notes, and as to the execution of agreements
for credit enhancements, are hereby delegated to the Supervisor, the chief fiscal officer of the
Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution is subject to a permissive referendum and the
Town Clerk is hereby authorized and directed, within ten (10) days after the adoption of this
resolution, to cause to be published in "The Suffolk Times, " a newspaper having a general
circulation within said Town and hereby designated the official newspaper of the Town for such
publication and posted on the sign board of the Town maintained pursuant to the Town Law, a
Notice in substantially the following form:

TOM SHEARIN: Tom Shearin, Silvermere Road in Greenport. This is my third trip in five
months addressing the flooding down on Silvermere Road. I want to know where we are at?
SUPERVISOR RUSSELL: Sure. We actually hired Neil McDonald to do the boring testing, he
is going to do the boring testing so we can figure out where to best put the drainage. We
obviously will have to go down pretty far because of the clay and everything else. But it is the
intent of the town to just go back and the most likely, successful plan that we can put in place is
to simply do what was supposed to be done which was to go through the clay lens and get down
to the water table so it can drain.
MR. SHEARIN: Well, he did that boring testing already and the town was paying for it.
SUPERVISOR RUSSELL: Yes, he did that a couple of years ago. Jamie Richter is coming in to
talk about that in two weeks. We also have Jay Bredemeyer, is already engaging in the water
testing for the DNA sampling.
MR. SHEARIN: Yes, I know. You were hoping to have that for this meeting, obviously that is
not the case at this point.
SUPERVISOR RUSSELL: No. Everything is under way though.

PATRICIA MOORE: Good afternoon,just a request or an issue for you to consider in the near
future. I had a variance that to me seemed like a no brainer and every time that I think a no
brainer, I get a surprise. First a family had a garage that had a half living space above that just,
it had always been used as an office space by prior owners. So my client said I want to keep this,
instead of just storage, I want to be able to telecommute with my office at home, I just want to
put my computer up there, so because the building department says you can't use a garage for
anything other than storage to be able to do anything else with it, other than, a pool house is
permitted but other than that you need zoning board approval. So whether it is a private art
studio, an artist lives there and just uses it as a painting room, somebody who telecommutes to
their office and just for their own private use, those uses are not permitted according to the
building department. So you go to the zoning board and ask, well, surprise me, they said no
home office, you can do it in your principal home but you can't do it in your garage. Even
though there was no testimony, they didn't want to run an office, they had no intention of having
anybody there, it was just a computer. And my client said, you mean a study? Yes, a study.
That's essentially all it was. Anyway, when the zoning board doesn't give relief for those kinds
of things, it seems to me the only alternative is the Town Board has to add some language to its
customary accessory use which is you can have your computer in your garage if you have room
for it, so instead of a workshop, instead of storage, if you were you know, let's think 20 years
from now and we all will have robots in our homes doing something or other and maybe you
know how to tinker, program or our kids will know how to do all that, you may need a dry space
in your garage to fix your robot. All I am asking for, is consider adding to the code an accessory
listed use because if it doesn't say so, even though I know as a lawyer what is customary
accessory uses, the zoning code should be a living document that allows you to consider what
our current accessory uses versus what maybe 30 years ago when the code was written was
considered an accessory use. Seems to me that nowadays with homeowners that have second
homes out here and they try to spend as many days out here as possible and commute,
telecommuting, okay, working from their computer, it should be something that we make easier
to get rather than impossible to get. So that's my request, the zoning board isn't providing that
relief therefore it seems to me, and I asked Mike Verity, I said Mike, did I call it the wrong thing
when I went to the zoning board? Possibly, I don't know but he said, well, if it's anything but
storage, it's not allowed. So, back to you guys. It's your baby.
SUPERVISOR RUSSELL: I would say, personally I agree with you, the issue came up a few
years back, someone wanted to put an arts studio in a home, ultimately I don't think they
completed the sale so we sort of dropped it at that point. You know, squeaky wheel, so, I think
you are right.
MS. MOORE: I have been to the zoning board a lot of times on artist studios, again, it's not for
sales, it's purely for their own personal enjoyment and a couple of sky lights and a clean room
because artists tend to be pretty messy and when you try to do it in your house, you will end up
with paint all over your walls, so you know, if you have a significant other in the house and they
don't want paint on the walls, they will probably send you to the garage anyway. So yes, that
would be a good alternative. So please address it if you would. Thank you.

