The public hearing on this matter was held on July 8, 1982.
Upon application for HAROLD E. WALTERS, by Richard J. Cron, Esq., Main
Road, Cutchogue, NY for a Variance to the Zoning Ordinance, Article XI,
Section 100-115 for approval of suitable screening around the periphery of
the existing junkyard located at 400 Nokomis Road, Southold; more particular-
ly known as County Tax Map District 1000, Section 78, Block 3, Lot 20 at
Laughing Waters.
The board made the following findings and determination:
By this application, applicant~seeks approval of suitable screening
at these premises upon which applicant stores scrap materials and has stored
since prior to zoning. The premises in question is zoned "A" Residential
and Agricultural, and contains an area of 9,600 square feet with 75' frontage
along Nokomis Road. Existing on the premises are a 1½-story frame, one-famil
dwelling house~ and two accessory buildings in the rearyard used for storage.
Section 100-115 of the Code requires "...all automobile yards or other
junkyards in existence as of the effective date of this chapter, as first
enacted in 1957, shall within three years from such date provide suitable
screening in the form of fencing or hedges completely around the periphery
of the area used for such purposes, and the type of fencing and hedges shall
be subject to the approval of the Board of Appeals .... "
It is the opinion of this board that the periphery of the entire rear-
yard should be enclosed with a six-foot stockade fencing. Now, therefore,
on motion by Mr. Sawicki, seconded by Mr. Doyen, it is
RESOLVED, that the screening outlined below is required for the
existing scrapyard located at premises of HAROLD E. WALTERS and known as
400 Nokomis Road, Southold, NY, and such screening is SUBJECT TO THE
FOLLOWING:
1. That the paraphernalia (used materials) shall be limited to the
rearyard area;
2. That the rearyard area must be enclosed with a six-foot stockade
fence to encompass the north and south lines from the rear of the house
and the entire west line;

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical dlfficultiesor unneces-
sory HARDSHiP because applicant has been engaged in a collection and
junkyard business for many years prior to the adoption of the Town
Ordinance. The use of his premises is permissible under the Ordinance
as a non-conforming use. Over the years since.the adoption of the
Ordinance, the applicant was of the opinion that he had the approval
of all Town agencies, including that of the Zoning Board of Appeals
with respect to the screening of the premises. In order the this
matter be fully resolved, applicant requests pursuant to Article XI,
Section 100-115 of the Ordinance approval of suitable screening at his
premises as may be reasonably determined by the Board of Appeals.

As per your verbal requests, we are providing copies of the survey
sketch outlining in yellow the junkyard area to be enclosed with
a six-foot stockade fence and a copy of the board's July 29, 1982
decision concerning this screening.
The paraphernalia is to be limited to the rearyard area of this
parcel as shown on the attached map, and to clear any misunderstand-
ings, the parcel in question is the residence parcel known as 400
Nokomis Road, Southold, County Tax Map No. 1000-78-3-20. The
stockade fencing is to be maintained in good condition during the
operation of this business.
We hope that this memorandum will suffice for your record.

in th£s statement because nor only I but a ma3ority of' my fcllot~~ neighbors
in Laughins ~gter are deeply concerned with the lack of e~forcemen~ of the
Zonin~ Code of ~he
The mosz flagrant violator is one Harold L~alters who is operating
a 3uDk ygrd~ principally cars and trucks, On the west side of Makomis lioad
about 300 fee~ south of B~la,;ater Ave. T~le property consists of ~wo lots, ~(1)
on which the ~alters house is located and #(2~ ~he io~ ad3oinil~ the house
zo the north on which the cars and trucks are situated.
'l~e property is zoned Residential. Lot #(1) has an exemption for
a portion supposedly properly screened because ~r. ~alters lived there prior
to the Zoning Code. Lot #(2/ has no exemption for it was only acquired a few
years ago.
B'!r. ~l~ers has been oreviously cited for violations and ordered
by Tov~ Justice Tedeschi zo clean up the premises. He was given a dislnissal
for compliance. ~lis happened a couple of years ago, now the place is twice
as ba~l as it was previously but thc Building Dcpto has not issued another
citation. ~hat we want to know is why? The penalties for violation have been
increased still nothing is done.
i know your schedule is busy but the scene of thc violation is less
than five ~inutes from Town Hall. P. ide over and see for yourscl£ this eyesore

In response to your recent request, I am writing to let you know
that it is my understanding that two board members, Mr. Joseph H.
Sawicki and Mr. Charles Grigonls, have no objection to the minor
change of the fencing on the Harold Walters' property. I, there-
fore, also have no objection to this change based upon the fact
that Mr. Walters is with the understanding that all the junk
(including unlicensed vehicles) will be placed within the fenced
area. If this is not the case and all paraphernalia is not placed
within the fenced area in the very near future, then this amendment
shall become null and void.
I hope this letter is adequate for your files. Thank you for try-
ing to alleviate a long-standing problem that has existed in the
Laughing Waters area.

