NOTICE OF SPECIAL MEETING
WE, the undersigned, being Members of the Southold Town
Board of Appeals, Suffolk County, New York, do hereby severally
waive Notice of the time, place and purpose of the Special
Meeting of this Board to be held at the Southold Town Hall, Main
Road, Southold, New York on Wednesday, November 2, 1989 at 7:30
p.m., and do hereby consent that the same be held on said date
for the transaction of those business items properly coming
before the Board at said meeting.

SPECIAL MEETING
THURSDAY., NOVEMBER 2, 1989
A Special Meeting was held by the Southold Town Board of
Appeals on THURSDAY, NOVEMBER 2, 1989 commencing at 7:30 o'clock
p.m. at the Southold Town Hall, Z.B.A. Office, Main Road
Southold, New York.
Present were: Gerard P. Goehringer, Chairman; Member
Charles Grigonis, Jr; Member James Dinzio, Jr., also present was
Doreen Ferwerda, Secretary (Absent: Member Serge Doyen, Fishers
Island and Member Joseph H. Sawicki).
The Chairman opened the meeting at 7:30 p.m. and proceeded
with the first items on the agenda, and the following action was
taken:
SCHEDULING OF HEARINGS:
On motion by Mr. Grigonis, seconded by Mr. Dinizio, it was:
RESOLVED, to schedule and advertise the following matters
for a Regular Meeting on November 8, 1989, in regarding the
following Appeals:

Special Meeting - November 2, 1989
On motion by Mr. Dinizio, Seconded by Mr. Grigonis, it was:
RESOLVED, to GRANT as applied, the Appl. No. 3~42 -
Cliffside (Tide Mark), SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the motel have 68 units and 1 manager unit.
2. That it not exceed 600 sq. ft. in size.
That the turning lane on the egress, to be added on
the island, Site plan by Henderson and Bodwell, Dated:
11/6/89, that there be erected a small sign placed on
the west side, indicating right turn only.

That it keep back 100 ft from bluff, except for ramp
leading down, 30 ft. buffer.
That together with erosion controlled plans, which
have been developed with the suggestion of the Board
for this Special Exception, that hay/straw bales be
placed outside the 100 ft. Mark (landward) during
construction.
That it is the understanding of this Board that only
the Managers Unit will contain kitchen facilities.
That a contract with the Village of Greenport exists
at the commencement of this construction project.

ACTION OF THE BOARD OF APPEALS
Appl. No. 3542
Matter of CLIFFSIDE (TIDE MARK). Special Exception to the
Zoning Ordinance, Article V, Section 100-50B (Article XIII), for
permission to construct 76 Motel Units in this Resort/
Residential (RR) Zone District. Property Location: 61475
County 48, Greenport, County Tax Map No. 1000, Section 045,
Block 01, Lot 01.
WHEREAS~ a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of CLIFFSIDE
(TIDE MARK) under Appeal No. 3542; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of County Road 48, Town of Greenport, and is identified on
the Suffolk County Tax Maps as District 1000, Section 045, Block
-01, Lot 01.
2. This is an application for a Special Exception from
the Zoning Code Article V, Section 100-50B, (Article XIII), for
permission to construct 76 Motel Units.

3. At the time of this hearing on 9/21/89, by letter to
the attorney for applicant, the Code sections were changed to
indicate updated Section of present Code, Article VI, Section
100-61BC4), as corrected. ~
(1) Article VI, 100-61B C4), the nature of this
present application is for a special exception for 68 motel
units and one manager's unit on this 7+- acres. As directed by
Final Draft Environmental Statement on this project.
C2) Hotel or motel uses as set forth in and regulated
by 100-61B(4) of the Resort Residential CRR) District.
(3) Definition of a Motel: Buildings or Building
providing overnight accommodations for motorists Cp.764,
Language of Zoning, taken from New York Zoning and Practice,
Third Edition, By Robert M. Anderson).
4. In considering this application, the Board finds and
determines:
Ca) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that the area chosen for the Motel Units are not
unreasonably located;
Cc) that the Special Exception will not in turn cause
substantial effect on the safety, health welfare, comfort,
convenience and/or order of the Town;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the Special Exception, as applied conditionally noted
below.

RESOLVED, to GRANT a Special Exception in the matter of the
application of CLIFFSIDE (TIDEMARK) as applied under Appeal No.
3542 for the placement of 68 Motel Units and 1 Manager Unit,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 68 Motel Units notoDF~c~ed 600 sq. ft. in size.

2. That a sign be placed on.west-side of turning lane, to
be added on the island, as shown on Site Plan of Henderson and
Bodwell, Dated 11/6/89, indicating right turn only, the sign is
to be approximately 2 sq. ft. in area and placed in full view of
all vehicles exiting from complex.
3. That all construction be setback a minimum of 100 ft.
from the bluff, with the exception of the ramp leading down to
beach.
4. That together with erosion controlled plans, as
indicated in DEIS, it is the suggestion of the Board for this
Special Exception, that Hay/Straw bales be placed outside the
100 ft. mark (landward) during construction.
5. That it is the understanding of this Board that only
the Managers Unit will contain kitchen facilities.
6. That a contract with the Village of Greenport exists
at the commencement of this construction project, for water and
sanitary facilities.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
and Dinizio. This resolution was duly adopted.