SUPERVISOR RUSSELL: Sure. Thank you. Would anybody else like to address the Town
Board?
Prudence Heston
PRUDENCE HESTON: I don't know what you said at the beginning of the meeting, it was
about as clear as mud. But I think what I was hearing you say, you weren't, it was kind of a
surprise to see so many people come here. How many people are here today for special events?
So while you may not be hearing a whole lot in your office about that, people have been
patiently waiting for the opportunity to come in here and discuss this. It is something that has
been on the agenda twice now, it has been cancelled twice. Today it was very unclear as to
whether this was going to be on the agenda or not. You have got, it affects a tremendous number
of businesses in this community and while you may not think there is a lot of interest in it, there
is a lot of interest in it. And people want this to go through well, they want the opportunity to be
able to talk with this Board about it and to get this right. And you know, it's like playing
telephone out there in the community. An email goes to another person which goes to another
person, it comes from the Farm Bureau, it comes from the Wine Council, it goes around and
around and around in circles. Nobody knows what is happening and what they know is that their
livelihood depends on it. and so, what you are seeing is a lot of people coming in, I see people
from catering, I see people here from farms, I see people here from vineyards, I see people here
from tent companies, from bathroom trailers, lots of different companies they are affected by this
and there's no opportunity to address this group.
SUPERVISOR RUSSELL: With all due respect, we try. We sent code committee meeting
notices out some time ago. We sent the draft of the language, we put it on the website, we put in
in the local media at least 30 days ago probably longer than that. What I had was a letter today
that said there was an effort to reach out to us, to discuss it that was, what was said again? Also,
the reason we put the public hearing at the beginning of the agenda was to assure everyone that
we weren't going to move forward with it but basically was said that he had attempted to contact
us and I am saying I don't know when, some of these people I see regularly, some of them
weekly, some of them certainly in the last week, and at any time if anybody raised any objections
or concerns, we could have tabled this whole thing, you know cleaned it up, get the language
better but we need to hear from people. We had, I know a lot of the people from agriculture here
we had the chairman of the Agricultural Advisory Committee part of the discussion. Steve Bate
was in a month and a half ago to go over the law thoroughly. I don't know how else to get the
message out there. We try. I don't know who else I should be talking to but we try. Our
accessibility is, all you have to do is contact us, I have offered recently to meet with people
nights and weekends. I have Wednesday night hours. I don't know how we are going to get this
information but this 11 th hour stuff, what I am suggesting is unnecessary. At any time over the
past several weeks, if anybody raised objection, we could put it on hold and say let's clean it up.
And what I am suggesting is, we have to be fair both ways here. You have to let us know what
your thoughts are.
MS. HESTON: I think people were waiting tonight, waiting for the opportunity. Waiting for a
public place to do that. I would assume that you would want everybody in this room to make an
individual appointment to come in and talk to you, they are waiting to do that.

SUPERVISOR RUSSELL: I agree. But I don't think they should do it under the threat of a
local law that's pending. I don't think they should have to come here at the last minute because
they are worried we are going to pass a local law that's going to damage them, damage their
business. All they have to do is reach out and say, look as an organization, can you come and
talk to us about this? That happens all the time on other issues. So that's how you get people in
the room, we are happy to do that but when we advertise these meetings, we try to get people
there and we have a code committee meeting and no one shows up, we put the text of the law out
there early in the process, at any time had anybody wanted the Board or Board members to come
discuss the issue, we are always happy to but out of fairness to you and to us, it really doesn't
have to wait until the 11 th hour, you don't have to wait to say well, we have got to hurry and get
in there because they are going to do something that will hurt my business. It also allows all of
us to have clarity, so I think if there was a better understanding of this law, there might, it might
not have maybe created so much angst. Those are the discussions we like to have, that's why we
have the meetings. But we need people to come in and participate. We need them to get ahold
of us. you don't have to do it one at a time. the farm bureau could have reached out to us at any
time, the wine council Steve Bate talked to us. the B&B association, all the people on this list,
they can reach out at any time and what we would have done, we would have said let's table this
and then we will get input that we are looking for, we will finally get the input and we will clean
it up before we notice it. Anthony?

ANTHONY SANNINO: Yes, Scott as you mentioned, you were right, Steve Bate did mention a
month and a half ago and did present in the letter that you received, some of the recommended
changes or discussions that we could have but I don't think he was afforded the opportunity to
meet with you guys, so I just wanted that to be on the record.
SUPERVISOR RUSSELL: He was though. First he met with the Town Attorney for probably
an hour and then we had a code committee meeting. That's what we had that meeting for, was to
get all that input. And I have to say, at the code committee meeting, no one was there from any
of the people or any of the industries that are here tonight.
MR. SANNINO: You mean for this particular vote?
SUPERVISOR RUSSELL: For the special events? Yes.
MR. SANNINO: Okay, when was that held? What was the date?
SUPERVISOR RUSSELL: I think we started meeting July 10, 2017. That's a long time, well,
you are looking at it wrong. It gave you plenty of time to engage yourself in the discussion. We
didn't come up with the draft language in July of 17, we worked on it over the course of that
time and then came up with the draft language and sent it back out there so people can comment.
MR. SANNINO: Yeah, we received it by public notice and that had to be two months ago.
SUPERVISOR RUSSELL: And at any time in the two months had you called or said, look, this
isn't going to work, we need to clean it up, the public hearing never would have been scheduled.