The Chairman opened the hearing at 7:49 p.m. and read the legal
notice of hearing in its entirety and application for a variance.
MR. CHAIRMAN: I have a copy of a survey prepared on December 18, 1981
by R. VanTuyl, P.C. of the parcel of land which is the nasure of this
application, and a copy of the County Tax Map showing this and the surround-
ing properties. Mr. Cron. ~,j~
RICHARD J. CRON, ESQ.: This is somewhat of an unusual applicatmon.
It's neither a variance or a special exception. It is made pursuant no
Section 100-115 of the code with respect to a junkyard-type of business,
in that the Zoning Board of Appeals makes an lnspec5ion of the property
and to be able to make a determination as to whether there is sufficient
screenmng. As I have indicated in the application, before the enactment
of the zonmng ordinance, he was of ~he opinion a5 the date of the
notice of violation that he had in fact secured approval from the Zoning
Board of Appeals when the zoning ordinance was enacted. Mr. Howard
Terry I think can verify that for the board. That is non the lmpornan~
factor. The importan~ factor is that this board make something in
wrm%lng and have specific requirements mn nerms of screening that we
can comply with...screening reasonable mn nature.
MR. CHAIRMAN: Thank you. Is there any else wishing to speak for
the application?
HOWARD TERRY (pas~ building inspector): Mr. Chairman and Members
of the board. The Zoning Board of Appeals and I have gone and visited
the site, and at that time the zoning ordinance required screening.
I don't classify Mr. Walter's site as a junk operatmon. We did go
through all of these codes. It is my understand that he has made a
research. I sent a letter explaing it to Mr. Walters. The survey you
have before you shows you where he put up the fence and some trees and
bushes. Mr. Walters men the requirements of the board at the time.
It was the chairman, Mr. Gillispie, myself and Mr. Bergen. I can't go
down and look through it.
MR. CHAIRMAN: We also did an intensified search and could find
nothing. It was never acted upon by the board. We did an updated
search for 280-a's in the town, which the Planning Board asked us to
do, and we did go through every application that was ever brought
before the board and at the same time we searched for information
or action concerning Mr. Walters' property and found nothing. However
we did find a lot of 280-a's.
MEMBER GRIGONIS: Baring all the facts, I think it's pretty much
about the same thing.

MR. CHAIRMAN: .Is the~e anyone wishing to speak against the
application? Miss Wickh~n.
ABIGAIL A. WICKHAM, ESQ.: I am here representing an adjoining
neighbor, Leslie Kunst, who adjoins the property on the south. She
is concerned about the screening because it does affect her property,
the saleability and value of the property and is concerned about a
possible ( ) of the property to the north, which was a problem
at ~ome time. Mr. Terry indicated there was some natural vegetation
that doesn't seem to be there any more. She would like to see something
in terms of a stockade fence along that entire area, not only to the
north but also, as you can see, down the road in the front. She likes
the neighborhood and would like it to have a nice appearance, and we
would like the board to take that into consideration. Mrs. Kunst ~
would also like to address the board.
LESLIE KUNST: I own the property on the south side of Mr. Walters'
property, which is 630 Nokomis Road. I am concerned. I have tried to
sell the property. I had an interested buyer, who turned it down for
the reason there were too many cars and his property was unappealing.
I feel now there is no possible re~ale value with the property being
as it is right now. After I bought the property, it was assessed at
a less value for the fact of my neighbor's property, Mr. Walters, and
I think with suitable screening this would help to improve my property
values, and I am concerned aboun my property values.
MR. CHAIRMAN: Is there anyone else wishing no speak against the
application? (None)
MR. CRON: I think it should be an interesting factor as to
perhaps who was first in the area, and the objectant came at a subse-
quent date. Mr. Walters is aware that he has no do some type of
acreening and it is to be of a type this board should consider. The
screening should be reasonable.
MR. CHAIRMAN: Is there anybody else?
MISS WICKHAM: First of all, the code does require Board of
Appeals' approval of suitable screening and there is some question as
to what that screening is, and Mrs. Kunst would like no be given a
brief description as to what type, as she has been there.

