INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted in triplicate to the Building
inspector, with 3 sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and giving a detailed description of layout ofproperty must be drawn on the diagram which is part of this application.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

Dear Ms. Ford:
In reply to your August 3, 1982 correspondence, please find
enclosed herewith a copy of this board's "Positive Declaration"
pursuant to the N.Y.S. Environmental Quality Review Act concerning
the proposed windmill-and-water-tower project to be located at
Orient.
Solwin Industries Ltd. has made two applications: [1] a
variance application (Appeal No. 2971) for permission to: (a)
construct towers exceeding the height limitation of the zoning
code and (b) obtain an interpretation of Section t00-90A to the
effect that a 'windmill farm' is a permitted industrial use
in this "C-i" zone; and [2] an application for a Special Excep-
tion for a windmill farm to be located on premises zoned "C-i~
Article IX, Section 100-90A (Appeal No. 2975).
Both files are quite bulky and are similar in context. Perhaps
you should contact our secretary, Mrs. Linda Kowalski, indicating
which documents (available at 25¢ per copy) you are particularly
interested in. The following are documents on file which may be of
interest to you: (1) applications, (2) maps, (3) 21-page memo-
randum submitted by applicant's attorney, (4) minutes of the
6/17/82 hearing which has been recessed without date at this time,

Dear Mr. Esseks:
Please be advised that the Board of Appeals at a Special
Meeting held Saturday, June 26, 1982:
(1) Rescinded their June 17, 1982 resolution which origi-
nally scheduled these matters for a recessed date of July 29th;
(2) Rescinded their May 26, 1982 resolution which originally
determined this project to be a "Type II" Action and declared a
"Negative Declaration" pursuant to the requirements of the N.Y.S.
Environmental Quality Review Act [SEQRA];
(3) Determined this project as applied for in Appeals No.
2971 and 2975 to be a "Type I" Action which may have significant
adverse effects upon the environment inasmuch as this project
involves the construction of new non-residential facilities
which meet or exceed any of the following thresholds: [a] a
project or action involving the physical ~lteration of 10 or
more acres; [b] a project or action which would use ground or
surface water in excess of 2,000,000 gallons per day; [c] any
structure exceeding 100 feet above ground level without regula-
tions pertaining to such height. The reasons for the "Positive
Declaration" pursuant to SEQRA are contained on the attached
Notice of Declaration.

ENVIRONMENTAL DECLARATION:
Pursuant to Section 617.6 of the N.Y.S. Department of Environ-
mental Conservation Act and Section 4404 of the Southold Town Code,
the Board of Appeals of the Town of Southold declares itself lead
agency in this proposed project and hereby classifies same as a "Type I"
Action which may have significant adverse effects upon the environment
for the following reasons:

Re: Variance Application of Solwin Industries Ltd."windmill farm"
Dear Members of the Board:
Solwin Industries Limited is requesting a special
exception to Art. IX 100-91. This Article does not
permit building to a height over 35 feet. The request
of a special exemption was Made in the Appeal From
Decision of Building Inspector April 2, 1982. In
this document it is stated that strict application of
this ordinance would produce practical difficulties
or unnecessary hardship because:
1. the windmills to be erected will not work
efficiently, unless they are at the height of 110 feet;
2. to place the windmills at the site, where the maximum
allowable height is 35 feet, is to reduce the efficiency of
the project to the point where the project will not be
feasible at all;
3. in order for the "windmill farm" to be effective
during periods of time when the wind is not blowing, the
"farm" requires water resevoirs as shown upon the survey
annexed to the application which water resevoirs will have
a total height of 150 feet each.
The purpose of this document is to clarify the overall
situation of wind power in general as well as to discuss
the various uses of the word efficiency. In the conclusion
section, each of these three points will be discussed
specifically.
The Nature of Wind Power
The wind resources of the world have provided power ~
for numerous tasks throughout history. More recently, in
the United States because of escalating energy costs and
uncertainty of conventional fuel supplies, interest in
generating renewable energy from this fuelless resource
has increased. The wind field accross the USA has b~en
evaluated by numerous government agencies and data regarding
the potential hi energy areas has been compiled. The ~
chart below published by National Science Foundation is
typical.

This map has been prepared by extrapolating high
altitude windspeed measurements down to a standard height
above ground level. Other maps are based mainly on
measurements obtained near ground level at airports.
However, airport locations are, generally, purposely chosen
to avoid sites where local topography might result in
high windspeed, thus airport data is of questionable
value in assessing the potential wind resources in the
USA.

The Power of the Wind
Wind has some very interesting pecularities in
its nature. The first element in the discussion
is the fact that the powe~ available from the wind
varies with the cube of the windspeed. This means
that doubling the windspeed inc.~eases the power by 8.