MR. SANNINO: But as you mentioned, Steve did call a month and a half ago and we did try to
discuss it.
SUPERVISOR RUSSELL: He never did with me. in fact, I met with him after that to discuss
the tourism district.
MR. SANNINO: Inaudible, Mr. Duffy and the government liaison, Denis Noncarrow.
SUPERVISOR RUSSELL: I don't know what they discussed but he needs to come back to the
Town Board and say these are things we need to talk about. We would have tabled it. we would
have, we are trying to clean things up administratively. There's that one thing, that's the cycle,
this one permit for six events, that's supposed to be tabled for another day...
MR. SANNINO: How do we leave off today with the current code?
SUPERVISOR RUSSELL: I am sorry?
MR. SANNINO: How do we leave off today?
SUPERVISOR RUSSELL: Current code is still the code, it's not being changed.
MR. SANNINO: Okay. And then for time to discuss?
SUPERVISOR RUSSELL: Yes. I mean there's two goals here, one is to clean up the
administrative review because you know, we have a part-time chair, a part-time board doing a lot
of reviewing.
MR. SANNINO: Totally understandable.
SUPERVISOR RUSSELL: So we need to clean that up. And then there's a second issue, which
we weren't going to get into until another time which is the wholesale review of the entire
special events code. You know, you have to remember we created this, special events weren't
allowed prior to adoption of this code. Only, I think wineries could have them under certain
circumstances, you know, farm operators, nobody could have them. We drafted this code to
allow for that but we needed to put provisions in place so you know, it was adequately reviewed
before the event took place but that was done, what, about seven years ago? Sometimes you
have got to pull code out and say well, now that we have experience with it what do we need to
do to change it. you know, streamline it, other respects, maybe we are not including information
that we are going to need. You know, it's a living process, it's a learning process.
MR. SANNINO: So at this point, you are approving the administration part?
SUPERVISOR RUSSELL: No, we are not, no, the first vote we took tonight was to say that
public hearing which would have been to vote on the changes as proposed, that hearing is done,

we cancelled it. We are looking for that input, we have been looking for that input. It is not
forthcoming.
MR. SANNINO: Inaudible.
SUPERVISOR RUSSELL: It is not forthcoming but I would really appreciate it. Can you
please stand up at the microphone.
Mike Falcetta, Sparkling Pointe
MIKE FALCETTA, SPARKLING POINTE VINEYARDS: Does this now have to have another
public hearing at some point to address this?
SUPERVISOR RUSSELL: Yes.
COUNCILWOMAN DOHERTY: Our intent here was just to clean up some administrative
things and some other things got in here just because we are also having conversations in public
work sessions and code committee meetings so this got a little more in it than we intended to, so
we cancelled out everything we've done here. I think what our intent is to just do the
administrative stuff which would be noticed for a public hearing and then, so the Town Board
can work with the current code for a while, as the Zoning Board member is working with it now.
So once we work with it, get a little more closely with the workings of it, and then gather more
information from you, then we can start other work sessions and meetings, code committee
meetings to get information from you as to how do we overhaul the whole entire code and what's
best for all of us in the town. That's the process that I see go forward.
SUPERVISOR RUSSELL: Yes, it's going to be a two-step process but any changes would have
to be re-noticed for a public hearing, absolutely. And what we would do is we would also hold
code committee meetings like we have in the past.
MR. FALCETTA: Okay. It is a bit disappointing, we've all, we are here, we all have been
discussing this. we were all kind of coming here hoping to hold the public hearing, it is 4:30 in
the afternoon, we've all taken off of work and shut down our days to be here to give our notice...
COUNCILWOMAN DOHERTY: Wait...
MR. FALCETTA: To be able to give our input on this tonight.
COUNCILWOMAN DOHERTY: We started getting emails yesterday, we got a letter and I was
confused with a lot of the emails because I thought they were talking about the alcohol wine
farm, there was so much information there because that was not what we were talking about, so
at the work session today after talking to the ag committee, we decided to just rescind the whole
thing and go back to code committee and make it a little more clear, just the administrative
things that we want to change. So that's why, we knew at that time we weren't going to be
approving any part of this. So it was too much of a change to continue with it. It would have had

to renoticed anyway, so that's why we decided to rescind it and we did it at the beginning of the
meeting so you would all know.
MR. FALCETTA: so how do we have a point person to go to or to develop a chain of command
so that we can clearly have a chain of communication with so that we can be a part of the
creation of this code so that it works well for everyone? How do we...
UNIDENTIFIED: Inaudible.
SUPERVISOR RUSSELL: We don't have, as a town account, we don't have Facebook. But I
am sure Jim could put it on his account, not everybody is friends but again, we do all we can to
reach out. I don't know how else to do it, the implication from this letter was it was some 11th
hour thing that we are forcing through the process. It's unfair and it's dishonest because that is
not the case. And we have had representatives at some of the meetings. I don't know how else,
if Steve had concerns he could have brought them to the Town Board, he could have said the
wine council wants to meet with you to discuss this. I have never turned a meeting down for
anybody that has asked that. There's a public process.
COUNCILWOMAN DOHERTY: Suggestion, have a point person continually check the paper
and websites of our meetings because they are all publicized and if you have one person check
and then you can start notifying everybody, okay, code committee on this day...
MR. FALCETTA: I was also, I have been going to meetings for this for the past six weeks. I
have probably spent on my own time 40-50 hours in meetings and phone calls discussing this on
the impacts it has between my seat on the wine council board, the farm bureau board. There's a
lot that goes into this.
SUPERVISOR RUSSELL: Then why didn't anybody contact us to say look we need to...
MR. FALCETTA: We need to check that out with the person that works for us because I was
told by Steve Bate that he had phone calls into the town attorney, phone calls into Denis and
there was correspondence, Steve was giving us updates at our council meetings and our other
meetings and it was essentially that there was no desire to meet was the impression that we were
getting from Steve. So if I need to take that up with Steve, that's a different case. But did Steve
contact the town attorney? Did Steve contact Denis?
SUPERVISOR RUSSELL: Yes, I think they met.
MR. FALCETTA: These are people that are within the town and if there job is to communicate
things back to you guys, that's sort of internal thing on your side.
SUPERVISOR RUSSELL: Steve was just in my office recently to talk about the tourism
district, he could have brought the issue up then but he never, ever raised the issue with me about
any imperfections that need to be corrected. Like I had mentioned before, Richie, Andy all these
guys I see regularly and one person could have said we need to put the brakes on this because we

