From: Mark Terry, LWRP Coordinator

Re: LWRP Coastal Consistency Review for BRENDAN & KRISTINA TULLY
SCTM# 1000-80-5-4.1
Jeffery Patanjo on behalf of BRENDAN & KRISTINA TULLY requests a Wetland Permit to
install 88 linear feet of vinyl retaining wall landward of existing bulkhead; install a 10'x20' un-
treated deck landward of existing bulkhead; and to establish and perpetually maintain a 25' wide
non-turf buffer along the landward edge of the bulkhead and along the bluff face. Located: 220
West Shore Drive, Southold. SCTM# 1000-80-5-4.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization'Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the action to install 88 linear feet of vinyl retaining wall landward of existing bulkhead; and
to establish and perpetually maintain a 25' wide non-turf buffer along the landward edge of the
bulkhead and along the bluff face is CONSISTENT with the below listed Policy Standards and
therefore is CONSISTENT.
The proposal to install a 10'x20' un-treated deck landward of existing bulkhead in
INCONSISTENT with Policy 4 of LWRP which states: Minimize the loss of life, structures, and
natural resources from flooding and erosion. -
Structures located in FEMA VE (velocity hazard) flood zones are subject to damage and
loss during storm events.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
