In 2014, the Board issued a Letter of Non- jurisdiction for a proposal to construct a dwelling and sanitary system. The Zoning Board of Appeals granted a variance in 2014 limiting lot coverage to 24%. Stacey Bishop on behalf of FORDHAM HOUSE LLC, c/o DENIS BOUBOULIS requests a Wetland Permit to install a ±1,167sq.ft. on-grade paver patio along the seaward side of the dwelling; extend existing westerly 15' long by 10' high by 12" thick concrete and stone veneer retaining wall an additional 35' seaward for a total length of 50' beginning"at the left rear corner of existing dwelling; at seaward end of westerly retaining wall, install a 28' long, varying height concrete and stone veneer retaining wall parallel with the dwelling; along easterly side of property, extend existing 3' high natural stone retaining wall an additional ±45' seaward; approximately 15' seaward of proposed 28' long parallel retaining wall, install a ±3' high by±45' long retaining wall situated approximately 1' landward of established 50' wide non-disturbance buffer; and to install a generator pad, generator, and buried gas tank for the generator. SCTM# 1000-21-5-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the LWRP Policies 4 and 6 and therefore is_ INCONSISTENT with the LWRP: The proposed action does not comply with a 1975 filed Covenant and Restriction (Liber 7969 page 274) placed on the lot within the subdivision known as Pebble Beach Farms. Clause 10 prohibits the construction of any part of a dwelling northerly of an approximate 100 foot bluff set back line unless approved by the Town of Southold. The text of the clause is included below. 10. An owner of a water front lot facing on the Long Island Sound shall not construct any part of the dwelling northerly i, of the approximate 100 foot bluff set back line shown on the f filed map, unless approved by the Town of Southold. The patio, retaining walls, generator and buried gas tank would be located within the 100 foot bluff setback and closer to the Top of Bluff and Coastal Erosion Hazard Area. The 50' wide non-disturbance buffer is recommended as CONSISTENT. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Right elevation...extend existing retaining wall constructed under existing Building Permit into Trustee Jurisdiction to meet the rear of the property.Wall needs to be extended approximately 45'and will remain approximately 3' height. Material will be natural stone as used on the existing wall. 2. Left elevation...extend existing retaining wall constructed under existing Building Permit into Trustee Jurisdiction. Existing wall extends'15'towards the bluff from the left rear corner of the house. It is approximately 10' high and 12"thick.Application seeks to extend the wall an additional 35'towards the bluff.At this point,the wall will stop,allowing a 15'sloped opening into the back yard for access(lawn mowers,etc).At the end of this retaining wall, a new wall will turn right to allow protection for the generator and buried gas tank also sought in this application.This portion of the wall will extend no more than 28'towards the right(as shown on the survey)and will be of varying height to accommodate the sloping rear yard.The material used for this retaining wall will be poured concrete,covered with stone veneer. 3. Rear elevation...install rear retaining wall beginning approximately 1'in front of the nondisturbance are(to ensure any footings don't encroach into this area)for the width of the rear yard.The height will be approximately 3'at the right rear yard and continue to the left. It may vary slightly dependent upon topography but will follow the sloping yard towards the 15' egress opening at the right side (as shown on survey).The owner is undecided as to the material for this wall: it will either be poured concrete covered with stone veneer,or continue the natural stone from the right elevation.