need more input because there are imperfections. We hadn't heard from anybody and we have
done everything in a public setting. I don't know how else to get people in to discuss these
issues. I don't know, again, ringing alarm bells at the last minute probably isn't fair to you and it
isn't fair to us.
MR. FALCETTA: And I don't think it was last minute because we have been having meetings
about this since the first time that this has been on the agenda and we were under the impression,
if we are wrong, then that's something internally on our side but we will look into it and see the
correspondence that's in place, who Steve reached out to and the correspondence. I have one
more quick question, if that's okay.
SUPERVISOR RUSSELL: Sure,please.
MR. FALCETTA: How are current permits being handled? As of today, as of tonight, what's
going on?
SUPERVISOR RUSSELL: The same way.
MR. FALCETTA: What?
SUPERVISOR RUSSELL: The same way.
MR. FALCETTA: Okay, I just have one other question. I had my employee go into the Town
of Southold the other day to drop off the special events permit, the message was relayed to my
employee that we have been instructed to be extremely strict on all the permits going forward.
SUPERVISOR RUSSELL: You can have the employee talk to me.
MR. FALCETTA: And there was a request to know the names of the brides and grooms for the
special events and the weddings...
SUPERVISOR RUSSELL: yes, well you would have to bring that to me, I am unaware of that
but we do need more detail from some of these permits, people are leaving things blank, that's
not the level of detail that we need. I can't speak to that, I am unaware of that....
MR. FALCETTA: As we go through this process and creating this new code, that permit needs
to be amended as well. When we are needing to apply for these permits, sometimes it takes the
bride more than 30 days to figure out who their caterer is going to be. So to know Suffolk
County catering numbers, different things like that, that far in advance sometimes are not
realistic. So I would also ask in addition to looking at this code, that we also look at the permit
application as well and I hope that you will look into the office as well.
SUPERVISOR RUSSELL: I would agree but there is, we have, a lot of people don't meet the 60
day deadline and we've done everything we can to get those permits out, look a deadline we
understand, some of the things have to be supplemental, we get that, we understand all that.

MR. FALCETTA: It's also a bit of a scary process when you do book a special event, you are
essentially taking a deposit from somebody, so if your site rental is $10,000 most places take
half, so I am taking $5,000 of somebodies money saying ma'am, sir, I have $5,000 of your
money I am going to tell you I am going to hold your wedding but I am going to keep my fingers
crossed that this passes through the board and they are going to say okay. Now what happens if I
have signed a contract with somebody, agreed to hold their wedding, now I am open, subject to a
lawsuit because I can't make an application for an event before I actually have a booking for a
wedding so this whole process just really needs to be examined and brought up to the status of
what an event is, how it takes place and the whole process of planning one, booking one. It's not
immediate, so...
SUPERVISOR RUSSELL: I would agree. This process was new for you and for us when it was
created in 2010. That's why we are willing to look at it but the administrative changes, again,
those are short term goals and the longer term goals which are what I talked about.
MR. FALCETTA: If there were two lines crossed out at the top of that code, I don't think
anybody would really be here, maybe we would have a representative or two to ask some
questions but there was a whole lot of striking in that code for purely an administrative change.
SUPERVISOR RUSSELL: No, okay. We'll talk about it.
MR. FALCETTA: Thank you, we appreciate that.
Karen Rivera
KAREN RIVARA: Karen Rivara. I am also on the Agricultural Advisory Committee, so I have
basically a process question about this. the first time I saw it on our agenda was the meeting
before the public hearing and both of those meetings were nor'easted out, we did meet and
discuss it earlier this week but I am just wondering when you do work through the process of
revising the code, if you are going to send it off to the Agricultural Advisory Committee for
some reviewing, comment and input. We have members from the various parts of the industry
involved and all of those segments for the most part have some interest in special events and we
do have people from the outside community as it's a public meeting, attend and give their input
so some good ideas have been tossed around the table so I am just wondering if part of that
process for public input would go through the Agricultural Advisory Committee?
SUPERVISOR RUSSELL: We'll work on the process, absolutely.
COUNCILWOMAN DOHERTY: We relayed that to them at the work session, I know you
couldn't make it today but we told them that we would keep them in the loop.
MS. RIVARA: Okay. Thank you. That would be much appreciated.