Other pecularities of the wind is that it changes
direction and speed on a daily and seasonal basis. The
effect of these daily wind patterns is that wind power
from a windmill will vary throughout the day. A typical

The relationship of terrain features also affects
the speed of the wind. Thus in areas where there are
fewer obstacles, the windspeed is greater nearer to the
ground. This is illustrated in the chart below from
"Windpower for Small Farms and Industry". The actual value
of this chart is that it shows the relative relationships
for various surface features, however it does have %imitations
in that the scale is not consistent.

addition of windmills will have an effect on the overall

Another pecularity of the wind is that i{ tends
to produce a high velocity component due to a compression
that occurs when it travels over an obstacle. Thus the
winds over an island could be higher than over the water
due to this effect. This is illustrated in the following
chart by NSF. The compression of the streamlines represents
a higher wind velocity field.

The wind has another interesting quirk in.that it is
not possible to extract the full power available in the
wind because a certain flow must be maintained to move
the air that gets slowed down by its encounter with the
blades of the windmill. The theoretical limit of extraction
efficiency is called the Betz limit and varies with the
ratio of the speed.~f the blade to the speed of the wind.
A typical chart by NSF is shown below. Different types
of windmills exhibit different efficiencies, these various
types with the general performance of each type are shown.

Wind Machines
The choice of a wind machine is a very important
aspect in the actual production of power from the wind.
Solwin Industries Ltd. has evaluated the numerous design
choices that are available and has selected the Savonius
Rotor as the best choice in light of the numerous legal .
and institutional issues as well as the maintenance
and longevity requirements. Each of the types of machines
are discussed below. The machines can be split into two

Solwin Industries Ltd. has imposed the following
design criteria in chosing a windmill to produce as
a product.
Should have:
Low rpm
Self starting ability
Relatively high power coefficient
Ability to shed ice but not throw it
Long life
Ease of maintenance
Access to transmission and generators
Omnidirectional wind pickup
Modular structure
Should not have:
Interference to TV signals
Noise
Sensitivity to wind turbulence
Complicated steering mechanisms
Mechanical blade pitch control
The answer to all these design criteria has been
the selection of the Savonius type rotor. A wind turbine
constructed in this fashion has the generator and
transmission close to the ground for ease of inspection
and service. The rotor can be stacked into,power trains
by adding other rotors above. Any ice that is shed will
fall within the radius of the height ~f the tower. Because
of the low tip to wind speed ratio, the rpm will remain
low, bearing life is enhanced. The windmill can be made
simply using standard sheet metal fabrication techniques.
Complicated controls to vary the pitch of the blades or
s~eer the machine into the wind are avoided.
With the basic style of machine selected, $olwin
'has developed it into a modular arrangement where one
size of rotor can be repeated a number of time9 and attached
to a tower to take advantage of the increased windspeeds
with height. A sketch of a tower equipped with Solwin

Wind Power Applications
When considering a windmill to provide power,
numerous design choices are available. A chart of
the possibilities is shown below.

Viability of Wind~ower
The wind is a highly variable resource as has been
shown from the previous discussion. Harnessing
this resource to provide electrical power is a
task that requires paying attention to all the varying
parameters in both supply and demand for the power. ~
The method of harnessing the fluctuating wind power
to the fluctuating demand for electrical energy is
to connect it to the grid of the public utility networks.
By connecting to the grid, the utility company effectively
becomes the storage medium in the system. Thus they
have the advantage of getting power into their system
when the wind is blowing and thus would not need to
have as much generating capacity on the line. This
type of set up has added advantages for the utility
in that transmission line losses to the service area
near a wind facility are reduced. In order to stimulate
this type of activity, the Federal Government has passed
the PURPA law which requires the utilities to purchase
power at their avoided cost. Solwin has contacted
LILCO, the local power company, they have shown great
interest in participating in this type of arrangement
and have also indicated that if a wind facility can be
made to store energy and then release it on demand,
LILCO would be willing to pay a premium for the pgwer
delivered during peak usage periods.
In evaluating the possibilities of storage, Solwin
has chosen to demonstrate a system that would utilize
water tank storage of energy derived from the wind.
This system can then be made to release energy on demand
thru hydro electric generators. A diagram from NSF
shows the possible storage choices available.