hedges of a certain minimum size, link fences -- complying with the

any time. As to what happened in the 1940's and 50's, I'm not sure

The public hearing on this matter was held on July 8, 1982.
Upon application for HAROLD E. WALTERS, by Richard J. Cron, Esq., Main
Road, Cutchogue, NY for a Variance to the Zoning Ordinance, Article XI,
Section 100-115 for approval of suitable screening around the periphery of
the existing junkyard located at 400 Nokomis Road, Southold; more particular-
ly known as County Tax Map District 1000, Section 78, Block 3, Lot 20 at
Laughing Waters.
The board made the following findings and determination:
By this application, applicant'seeks approval of suitable screening
au these premises upon which applicant stores scrap materials and has stored
since prior to zoning. The premises in question is zoned "A" Residential
and Agricultural, and contains an area of 9,600 square feet with 75' frontage
along Nokomis Road. Existing on the premises are a l%-story frame, one-famil
dwelling house'and two accessory buildings in the resryard used for storage.
Section 100-115 of the Code requires "...all automobile yards or other
junkyards in existence as of the effective date of this chapter, as first
enacted in 1957, shall within three years from such date provide suitable
screening in the form of fencing or hedges completely around the periphery
of the area used for such purposes, and the type of fencing and hedges shall
be sub~-ect to the approval of the Board of Appeals .... "
It is the opinion of this board that the periphery of the entire rear-
yard should be enclosed with a six-foot stockade fencing. Now, therefore,
on motion by Mr. Sawick!, seconded by Mr. Doyen, it ls
RESOLVED, that the screening outlined below is required for the
existing scrapyard located at premises of HAROLD E. WALTERS and known
400 Nokomis Road, Southold, NY, and such screening is SUBJECT TO THE
FOLLOWING:

1. That the paraphernalia (used materials) shall be limited to the
rearyard area;
2. That the rearyard area must be enclosed with a slx-foot stockade
fence to encompass the north and south lines from the rear of the house
and the entire west line;

Dear Sir:
As per our conversation in reference to Harold g. Walters (Junkyard).
Visual inspection and photos taken indicate junk or second hand ma-
terials are not confined in any specific area on the property. I
refer you to section 100-115 of the Southold To~m code. This being
a pre-existing non-conforming business does not exempt Mr. Walters
from conforming with that section of the code which says he must
within three years of adoption of the code, provide suitable screen-
ing in the Farm of Fencing hedges etc. that must meet the approval
of the zoning Board of Appeals,for the interest of scenic beauty be-
cause this is in an (A Zone) it is within the realm of the boards
authority, to restrict such activity to the rear yard of the business,
if the board feels it will not hamper such business~Mr. Walters would
still have the right to later appeal for more space if he felt he
needed it. The word periphery can be interpreted in one of two ways~
(at the boards discretion). One~ could mean around the entire pro-
perty line or two that area which encompasses the second hand material.
I would suggest, whichever is less stringent on the ow~er~ again this
would be a Zoning Board of Appeals decision.

SPECIAL MEETING
APRIL 24, 1982 ~'
A Special Meeting of the Southold Town Board of Appeals
was held on Saturday, April 24, 1982 at 9:30 o'clock a.m. at
the Southold Town Hall, Main Road, Southold, New York 11971.
Present were: Gerard P. Goehringer, Chairman; Robert J.
Douglass and Joseph H. Sawicki. Absent were: Charles Grigonis,
Jr. and Serge Doyen.
The Chairman called the meeting to order at 9:30 a.m.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it
was
RESOLVED, to table Appeal No. 2977, application of
Jerome E. and M. Dorothy Bloom pending review and comments
from the Southold Town Planning Board concerning this proposed
division of property.
Vote of the Board:. Ayes: Messrs. Goehringer, Douglass
and Sawicki. Absent were: Messrs. Grigonis and Doyen.

The Chairman discus-~-~-c~ndence from Richard J. Cron,
Esq. concer, ning the Harold Walters Property as to whether or /
not screening for the junkyard had ever received approval from/
the Board. of Appeals, either in 1962 or thereafter. After /
reSearching all our records, we have found no formal ac~i0n or~
informal approval ever mentioned at a public meeting of the
board..There also was no record of any correspondence ~rom
Mr. Gill~sPie, Chairman of the ZBA in 1962, concerning this
alleged screening approval in 1962. The board members authorized
the chairman to reply to Mr. Cron's letter informing him of the
above and after again speaking to Member Grigonis.