CARL NOVAK: Carl Novak, president of the Long Island Farm Bureau. And some of the
things I have now heard kind of change what I was going to say here but as Mike said, this was,

is being presented as an administrative change, however, the document that we saw with strike
throughs and a lot of additions, really looked like more than an administrative change. We
understand you consider the changes to be administrative, we understand there may be a change
to, need to change some of the aspects of the code to address the administrative issues but we
feel some of these points that we saw in the amended document went beyond administrative and
could adversely affect the business community. I am really encouraged to hear you say you want
to talk, you want to reach out and we would like to do that also, and you know, regardless of
what did or didn't occur in the past, we felt a public hearing was our opportunity to be heard
because we didn't feel for whatever reason, we had that opportunity in the past. So moving
forward, if the Board is willing to reach out to us as a group and our business groups, we are
more than happy to participate in the process. One of the things as far as the town committee
meetings, at the times they take place, as business owners and residents engaged in operating
businesses, it's sometimes difficult to spend several hours every week at town hall with
committee meetings, taking time off when we can't focus on our business. If that's what we
need to do or if we can set up some time when the town can be more amenable to a schedule that
allows business members to address them, that would be good also. Or an opportunity to address
council members at our businesses would be helpful. So we are willing to work with you, we
want to work with you, we understand there's issues and we want to get them addressed but
whatever the process is to include the business community and for the business community to
include the town board, I am a process guy, whatever that process is obviously isn't working or
else all these people wouldn't be here at the 11th hour. So I tend to not look at people for the
issue or to put blame on people, look at the process, what is not working in the process, what can
be changed in the process to get an inclusive input from the business community and from the
residents.
SUPERVISOR RUSSELL: Thank you.
Adam Suprenant
ADAM SUPRENANT: Adam Suprenant, Southold. I was at the ag advisory committee this
past week and I was just really disappointed that there was no outreach at all to ag advisory on
this issue and I understand special events aren't just for farmers, they are not just for wineries
and that other business types have special events so it might not have been a pure fit but I really
encourage you as town board to please utilize the experts that are volunteering their time, to get
their advice, reach out and also, go out of your way, please reach out to the consumers like for
my business, Coffee Pot Cellars, I don't do special events so this law doesn't affect me, I still get
pushed around by my wife to please call up because our neighbors wedding music is too loud at
11:30 to please call the cops and I try to resist because I realize there's only a few months a year
for this type of business to occur, so I try to calm her down. It's not always possible, so I would
encourage you as a board to reach out to us, not just to the farmers and the wineries but other
businesses that h ave special events. One last comment I have and I am going to be brief, code
committee, I have been looking all over, is there an agenda that is published for code committee?
Are there minutes? Is that something that's online? Is that something that we need to do a foil to
get? Because I hear this that you know, everything is transparent and open yet a lot of times and
we had an issue with the last law I saw a lot of faces in this room, the last bad law I would say,
to, that the code committee it is a mystery what goes on there and I know it's a public meeting,

there should be some sort of notice and agenda posted so that we as the public know what is
going on there.
SUPERVISOR RUSSELL: It is.
MR. SUPRENANT: Is it online?
SUPERVISOR RUSSELL: Yes, I will forward it to you. Actually it goes online, it goes out to
all the media and along with the agenda which specifies the issue that is to be discussed.
MR. SUPRENANT: With the agenda, and that is noticed in the paper?
SUPERVISOR RUSSELL: That is sent out to everybody, including the media.
MR. SUPRENANT: Thanks. Then I just must be missing it.
UNIDENTIFIED: Is there a way of publishing it? Because I watch for it all the time and I am
telling you, I have a secretary assigned to it and half the time we don't see it....

MR. SUPRENANT: Is there an agenda packet like there is for the Town Board meetings?
Because that's what I....
COUNCILMAN DINIZIO: Well, I notice because I am doing a lot of work on that now,
because it is an impossible site, it's hard to navigate, so we are working on that and a bunch of
other things but I just looked it up to see how easy it was to get information. There is really, all
the agenda says is codification of agricultural advisory committee, that's all we are going to be
discussing. As far as any formal agenda, no.
SUPERVISOR RUSSELL: You also had your chairman at the meeting, so it wasn't a mystery.
We have to rely on the leadership to convey things back to our committees. That's the best we
can do. I realize people can't always make it to the various meetings and incidentally, we have
had people in the past say look, this issue is really important to us, we need to schedule this
meeting at night because we are working and we have done that. So, 6:30, you know, when you
have a meeting and no one raises any issue about the issue, that puts us in a tough spot because
we are trying to move forward here.

MICHAEL VARIALE: Good afternoon, my name is Michael Variale, I am from East End
Wedding Guide. We are a new organization, four years old but I think I represent probably
about 50 or so vendors and my contact list extends beyond the network. I just want to make a
note, if there is anything or communication, if I can be informed to relay that message, I am also
a member of the North Fork Chamber of Commerce, I just got on the North Fork Promotion
Council, so I think if communication goes to the people that need be, it would be very beneficial
because the room is packed now, it's essential. From what I understand there were roughly 400
applications for events last year, and it's an estimated $60,000,000.00 input for business.
Whether you are making coffee, doing the 7-11, people are coming into town. It's a nice infuse
of money. So if you say hey listen, we need communication, I would be more than happy to give
you my email and we can pack this room out every night if we have to.
COUNCILWOMAN DOHERTY: Should he send his contact information to your secretary?
SUPERVISOR RUSSELL: Absolutely. But I will say there is nothing in this proposed
legislation that was going to impact weddings in any way.
MR. VARIALE: Special events...
SUPERVISOR RUSSELL: The whole purpose of the special events was to permit them more or
less in all businesses. But there was, the review process might be a little cumbersome, that's a
relic from the original code. That wasn't what we were proposing.
MR. VARIALE: Whatever it is, I think it affects every single business on the north fork. Thank