The energy farm will consist of extraction systems to

a distribution system to distribute the energy to the
light industrial ,,nd home users. Thc, methods of extraction
will vary depending on the location but will consist of
wind turbines, phc, tovoltaics, solar ponds and solar water
I~cating p'anels. The storage of energy will be accomplished
by the utilization of hydro storage towers, batteries and
thermal ponds.
The light industrial use of energy can be in the form
of electricity, process heat and water pressure. The home
use of the energy will be in the form of district heating
~nd cooling as well as electricity. ~
The initial plans for the development of the
Energy Farm consist of developing two locations.
Near East Marion, Long Island, Solwin will be developing
a 27.5 acre tract utilizing Wind Turbine Towers, Hydro-
storage Towers, Photovoltaics, Solar Pond and Stand by
generators to provide electricity for Greenhouses and
light industry that will be located at the site. Any
excess power generated will be sold to LILCO.
Near Saugerties, New York, Solwin will be developing
an 88 acre tract utilizing Wind Turbine Towers and
~ Solar Pond to provide electricity and heatin~
for a condiminium complex. Any excess power generated
will be sold to Central Hudson Gas and Electric Co.
The East Marion Energy farm will be capable of
providing 12 Mwhrs per day of electricity and 20 MBtu
per day. The Saug~rties £~urgy farm will provide
8 Mwhrs per day of electricity and 20 MBtu per day.

on an austerity power budget, the wind farm is designed to supply ·
as n~mny as 250 ~s if t~y are able to keep their demand for
power in an en~rgency situation to lkw or in real terms/a refrigerator,
a TV, an~ 2 to 6 lights.
Local roadside business such as vendors, gas station operators,
restaurants also will benefit as an installation of this nature
will bring n~ny persons to the area who are also interested in
developing similar systems for their ccm]nunities.
Because w~ter towers are envisioned as a part of tbs final
develo~x~%t of t~ site, the adjacent area may be able to benefit
by utilizir~ waterpressure s~pplied by wind power. Wit]% a future
tJuLnking cc~m~ity, plans can be made now that will determine the
maximin benefit to the cz~anunity.

Efficiency
The efficiency of any system is the measure to
which it utilizes the energy that is put into the
system in the conversion to another form of energy.
In conventional systems this is expressed in miles
per gallon or kilowatt hours per gallon of fuel.
In wind machines this term efficiency expresses
the amount of power recovered from the wind in any
given wind speed. However, when looking at a project
from the overall standpoint, efficiency can mean
how long the system lasts versus how much material
it takes to produce it. In some cases what is termed
efficient in one situation is not in others. For
example, a windmill on a small suburban house is
usually not considered efficient or cost effective
because the cost of the delivered electricity is
low, however that same windmill on that same house
away from the utility lines becomes very cost effective
and efficient if the costs of installing the power lines
to the house are considered. Thus ~fficiency is in
reality a term that encompasses all aspects of an
installation and even can encompass such untangibles
as future energy cost increases,environmental impact
and costs of cleaning up pollution caused by excessive
fossil fuel burning or nuclear waste.
Conclusion
The windmills as designed are 110 feet tall. The
height was arrived at because of considerations of rotor
spacings, effective utilization of the structure, level
above which wind power is available, transmission and
generator sizing and penetration into the wind field.
In reality the greater the height the more wind power
available but, in coming to grips with reality, the
height was chosen as a practical and attainable objective
for a windmill.
If it is decided that the maximum height cannot
exceed 35 feet, this means that the windmills as presently
designed cannot be installed. It also means that there
is a great probability that windmills on any type cannot
be used because of the blockage of wind by the surrounding
trees.
In order to provide an output of energy in a low
wind condition, the concept of energy storage has been
developed. This energy storage will be in the form of
water. In order to get the most amount of energy from
water high tanks must be employed. A chart showing the
relationship of height to energy output has been compiled
by the New York State Energy Research and Development
authority is included on the next page. In making design
decisions on this project, the height of 150 feet for the
water storage tanks was chosen as a practical and attainable leuel.

Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed in this
appeal application is hereby classified as a TYpe II Action,
not having a significant adverse effect upon t~ environment
for the following reason,(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects

Enclosed please find correspondence from William W. Esseks, Esq.
received today concerning: (1) a request to place a 15' high
portable windmill temporarily at the Town Hall, and (2) the
variance application filed with the Board of Appeals for a
windmill farm to be located off the Main Road in East Marion.
The variance has not yet been scheduled for public hearing by
the Board of Appeals inasmuch as we are awaiting additional
information concerning the access and topography of the East
Marion site.
Also, Mr. Esseks has requested to meet with members of each board.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
1. the windmills to be erected will not work efficiently,
unless they are the height of 110 feet;
2. to place the windmills at the site, where the maximum
allowable height is 35 feet, is to reduce the efficiency of
the project to the point where the project will not be
feasible at all;
3. in order for the "windmill farm" to be effective during periods
of time when the wind is not blowing, the "farm" requires water
reservoirs as shown upon the survey annexed to the application
which water reservoirs will have a total height of 150'feet each.