SUPERVISOR RUSSELL: Who else would like to address the town Board?
Kate Sepenoski, East Marion
KATHRYN SEPENOSKI: Good afternoon, Kathryn Sepenoski, East Marion. You are
proposing address just administrative changes next time yet it seems that the crux of that is part
of what we are not very happy about. The process when it was discussed among the agricultural
community at our recent meetings to prepare ourselves to come here and speak tonight were that
they thought the process worked very well, that Chairman Weisman made wise decisions even if
she had to consult before making her decision but your adding layers of other potential
miscommunication from certain politicized areas, if you will, that we have already had
bottlenecks in making the process work smoothly. And I understand you're saying once again,
Supervisor Russell, that you are not aware that anybody tried to reach out to you. I have heard
that at other meetings, we are holding ourselves responsible if we didn't all show up but we have
just witnessed that the communication already didn't work that we needed to speak to you and
that we wanted to communicate to you, so if that's the very same platform that you are proposing
we already as an audience can see that there are going to be missteps and one misstep can mean
one event whether it's work $50 or it's worth $10,000 and I would put it to the town attorney that
the vineyard owner at Sparkling Pointe made a very good point that if you take a deposit and you
default on what you are proposing to give them and those families have made reservations at

hotels, they booked tours and events, dinner reservations, all the things that they come here to do
in a very short season and we all know, grew up knowing it, what tourism means that we will
then be held liable as a business owner if we couldn't provide that because we couldn't secure
the permit we need. And purely because there is miscommunication, not because anybody even
intended to withhold one but if there's a drop from one person, imagine the drop and the
catastrophe that can befall any applicant if all of these people that you are proposing are just
administrative changes. That is a large part of what frightened this community and why we are
all here because the ancillary businesses to what we again, feel was a direct target at agriculture,
this is the second time in a couple of months and you are snickering...
SUPERVISOR RUSSELL: I am not snickering.
MS. SEPENOSKI: But you see a lot of the same faces but then those faces have then spoken to
their community members who support them, who are the rest of the fiber of how we all
communicate and stay in business. So we all have concerns that we are going to fall short, we
feel that this is a way to hinder our ability to grow and stay viable, to continue to pay rising tax
costs or mortgage costs or whatever it may be, if you are a farm or any other business, if we have
restrictions to strangle us to the point that we can't remain here, what just happened even at this
last nor'easter, you stay off the streets, you could look down the entire street and not see a car or
a business open. That is what the north fork will look like and that is what it has looked like in
the past when there was a downturn in the economy and higher interest rates. We struggled as a
community, we revitalized, we came back stronger, we innovated, and we changed and that is all
we are looking to do and not have so much, we already have plenty of regulation, you
overregulate us anymore and people are going to leave and your tourism is going to leave and so
is the base for an increase in any staffs pay, you are not going to be able to pay your people more
and why should they make more if we as a community can't support ourselves so we can pay our
taxes and we stay here. So administrative is still to me a scary word because it looks like a lot of
added layers with one single word and we know how important one word means in a document.
So, I thank you for your time.
SUPERVISOR RUSSELL: I am sorry, Kate, can I just address exactly what, so you understand
exactly what I said, what I addressed was a letter that said there was an attempt to do so
previously, to contact us and what I am saying, I never heard from anyone so I don't know what
the attempt was because I never got a call of any kind and no one said anything and I've seen
these people on a regular basis, so that, you know...
MS. SEPENOSKI: So I have another question, code meeting or work session, are those part of a
public record?
SUPERVISOR RUSSELL: Yes. They are noticed.
MS. SEPENOSKI: Not noticed, if someone comes to speak, if someone addresses the
committee, the board, is it documented so it is part of the record of the discussion like what we
are having tonight?

MS. SEPENOSKI: And what about work sessions? So today, our representative showed up and
there was a discussion...
SUPERVISOR RUSSELL: Yes. Yes.
MS. SEPENOSKI: All of that is accessible.
COUNCILWOMAN DOHERTY: You can actually watch it on video.
MS. SEPENOSKI: Because part of our misinformation is that had we come, which clearly could
have been a group this size or larger to make our comments at your work session, that it would
not have been part of a documented, recorded, part of our public comments would have been
included.
COUNCILMAN DINIZIO: Work sessions you would have to have an appointment, you can't
just come and stand up and talk at a work session, okay? This is where you do that and honestly,
you could do that, this, what you are doing right now, at any of our meetings. So during the
course of two months or so you have been discussing it, you could have come every other week
and do exactly what you are doing right now.
MS. SEPENOSKI: Okay. Thank you for that clarification but again, we do have people from
our committees saying they did reach out and that is to some of the committees you are listing as
part of the layers of what that administrative process will be and they are already was a
breakdown in communication that we wanted to come and that we wanted to talk with all the
members of the board even if it was in groups of two or three with board members so it wasn't
overwhelming so we could address points. And however that broke down, we know that the
reach-out,happened, so however you did not hear about it Scott, that needs to be fixed on your
end, we clearly have some things to fix on our end but we need to have the correct line of
communication happen, not working on it, actually having it work.
COUNCILWOMAN DOHERTY: Can I say two things? First I think the, instead of
individually emailing us at various points, if you do a group email every time, so we all see and
make.a point of it, not everyone is going to answer because what we will do is have one of us
answer or maybe all of us will answer but a lot of times, Scott is here full-time, every day and he
deals with this every minute. The rest of us are part-time and we rely on emails to find out a lot
of what is going on and sometimes Scott doesn't remember he has got to forward everything, he
gets probably hundreds of emails a day so it's better if you do a group email and the other
thing...
SUPERVISOR RUSSELL: I am sorry, that's not true, I forward every email with regard to
policy being discussed by the town.

COUNCILWOMAN DOHERTY: Yes, I am sorry, I didn't mean to say you don't do that but I
am just saying that if you're looking, I just feel that a group email from a group like you to a
group like us is just better way of communication. That is my opinion. The other thing is when
you were talking about in the proposal that we rescinded about going through all the layers, we
have been doing that all along, we just decided to put that in writing. Leslie, the chairman of the
Zoning Board has reached out to all those people we have listed in that proposal and that is the
way this process has been going all along, so that wasn't changing anything, it was just putting it
in writing to say this is what we do. Which might have made everybody freak out thinking now
they are adding all these people but we were always doing that. So the process wasn't changing,
we were just clarifying it more.
SUPERVISOR RUSSELL: Can I point out that the Farm Bureau representatives reached out to
three board members last week and said we want to talk to you about some concerns, right away
Councilwoman Doherty offered them the opportunity to come to work session today. So you
know we are more than amenable to get this type of input and when it's requested we react and
offer it very quickly.
MS. SEPENOSKI: I think the miscommunication may be on some of our part, that it wouldn't
be part of a recorded document, that might be part of it and that we needed to be heard as a
community and so this, quite frankly, is your mass email.
SUPERVISOR RUSSELL: Let me clarify, when you have a public hearing, when you have the
work session, the conversation isn't part of the record of the public hearing. So I think what the
issue was, you have to make the comments at the public hearing to be part of the official
transcript of the hearing itself.
MS. SEPENOSKI: So that clarification is important, that is why we are here because I think the
fear is that even if we went and we give our input that it will not carry the weight that it needs to
when we are standing h ere in front of you and in front of everybody as a community, so that
everybody can hear and it isn't miscommunicated like the telephone, one person hears one thing,
they repeat it a different way, we are having that opportunity tonight because this is how we feel
and these are our concerns and they are financial to every single person not only in this room but
we are also representing who couldn't come tonight. So, thank you for your time.
Rich Vanderberg
RICH VANDENBURGH: Good afternoon, Rich Vandenburgh, actually question relevant to my
position as president of the Greenport Village bid and just because I have never attended a code
committee and I do think the point that Jill made about group email, very important because I do
think there's greater accountability on both sides when that happens because it was, you know, it
was a question based upon what I heard as to really clearly delineating what that communication
thread shows in terms of attempts to reach out to address this issue and what attempt that we as a
group and the related businesses ultimately are made aware of you know, the issues that do
exist. My question though relative to the code committee was the document, the proposed
legislation with the various lines and changes in it, that ultimately is achieved at the theoretical
end of the code committee examination of that legislation, is that correct?

SUPERVISOR RUSSELL: Yes. The code committee is to, I guess what you would call hone
the draft and then that comes back to the Town Board and then we notice it and that's what gets
advertised, put on the website,the local media. That's the text.
MR. VANDENBURGH: Okay, so when the code committees are held and actually a more of a
subset question, is the meeting always held at the same time each month? Or does it move
around?
SUPERVISOR RUSSELL: It's held at the same time, usually 2:30 but we call them when
there's pending legislation. In other words, if we are not anticipating amending the code at any
point in the near future, there would be no need to have one.
MR. VANDENBURGH: Okay. Next question relative to the document that we kind of are all
focused on here and kind of the concern with the you know, administrative versus substantive
changes, will there be the ability to return this document to the code committee? My basis for
that is essentially because of the, call it missing ships in the middle of the night in terms of the
fact that this code committee ultimately reached this conclusion with this proposed legislation
that has obviously elicited a lot of concerns from the community, is there an opportunity to
return this legislation to the code community so that now we are vested with this information, we
can actually then participate in that committee to try and get this legislation right.
SUPERVISOR RUSSELL: We wouldn't have a choice, we would have to because anything
then would be subject to new public hearing and any draft, any re-draft would have to go through
a code committee meeting hearing and I can guarantee you, any board member here would be
happy to meet at night.
MR. VANDENBURGH: So we can return the original draft, the original legislation, the original
code back to the beginning and kind of rework this through the code committee?
SUPERVISOR RUSSELL: Yes. I think it would serve both sides because I think there is a
misunderstanding tonight, for instance the fees, people were concerned. We don't set the, there
is no proposal to set fees on a per event basis. The proposal is to set fees at the beginning of the
year like all other fees, building permits fees and everything else by resolution. It's just the
mechanics involved in setting the fees. The fees were to be established, everybody would know
what the fees are, same fees as you go forward.
MR. VANDENBURGH: Okay, and at those code committee meetings there is the opportunity
for the public to come, be heard, offer input?
SUPERVISOR RUSSELL: Yes. What we have is we have a work session, you know the
building inspector, everybody that would be pertinent to the discussion and at the end of that we
would let people speak.

STEVE MUDD: Good evening, Steve Mudd, Southold. Is it fair to assume at this hour, this
public hearing that all you folks up there are amenable to sitting down to rewriting, amending
this code?
SUPERVISOR RUSSELL: We have been amenable the whole time.
COUNCILWOMAN DOHERTY: That's what we are saying we are doing.
MR. MUDD: The other question I have, if this public hearing is cancelled this evening or this
part of this hearing is cancelled this evening and I know we have got to spend a lot of time
rewriting this thing but I have a question on the legality, when a public hearing is cancelled for
whatever reason, how quickly can it be put back on the docket?
SUPERVISOR RUSSELL: It would have to be renoticed....
MR. MUDD: How many days does, legally, how many days it take to put it back on the docket?
SUPERVISOR RUSSELL: We would have to notice it, it would take 30 days for the public
notice after the notice is adopted, 30 days before the Town Board can take action, 30 days before
the Town Board can have a public hearing.
MR. MUDD: We are here less than 30 days, can you explain that to me?
SUPERVISOR RUSSELL: When was the notice...
COUNCILWOMAN DOHERTY: We generally give 30 days, we had the public hearing
scheduled for the Tuesday that we had the snowstorm, so...
MR. MUDD: I understand the weather event cancelled the hearing but we are here less than 30
days and the Supervisor just said that you can't do it less than 30 days.
TOWN ATTORNEY DUFFY: Inaudible.
SUPERVISOR RUSSELL: The law would require 10 days notice but we usually go 30. I
can't...
COUNCILWOMAN DOHERTY: We can't go less than 10 days notice.

We have no idea when we are going to be ready to notice it for public hearing.

question is, when can you legally put it back up to have a meeting?
COUNCILMAN DINIZIO: We have code committee meeting set for the 29th. That is
concerning something that is not this, so we would have to have another code committee meeting
for this, okay, so we can look it all over, try to agree on something, get the language whatever it
is, okay and then we would have to have a Town Board meeting after we have a document we
can kind of say we can put out to the public...
COUNCILWOMAN DOHERTY: You are talking about at work session.
COUNCILMAN DINIZIO: Right. So then we have to schedule, okay, that meeting, in other
words,that public hearing. You are talking a month and a half, at least.
MR. MUDD: But we are here less than 30 days, that's why I am trying to clarify this.
COUNCILMAN DINIZIO: We had everything settled as far as...
COUNCILWOMAN DOHERTY: We just rescheduled it.
COUNCILMAN DINIZIO: In other words, we had the document. We just rescheduled
whatever we had, now we are not. We are going to go back to square one, okay, and hopefully
what I am saying, let's have a one page document as opposed to...
SUPERVISOR RUSSELL: The text was already out there, we had to reschedule because Town
Hall was closed as result of snow which I think is one of the issues that Karen talked about in
that the snow, maybe you guys couldn't meet, I think there were two meetings you guys had to
skip because of the snow.
MR. MUDD: Okay, thank you.
SUPERVISOR RUSSELL: Who else would like to address the Town Board on any issue?
Councilman William P. Ruland
COUNCILMAN RULAND: I would. As I said before, there is a time to listen and there's a
time to speak. I think now is a time to speak. It's obvious again that we'll use the word
communication or lack thereof, however you look at it, I draw some of my remarks to Mr.
Novaks comments earlier. Pretty much now regardless of what's done in the past is yesterday
and we need to look at this as tomorrow, so I am looking at it as tomorrow and the first thing that
is obvious is there are a number of people and organizations represented here this evening and I
would hope that as we go forward, I will certainly propose that a code committee with this much
content to discuss even administrative changes, we would hold it in the evening so that the

business people would have a better chance to either come or be represented by someone who
will come. I also think that to the Supervisor's remarks that we will do a better job in how we
notice. There is a difference between a legal notice which is rather perfunctory and cut and dried
and just giving someone the word that we are going to meet on X evening in code committee at
X place and X time and this is what we are going to discuss and I think that would go a long way
towards informing people in the what, when, where and why. It seems rather, I am not saying
that it is overly simple but I am saying that as we go forward because history has taught us again
that there's something that needs to be done a different way so as we go forward, I think that
anybody whether it's an individual in this room, someone who sees it on tv after it is published
tomorrow, someone who left here and didn't hear all the discussion, has the opportunity to either
come to code committee and offer input on the changes that are going to be or should be made to
the code or whether it's a group or organization that want's to have a representative or have
multiple representatives come and offer something for the discussion. I think that this will go a
long way towards alleviating some of the problems that have happened more than once in the
past. And that is all I have to say.

would not necessarily be at that meeting.
